Defense Lawyer to Misty Cummings: “Shut Up!”

The Bald Truth has learned that detectives investigating the Haleigh Cummings case tried to quiz Misty Croslin Wednesday night after her arrest on felony drug trafficking charges about what she may know that could finally crack the mystery of what happened to the missing five year old she reported missing almost a year ago.
But Haleigh’s ex stepmother refused to cooperate, on advice of her attorney, Robert Fields of Palatka, Florida. “I advised her to invoke her right to remain silent and let her attorney do any talking,” Fields told me in an exclusive interview I reported on CNN’s Nancy Grace Show Thursday night.
Fields told The Bald Truth he doubted Misty would be leaving St. Augustine, Florida’s St. Johns County Jail anytime soon. She’s facing a $950,000 bond that would require she pay ten percent, or a $95,000 cash fee for a bondsman to guarantee Misty would show up in court.
Hinting at a possible defense strategy, Fields scoffed at law enforcement’s claim the drug case against Misty was developed without any consideration of her role as what amounts to a person of interest in the Haleigh Cummings case, and apart from any ties she has to the other drug defendants. Misty’s lawyer said his client was targeted for drugs as a way to pressure her for information in the missing child case, and that police denials were like arguing there’s “no pink elephant in the living room, when you’re looking at the elephant.”
“If law enforcement wants to set up a drug deal to get painkillers off the streets, they could target a lot of people in Putnam County,” Fields told The Bald Truth. “But they targeted only people with ties to Haleigh Cummings. How can they say the drug case and the Haleigh case are a separate matter?”
But the special agent in charge of the tri county drug task force that oversaw the successful undercover operation, told me local police acted on a tip the accused were selling dangerous prescription drugs that have become an epidemic in Florida, and had to be taken down. Dominic Pape of the FDLE tells The Bald Truth the drug investigation was apart and unconnected to Haleigh Cummings, though law enforcement conceded they’d be delighted if the case could be cracked from any new leverage the drug busts might give Putnam County in the missing child case.
To maintain the integrity of the drug cases as a standalone probe, and avoid giving defense lawyers a freebie “target” defense in the drug cases, Lt Greenwood tells me Haleigh Cummings task force detectives were kept in the dark until the day before the drug bust went down. But Fields maintains “it’s pretty much impossible to say they are separate.”
Over the last year, sources close to the case have told me investigators brainstormed and day-dreamed of a way to pressure Misty to cooperate in the Haleigh case, cranking up the heat every chance they got–putting brother Tommy in jail on a gun theft charge with a whopper of a bond, sending Misty’s mother to jail on an unrelated check theft charge, keeping Misty broke and isolated until she got desperate to make a buck.
One of her co defendants, Misty confidante Donna Brock, who spoke exclusively with me over the last few months, has told The Bald Truth that law enforcement leaned on her to cut Misty loose, stop giving her rides, buying her meals, enabling her in any way, hoping she might crash and burn, and get desperate enough to do something, anything that would land her in jail to stew and consider the consequences of remaining tight-lipped.
Donna Jaquith, who owns a Palatka, Fla. Bonding company and has bailed out Ronald Cummings and members of Misty’s family before, tells me she got a call from Misty sister in law Lindsay Croslin Wednesday night, asking how much it would take to spring husband, Tommy. He’s charged with one count of drug trafficking and faces a $100,000 bond.
Ordinarily Jaquith, tells The Bald Truth, the fee would be $10,000, but she told Croslin she’d accept half and finance the balance if she could come up with $5,000 cash. She hasn’t heard back, but wants to cut them a break. “The Cummings and Croslins have been very good clients,” she told me, “very good for business. Of course, I hate to see anyone get arrested.”
Even Jaquith says she’s experienced pressure from law enforcement to back off, and let them the Cummings or Croslin clan stay in jail if they get popped. “One detective stopped in to say, ‘You’re not bailing them out again, are you?’” Donna had to remind the officer that was her business.
Also behind bars in St. John’s County: Misty confidante Donna Brock, facing a $250,000 bond for one count of trafficking. She told a circuit judge at her first appearance hearing Wednesday that she didn’t have an attorney, and was assigned a public defender.
Meanwhile, Ronald Cummings remained behind bars in Flagler County, charged with three counts of trafficking that earned him a half million dollar bond—as police deliberately kept him separated from the others.
According to Lt. Greenwood, it’s standard strategy for police to separate suspects in a major drug case with multiple defendants, so they “don’t have a chance to get their stories straight.”

