Friends Say After Daniel Died, His Mother Died of a “Broken Heart.”

In a legal victory for Anna Nicole Smith’s beleagured lawyer and longtime companion, Howard K. Stern, the Bahamian magistrate says he will instruct inquest jurors that homicide has been ruled out as an option as a cause of death in Daniel Smith.
We’re told Magistrate William Campbell today hashed out four possible options jurors can choose from in determining cause of death in the 20 year old son of the late Playboy model and reality TV star, who died of a drug overdose in September, 2006:
–accident, “misadventure non-dependent drug use and an “open verdict,” which means they cannot agree how he died.
Jurors will return March 31, courtroom sources tell The Bald Truth, to hear the judge’s instructions, then take two hours to return their verdict, or “finding,” as it’s called.
“The evidence appears to be simple, but it requires more time for review,” said Magistrate Campbell, reported ETonline, quoting the Associated Press on why he postponed sending the case to the jury.
For Stern, who testified Wednesday he never gave Daniel any drugs and had no idea he had a drug problem, sources say the judge’s ruling was not unexpected, and certainly dove-tailed with testimony and forensic findings.
For several months, Stern sat quietly in the courtroom, hearing toxicologists, forensic pathologists, investigators detail the high concentrations of Methadone mixed with two anti-depressants they believe killed him, and a handful of witnesses with an axe to grind who tried to imply Stern had something to do with it.
While police had ruled out homicide as a possiblity in their initial probe, the magistrate laid those smears and innuendos to rest Thursday, with Anna Nicole Smith’s mother, Virgie Arthur, and her legal team among those in court who have been raising suspicions directed at Stern.
One forensic pathologist, Robert Middleberg, who analyzed tissue samples sent by the Royal Bahamas police, told me he’d never seen anyone deliberately poisoned with Methadone, one of the theories advanced, and that a handful of pills crushed up would not only not dissolve completely, but be so bitter as to be noticable if mixed in a drink.
In fact, no one, including Virgie Arthur’s lawyer, Milton Evans, suggested that homicide was an option.
As for the option to find “misadventure” as a cause, TMZ reported that under Bahamian law, it’s defined as “a hazardous course of action which ended fatally.” An open verdict means the jury can’t decide the specific cause of death.
One veteran attorney told me he hoped the exhaustive process would show a legal system that was fair and thorough, and police who turned over every rock in investigating the young man’s death.

I have a pretty good idea what OQ motives are but for the life of me can not figure out what he is doing. He loses at every turn, why not stop? Is it he just has to win, at any cost? They know what happen to Anna and Daniel and they know HKS had nothing to do with their tragic deaths. For the life of me can not understand what point they are trying to make, I know the marshall money is a lot but as an attorney shouldn’t he know they have no right to that money? Gosh, just don’t understand those people.

I am so happy for Howard that this inquest is finally winding up. I’m so glad the magistrate saw through the lies and schemes of all the others who were trying to hurt Howard in any way they could, through their hatefulness and greed.
That’s pretty silly even thinking Howard would crush up pills and give Daniel. How could anyone even suggest that.
I know Howard was like a father to Daniel and Daniel was like a son to Howard.
Howard has stayed the course and stayed so valiant and strong. Everyone and anyone came at him with all they could, but he withstood them all and came out shining like the bright star he is.
HOWARD, if you read this, know that we have all been in your corner from the get go. We could see the decent man that you are and we could also see the rest of the characters for what they are and the difference is night and day. This is why we all got so involved in this saga to begin with. We could plainly see the kind of man you are and we couldn’t believe what the media was doing to you. How can this happen? No one is safe from this happening to them, God forbid.
Just when I was thinking that no one had any integrity or morals, you came along, showing us there is still some hope out there. Take care dear one and know that we all love you and have never given up on you. You never gave up on doing what is right for Anna either. How lucky she was in having you by her side all those years Howard. It’s a shame she had to die so young, but I know that she was treated better by you in those years than most of us could ever hope to be treated in our lifetimes.
You stayed strong and showed everyone what you are really made of. It was always obvious to those of us who could tell what kind of person you are and for those who could see the rest for the scum they are.

Thanks for the update. I sure hope the jury doesn’t come back with an open verdict. My gut feeling is that the open verdict won’t be what the jury decides. Here is my feeling about the jury’s verdict based on everything that I’ve read and heard about Team Virgie’s actions since ANS died. No matter what the jury decides Team Virgie probaby won’t let it go. Team Virgie is probably already thinking/saying that HKS paid someone off to get the non-homicide ruling. They will probably think/say this regardless of what the jury decides. I feel like Team Virgie is out for HKS’s blood and won’t be satisfied with anything less.

No surprise, we knew all along it was not murder.
Even Virgie and her lawyer did not believe it was murder. They however tried to make the public believe that because of the money-motivated agendas they had.

I see they are going to hang on and pick Anna’s and Howard’s world apart because it was “different”, not “normal”, not how they think people should live. It makes me sick to read comments about what Howard and Anna did and all the nasty remarks, sickening.
BTW, I know of other people who take a picture of their deceased love one, not that uncommon. Don’t be mad at Howard for the world seeing it, that honor goes to Ford Shelly.
I know it does not matter whatever I say, there are people who live in hate, simple as that. Howard know there are many people out here who care about you, want best for you and want you to mend and live in peace with wonderful thoughts of Anna and Daniel, until you see them again, God Bless you, God Bless your heart.

Thanks Art for a great article. My heart goes out to Howard and the Stern family for what they have been subjected to for so long. All of us that supported them from the beginning have stayed with it through all the tabloid hammerings and virulent attacks upon Howard’s character and the verbal assaults upon his family. Some people really enjoy trashing people they don’t know but I fail to see WHY. I have yet to find an answer to that one.

As many of you know my position on this and just as many of you have predicted, no surprises here. And for Anna’s mother say what you will she too has to be glad that this is over.
And the misery and hate that has been felt will only cause poor health. All the parties have their memories and it just might be time to let things cool, and realize these were great people with ‘human flaws’. In saying that everyone should allow for a healing process and when it is all said and done, Howard loved Anna and Daniel and Virgie is still the grandmother of Larry’s daughter. And I hope in time those who really loved these two people will try and find piece in their own lives and move on to a place of peace and try and reflect on the good times!

Hello Cindy Lou or Gidget or Jackie Hatten or Rita Crosby or Virgie in the wolf in sheep’s clothing whom ever you are…thanks for your opinion however where I come from people do take photos of their dead for memories so as not to forget them in final sleep mode.
It is traumatic enough to lose someone you love so much it takes a piece of you at death and that piece never comes back. That photo is what is left…
Imagine Howard, he now has lost 2 pieces of himself and those pieces make you feel so lost.
I am certain the Bahamian jury in their wisdom will say it was the following MISADVENTURE OF DRUG USE…or accident. I believe in the system and I believe in the people that were selected will come up with a favorable ending I feel it and see it. G#d bless them

I know one or two who are a tad angry and blame you for everything that went wrong but the odds on this board are more positive than negative. To Clindy lou No. 5: And where, may I ask, was the photo(s) of a deceased Daniel laying in his mother’s arms found? It was found among the stolen personal items belonging to ANS - so it was either from a collection of HER (Ican scream also) photos which she had to have been aware of or on HER laptop which she would had to be aware of. Since she apparently knew or had asked Howard to take them she must have wanted the photos taken.

I think it has to be obvious to anyone that the whole thing was a tragic “misadventure”- the kind that mothers pray every night that their sons (or daughters) don’t ever fall into. Like Heath Ledger.
I remember when Daniel died like that and I knew how close Anna was to her son and I, (having an only son the same age) I asked my husband “OMG,how does anyone live through that?” And she did not. It is just all so sad.

I think what they did is right. There was no murder. Anna and Daniel died tragic deaths, but because of too many, and a bad mix of prescription drugs. Howard loved them both. Virgie is just a whiner, and a troublemaker. I hope Howard sues her, and her arrogant lawyer, for the ugly things they have said about him. Bahama did the right thing.

I know lots of people that have pictures of lost loved ones…I lost my Dad when I was 16years old…they were doing family pictures with him…I was the only one that refused to have one taken…to this day I regret it.. In my time of sorrow that I just couldn’t bring myself to do it.
But Oh what I would give today to just have that one Picture..
Howard I’m so happy for you,,I will continue my Prayers for you..still asking for strength to help you get through the other hurdels..I know Anna and Daniel would be so proud of how you have stood for them..You truly were her Rock as she was yours…

John (#24) You know that I am a fan. Great words, you are right I know this in my heart. I might be able to feel more like your statements if Virgie drops the frivolous defamation suit against two broadcasting stations and Howard. She has made money by selling video footage at Daniel’s grave ($12,000.00) and hundreds of photos ($5,000.00) Virgie admitted the photos to Greta on TV. The video money was in a document from Splash that she received the money, not her sister-in-law. I just don’t think this type of person would do anything but harm that little girl’s mind. Anna’s wishes should be honored. I was brought up in the church and attended a private Christian school, this woman shows no signs of loving anyone but herself in my opinion.