Art- Well it appears that LE has followed the “oxycontin trail”!!! My gut has said for months that needed to be done!!! Something else my gut has said is that Ron’s mother needs to be questioned about her statements she made on Nancy Grace about her use of oxycontin. LE needs to know did Ron’s mother have a prescription for oxycontin, and if so why, and if not, how did she obtain it?? Also, Misty stated in an interview that Haleigh used to get leg cramps in middle of the night, and Misty had to rub Haleigh’s legs, kinda an unusual statement, imo. It does appear that perhaps Ron and Misty did give Haleigh oxycontin, and this may have been Misty rationalizing the reasons why, “the leg cramps”. As you and I know, when oxycontin is crushed, the time release is destroyed, and likely this is how Haleigh was given the oxycontin with bread and jelly or by other means!!

I only have one thing to say,if the PCSO has looked for anything to get Misty on I am sure they could of thrown some charges on her the night she was in College Arms,or how about the many times she has driven without a license.I have seen them put other people in jail for alot less.She has acted like she is untouchable,if it was me in that situation I would be walking a fine line.Not to mention looking for Haleigh.And doing everything I could to help.Like they say actions speak louder then words.

Is he an informant? Is that why Robert Fields told Misty she is not allowed to talk to Ron Cumming? Did he know something like this would happen? I mean I doubt he would loose his son over this but why is he so happy? Is it just that he knows all will see this? I guess we will just have to wait and see if Ron walks out of jail on this one.

As far as the bonding company and Mr. Fields are concerned, they are in it for their job. As long as LE was within their legal limits, they had every right to arrest them. They are accused of a very serious crime. Plus, a little innocent girl is still missing and if this helps them get to the truth then I say more power to them. Haleigh didn’t commit anything illegal, why is Misty getting any sympathy anyway? If she did what they claim she did(the drugs) then she deserves what she gets, she had the choice. I was a bit disappointed to learn, but not too shocked, that Ron is involved in this, but I would actually love what native in canada says to be true, that this is all a setup to get Misty. I really have no pity for her, once you break the law like that, you have to pay some sort of price.

WRITING A PATIENT PRESCRIPTIONS FOR THE SAME DRUGS – EACH WITHOUT KNOWLEDGE THAT ANOTHER DOCTOR IS DOING THE SAME. THE CASE IS PENDING.THE DRUGS INVOLVED? OXYCODONE AND HYDROCODONE.

There is definitely a great argument to be made that these parallel investigations are connected – and rightly so. The environment that Haleigh was subjected to was not just of an irresponsible drug dealing father – but more one of an entire family participating in a lifestyle which clearly includes drug abuse and criminal activity.
Every single member of the Cummings and Croslin clan are tainted and intermeshed – and in a climate such as this, an innocent child is bred into nothing less than a risky lifestyle – ripe, because of the nature of it’s characters involved – where a “disappearance” such as this occurs.
If this were medicine, it would be called cancer – and the treatment would be to remove it. all of it. In this case, unfortunately, the only removal possible is by long term incarceration at the taxpayers expense (and a heavy one at that) in the hopes of educating discouraging others who may be on the same path as this “family” of unproductive citizens.

I can’t imagine anyone would think that Ron would be an informant on his very own squeeze. Why would he want her locked up? She may get a notion to tell all about Haleigh. Where would Ron be then? He is probably smiling because he has always gotten off every time he has been arrested for drugs and the charges have been dropped. I don’t think that is going to happen this time. Having, at one time, been married to a bad man, I recognized him for what he is when I first saw him. I couldn’t believe Nancy Grace couldn’t see that. Now I understaand that LE is being adamant that they are being held on drug charges and not anything to do with Haleigh, but the way I see it, one of these losers is gonna roll, trash like this snitch their mouths off to save their own asses. Now I never wanted to beleive that Ron KNOWS that Misty killed his daughter and I thought when he divorced her, that would be it and now I think it was a total smoke screen because people got on his case because of her. Now she is being held on $950,000 no bailbond company is gonna post this for her unless she comes up with $95,000 and it is highly unlikely that will happen. Now I know once again she has refused to cooperate with LE, she was raised by her scum parents, theyu taught her to fear police and lie like hell to them. But this might work to LE’s advantage. The longer any of them is behind bars, espcially Ron, I feel he will roll on Misty so we might know sooner than later where Haleigh’s body lies because we all know she is not alive and died that night. It is time for the truth to come out and Misty is now an adult so she would not be charged in juvenile court. I think she either overdosed her intentionally or to knock her out so she could go partry and came home and found her dead and all this time she has been a selfish, loser low life piece of gutter trash and she needs to give it up.