My father was in another country a few years ago when my mother told me he was not doing well. He caught pneumonia in the hospital and he was discharged home. Even though it was his wish to go home, I do not consider the discharge to have been a responsible thing to do. I booked a flight for the very next day, Christmas Day, arrived there early morning and rushed to where they were. After greeting my mother, she told me to go see my father who was still sleeping. I did not want to wake him, so I sat by this bedside and waited a few minutes, at which point I started calling him. When I realized he was too still, it eventually dawned on me that he was indeed too still.
Cindylou, get your heart pumping. Others are welcome as well. The burial is normally within 24 hours, so I wasted no time taking pictures with him, as though I was kissing him goodbye. If I could, I would share those pictures with you, and I am not kidding. It was a tender moment and I am glad I took them.
I sincerely hope you have been able to read and digest what I have written. You may now petition to send me to the gallows.

Finally, the truth has been told. Of course, HKS is innocent of any wrongdoing in the death of Daniel. The whole mess was fabricated by Virgie and her hit men. You’all know the one from Texas.
I hope Dannylyn gets a ton of money from Marshall’s estate and HKS gets a cut for administering the trust. God knows he deserves it after the abuse he has taken from ANS and the abuse after her death. If anyone should be left out it should be Birkhead…the sperm donor

John. You’re just a big old teddybear. Or is it because you’ve been around the block a time or two?
I know Virgie has. Her career dealt with these problems often and her affiliation with DARE would have given her tools on how to recognize. If the background stories are true, prescriptions were available to Anna at a young age. I’m guessing she snuck her share. Even estranged, she must of still loved. In grief, isn’t one of the first emotions, denial? It still doesn’t explain to me why she didn’t try to contact Anna other than the airwaves.
Who doesn’t have regrets? Too many to count with this story of lives broken. Still except for the fact that Anna made her living in front of the camera, there are people just like her and Daniel in every walk of life, living on the brink.
For the bloodsuckers that relished in the story, I hope they pay. And I still hope for education and awareness so Anna’s and Daniels lives have some long lasting contribution to society instead of ratings and tabloid fodder. New generations are on their way, and pot and cocaine are not where the moneys at.

IMO Cindylue is just one of those people that wanted things to go the other way and she is angry that it COULD NOT HAPPEN.Where I live people also do take pictures of their loved ones at peace at the funeral home for personal reasons and not to be put in the public domain like FS did If you are angry about this take it out on the person who put very private pictures out there for all to see just maybe over a bike and some toys,much less a house

We have a picture of my father-in-law taken a second after he died, spur of the moment thing, we loved him dearly. And we are fairly decent people.

I recall someone saying a long, long time ago (I’m pretty sure it was you) that it seems the good, decent, honest and imformed people support Howard. We followed our hearts but also the facts and it led us to care about and support him.

He can really help the literary world by proving to publishers they should not publish things by idiots like Rita. The publishers of Rita’s book probably already know that. Her one course is writing was probably a night course at UofSouth Carolina when she worked there briefly.

Someone said “EVIL NEVER WINS”… Unfortunately, Evil DOES win - examples are are all around! However, those “wins” are temporary; eventually, they must pay with heavy interest.
After a lengthy detour, it’s now time to finish “answering” other issues, especially Ford Shelly and that Jack Harding character. Anyone who has substantially benefited by grossly inflaming the innocent (including may a few of the worst from the media??)… I think not doing so, will send a bad message to people that certain types of crimes do pay, and rather generously so. !#$$$&*%!!!

I will not be nasty like some people but my people are from Eastern Europe and I have received pictures of my dead Uncles at their funeral. People deal with things differently. Howard said Anna need that to help her get over her lose. If that’s what worked for Anna than who are we to complain.
I just wish those people who help push those terrible stories about Anna (like Nancy Grace and Greta) get their due.