Kelly – I believe Ron is smiling for one of two reasons; a) he’s on pain killers and couldn’t feel pain, or fear if he tried, b) because he’s trying to look like he has nothing to worry about, because he’s innocent and this is all Misty’s doing.

Not stupid, just frustrated, like many frustrated people who dissed our reports citing sources close to the case detailing a plan by LE, deliberate, focused, however slow-moving, to put Misty in such a desperate situation that she would be tempted to do desperate things … get busted and be forced to reveal what she may know about a baffling mystery police believe she holds the key to cracking…Facing 25 years behind bars, or more, she may become inspired to yak, they hope, and lead police to Haleigh, or her body. Who needed a tip, with Misty’s 911 call reporting a mugging while drugging with pals, a brother found passed out at the school bus stop with a lap full of possible pills, a father who once blamed his brief son in law (Ronald) for trying to poison him with bad drugs, a decapitated rat in a mail box, a Mom once addicted to crack and parents who publically aired their suspicions because they were mad at Misty? Why were they mad? Well, Donna Brock once told me Misty had confided they were mad because she “wouldn’t share her valium.” Their behaviour could have been the tip off as easily as someone who bought “bad shit,” and decided to rat them out–Art
4. He may have been a snitch when it suited, but LE denies he was ever an informant, paid or otherwise. When he allegedly showed up with Misty to sell the undercover cop drugs, three out of the seven times she sealed the deal, he was simply busted, no get out of jail free card anymore, if he ever had one, which I’m don’t buy. I just think he was lucky, if dumb, and his cronies were dumber.

Having interviewed Amber Brooks, Ron’s first squeeze of this bunch who has her own issues, and Crystal extensively early on, there were lots of similarities in Ron’s behaviour, from playing Russian roulette and threatening suicide, to drugs and emotional abuse…then according to what Nay Nay Prevatt told me, Misty reported he squeezed her into a little ball when he thought she was pregnant by another man and tried to abort the imagined baby, inspiring her wild 4-day revenge romance of sex and drugs with White Boy Greg we broke on The Bald Truth in our exclusive interviews with Greg Paige and Nay Nay Prevatt. One interesting note about the illegal prescription drugs she was allegedly selling, among them, Roxycodone. this whole situation is just tragic.
And I know I’m going to get flayed for this, but my heart just breaks when I think about Misty Croslin.
Do I think she had something to do with it – absolutely.
Aside from all of that (and please, don’t think I’m trying to be cavalier or brush aside anything she did), I just cannot imagine being 18 years old and just continuing to always make the worst possible choice in every single situation. Just imagine being 18 and having so completely screwed your entire life. Zero to look forward to.
Even if it turns out she is completely innocent of having anything to do with Haleigh’s disappearance (very unlikely, I know), the choices she continues to make, the environment and situations she continues to put herself in…I wouldn’t wish her life (which she has largely created herself) on my worst enemy.
I don’t think Misty will ever “confess.” I just see more tragedy coming. I’ll be surprised if Misty sees her 21st birthday.

This is the best thing that ever happened to Misty. This is LE’s shinning hour, allegedly. They don’t get it its not her and they are hardly going to come out as a beacon light that leads the way to Haleigh. When it is all said and done and this girl is free again IMHO Putnam seems like the last place she should go. Get a grey hound close as possible to the border walk across and never look back. American Police are quite different when it comes to having another agency breathing in on their methods case in point; Laurie Bembenek.

Drugs are too easy to get and use, until it seems you really need them.
I’d just like to see it possible for people and pets to be able to get them free when needed without paying for blood tests to be done just to pocket bucks.

Art, I am a little confused here, please enlighten me. Donna Broch, how is she into this drug stuff with the yahoo family? I was under the impression that when she first befriended Misty, she was supposedly “undercover” and sent by Tim Miller? was there any truth to that, and if so, then WHY in the world is she still associated with the Croslin/Cummings yahoos??

Looking at Ronald’s mugshots give me the creeps. He looks as if it’s all a joke. Is he proud? Hopefully he will not make bail this time, and they can also start laying more pressure on him too. My gut just tells me that he knows more about HaLeigh’s disappearance then he would ever reveal without massive pressure put upon him. He knows, and isn’t telling, so it makes him as guilty as the person who did anything to that precious child. All of his crocodile tears never fooled me for a minute ! Something doesn’t smell right in Florida, and it’s coming from Ronald ! Peeeewwwwww !!

Thanks for answering my questions Art. I have so much respect for PCSO and your reporting on Haleigh. I so much hope that one of these druggies will roll. I just found out through reading about Roxys, I kinda do not understand the whole pill thing. I understand about pain pills, but when people report or talk about oxy, roxy and hydrocodine I tend to get very confused. The one thing I have read, is that these 3 will be very sick in the next 2 weeks. With that being said, I hold out hope that someone will Roll. It is time for Haleigh to come home. Ronnie and company was not out looking for Haleigh, they were just getting high, which tells me they did not skip a beat. And it does suggest someone in that bunch knows what has happened to Cutie Pie. I have always called Haleigh that because of her cute smile. Something tells me the jail house letter was very accurate, we just do not know what pond they put her in. I cannot for the life of me keep living as though nothing has happened, I think that is what I am having a hard time with. I cannot grasp that concept of them living like nothing happened. 339 pills (that is a lot of pills). Way to go LE. Everyone thought you just did not get it, and the entire time we are the ones that did not get it. I know you are on the ball and the undercover brother well all I can say is You Rock!!!!

I think Ronnie smiling in the mug shot was because his mother never ever let him stay in jail and he somehow got out of everything. I bet during the bail hearing that smile came right off his face. No way does that family have that type of money to get him out. If they do, I am moving to a trailer. LOL…. Misty is now 18 years old and the game has drastically changed although she does not realize it yet. She will in the next few days or weeks. I saw the news clip during the bail hearing and she was still defiant, confident when she says she already has a lawyer. I do realize lawyers have a bad rap, but this guy must be hard up. I would seriously take a step back. How is he going to be paid? How can he help her now? What name will he make for himself? All I care about is a signed statement as to where Haleigh is. I just think they dumped her in another pond that was not searched. That jail house letter is sounding more and more realistic now. Hanks wife, the nurse calling the bail bondsman to get information as to how to get him out is bizarre. Someone working toward getting a degree (she knows everything, all about the drug use and selling). You cannot be in that environment and not know what is going on. Go get em LE!!!

Roxycodone is very different than Oxycondone in that it dissolves rather fast Oxycodone has a protective coating and is extended release over time-Roxy is short acting and works very fast and would really kill a kid, really. It would melt in her mouth as well. Not like Oxycondone where if it tasted bad she could spit it out and she would have to chew it hard – Roxy is like slush in seconds even if she spit it out she would still ingest some I would guess.
Why are police still so focused on White Boy Greg. I read somewhere they ask all prisoners for info on him?

Art….. so what is the scoop on Donna Broch?? Does she, or did she really work with or for Tim Miller ?? And how does she still have herself involved with Misty and the rest of the GoofTroop…. I was under the impression that ties were severed with Misty after the road rage incident.
If she was truly “undercover” per orders of Tim Miller back then, WHY on earth would she still be associated with the “trailer living Yahoos?” Especially once it went public that Tim sent her to stay with Misty and become her confidante, why would they even have her around during drug deals? Wouldn’t they have been leery of her and afraid she would narc them out? I mean I can understand all of the others being together…the family who gets high together sticks together !!…How is Donna Broch fitting into all of this???

Correct me if I am wrong, but I thought I heard on Nancy Grace one of the drugs they were peddling was Oxycontin? What Did they do, what the special that was on a cable station called the Oxycontin Express, about a certain plane that brings people to Florida, and shows them which clinic and/or doctor to go to that will prescribe Oxy’s at a cost of about $500.00 a pop for over 200 of them, so the “gooftroop” decided to give it a try too?? I know back in the very beginning of this whole case of poor little HaLeigh going missing, there was alot of talk about Ronald and his use of pain pills, and his comment was he only got them when he would accidently get hurt at work…he obviously got hurt “accidently” on purpose alot….lol Is Ronald even employed again now, or is he pulling a George and Cindy Anthony? No need to work as long as you can get paid to be on Good Morning America or the Today Show !!

Art, this is what I am hoping that is happening right now. Misty’s lawyer, OK LE, what type of deal can we make if we know what happened to Haleigh? Misty is facing mandatory 25 years as an ADULT. Atty can ahhh, can we make it 5 years and my client will tell you what she knows,(which will be a lie), because people on this stuff when they open their mouths everything that comes out is a lie at all times. LE, nope Misty will spend 15 years in jail only if she lets us know the truth, Atty. well we will see, I will need to speak with my client, ahh what if we can implicate others, can we have 4 years in jail? LE, No! 15years and all cards on the table. Atty, well I will get with my client and get back to you. Atty, can you give my client medicine to help her with the withdraws? LE, Nope. No medicine available for your client. Sorry. I say this with all modesty…I did comment back in November that LE was waiting for Misty to turn eighteen. I never doubted for a moment that LE was not doing their utmost. We will all see just how well the “good guys” did their job.

Of course Fields is going to say Misty’s arrest was to get her to talk about Haleigh’s disappearance. I seriously doubt he thinks she is innocent, but is doing his job as a defense lawyer.. Where is she getting the money to pay him? Is he Pro Bono? Ron’s smiling photo looks like it’s just another day at the office. He thinks he is going to get out again, as he has done in the past, and continue his drugging and selling..I keep remembering the day he and his Mom were kneeling on the ground, right after Haleigh’s disappearance..His eyes were twitching back and forth side to side at an unbelievable speed.. A sure sign of using cocaine..I’m wondering if he put Misty up to buying the drugs, using her as his scape goat..He’s the top dog in Satsuma, or was.. Now that LE is cracking down heavily, he may have to relinguish his crown.. Boo Hoo

Once again excellent reporting…I can’t help but feel a little empathy for Misty…I would never show her though…she is only just turned 18 years old and was forced to “grow-up” before her 18th birthday…the guidance she has received her whole life has been clouded by DRUGS and alcohol. She is living her life the way her parents lived theirs, that’s why they all think it’s ok for her to be doing drugs etc…It’s her parents lifestyle! Every time you make a decision it ALWAYS seems to turn out worse than the last decision made. 18 years old and your already going to prison for a long time…very sad…I’m afraid we may never know what happened to Haleigh. I hope they do not let her out because she my kill herself and then we will never know. Really 18 years old looking at so much prison time and having the very much non-support of a family unit. I am praying for everyone involved. Thanks for the great reporting.

I don’t think Misty will kill herself if she is out of jail..The girl is hard as nails inside..One doesn’t grow up in that atmosphere and not develop a “me against the world” attitude, especially towards LE..I do have empathy for her, but I don’t totally blame her parents…She could work in a respectable job, or maybe go to school on a pell grant to better herself..Many of us grew up in lower income, dysfunctional families, but we didn’t turn out to be free loaders with a sense of entitlement..No one but Misty can change her life for the better. If she chooses to continue down the path of destruction, she has no one to blame but herself..Now that she is eighteen, I hope she will realize the severity, and consequences of living a life of crime, and decide to be a respectable, tax paying citizen.. It’s a long shot,and she may never get the chance. She and Ron need to come clean about Haleigh, then let the cards fall where they may..She is now facing a long sentencing. The right to a better life may not be in the making..I find it hard to feel sorry for her. She is choosing to remain silent, complicating the finding of Haleigh..I think she is afraid to rat on Ron because of his violet temper, and I think she and Ron know what happened to Haleigh..

Many of us are confused about Donna, but from what people are telling me, Donna became the most confused of anyone about herself after Tim expelled her from TES, and went from volunteer undercover mama, claiming she was helping police, by befriending Misty to get information, to trying to protect Misty and the information she was given…and as happens with amateurs and even some semi pros undercover, they do a sort of psychological transference and cross the line. Trying to learn how to manipulate their so called target, they feign affection and wear the same stripes, and before you know it, they are actually feeling the affection they faked and wearing the real stripes.
Maybe that happened to Donna. Wonder if she might have been doc shopping and passing her pills to Misty to market? Art

I agree with Mary, Misty is of her own making. She had a chance to come clean (in every way)after little Haleigh was missing. She decided to continue her drug infused life. It seems to me that she got what she wanted, married. But look what a husband she snagged.
Art, thank you for not giving up on this and for your great reporting and insight. I had asked my daughter, a psychologist, about Donna Brock and she had told me the same thing you did.

Dot, You are right. He needs to be taken to a vet and fixed, he certainly doesn’t need anymore children and tax payers do not need anymore teenage unwed mothers. I think the reason he married Misty was fear he would be made to, and not in control of his situation. Regardless of her background and lifestyle, she was under-age and it was statutory rape, at least in most states.

What chance did she have in life? Would Haleigh have grown up to be like Misty? But Haleigh should have had the chance. That is really sad. I am starting to think she is not with us. She is as guilty as homemade sin. She is a parasite taking up space on this Planet. Her parents have lied continuously and did nothing to help their little granddaughter.
Fronk is not involved in the murder per se, but I do believe he knows more in this dilemma too. When he had to take a leak, he knew where to go take it, and that is why I am concerned about his kidneys in that time frame of the body being found.