Anne: We have always seen things exactly the same way about Howard and also about Larry. You always had the courage to say what you thought about Larry, even when it didn’t seem popular to do so.
I don’t accept him and won’t, until he does a complete about face and I don’t think that will happen, because I don’t think he is able or willing to change. He is what he is, which isn’t much in my opinion.
It’s just too bad that he turned out to be the father. Howard would have been the best father any child could ever want. I just pray that Larry keeps Howard close to Dannielynn, for her sake. If Larry truly loves her, he will.
I still remember how Howard would keep her away from the cameras when he had to take her out for any reason. He kept the media away from her. As soon as Larry got her, she was all over the tabloids, with him .
Anne: Don’t ever change. Don’t ever lower your standards for anyone (I’m sure you wouldn’t anyway, lol). I think you are a very nice person and I admire you for sticking up for what is right.

Too many people go with the flow even when that flow is taking them under. It’s much harder to fight the current, but it will eventually lead you to safety. It’s much better to go it alone and save yourself, than to go under with everyone else. It’s nice if you can save someone else with you, but some people just don’t want to be saved. There will be a nice warm place for them in the end, lol.

I am so happy for Howard. There were many evil doers and greed mongers that went out to destroy him so that he could not do everything in his power to keep his promise to Anna, that he would protect and watch out for the interests of her baby girl. If Anna, who had just had a baby and lost her only son, needed a picture of him with her after his death what business is that of anyone else? We all have different needs. Anna was certainly in a state of absolute shock, and what she needed Howard always tried to provide. He did not profit over the picture being posted on the internet….that was stolen from Anna’s estate. Howard has been a very quiet man, not ever wanting to say or imply anything less than favorable about the woman he loved. He loved Daniel too, I believe in my heart and is certainly not the only parent, friend, etc. that did not recognize that Daniel was heading down a destructive path prior to his untimely death. Both of their deaths were a tragedy, and I will always believe that Anna was wise enough to know that Howard was the one person who would not exploit her daughter,the person who would always love and protect her, and I believe he will always do everything he can for Dannielynn and everything he can to clean up the gargage that so many people have thrown at her especially, but also at Daniel. There have been so many evil people coming out of the woodworks making all sorts of claims about them and Anna after she was gone and not able to defend herself. Shame on each and everyone of them…they obviously did not care for Anna, but wanted to claim some twisted sort of fame. How disgusting they all were and are. There are a lot of vultures out there trying to grab and take what ever they can from Anna and her innocent baby girl. I hope that Howard now finds some sanity in his life and that he finds someone to share his life with who can devote herself to him, and who will understand that a part of him will always love Anna.

Regarding John N’s comment.
The reports regarding the inquest are a bit sketchy. I did read that Virgie did cry during Howard’s testimony especially the part when Anna tore off her cross necklace and threw it against the wall. When I read that, I got a lump in my throat myself. I’m hoping that Virgie cried out of sympathy toward what her daughter went through, and has finally realized Howard had nothing to do with Daniel’s death.
This is my hope on this Easter Day.

I agree with Beverly to never let one’s guard down even though I have (stupidly so) when I should have known better.
Howard and Dannielynn’s father must NEVER trust Virgie regardless of how many tears she shed while Howard testified. The woman will quickly compose herself and strike again. She is as deadly as a stinray.
I am surprised at your commint, Mr. Nazarian. To consider Virgie human and accept that human beings have flaws is the last thing I would expect coming from you. Virgie does not have flaws, she has barbs. Dannielynn must never be with her under any conditions. Being a grandmother does not entitle those who have proven to be callous and untrusthworthy. Being blood related is a poor excuse for blind entitlements. One must prove worthy of trust and respect, neither of which shows up in her history chart.

….and furthermore Howard’s life will never be the same. The horror he has been put through cannot be any different than the post-traumatic stress syndrome brought on by a serious life-altering horror.
While we were busy blogging and wondering what the next news was going to be and Virgie was vacationing happily while posing for the cameras with a stupid smile, Howard was very likely up most nights working on the legal matters he found himself entangled in for the crime of having loved Anna and possessing the loyalty and the backbone most people could never master. To work so hard at clearing the manure thrown at him while at the same time hurting so deeply for his losses is beyond comprehension.

Don’t get me wrong. I’m no Virgie fan. But hopefully she’ll see the light and see that continuing her war will not do her any good.
What I’m going to say now will tick off many but it is my honest opinion. In a way I can understand why she resents Larry. He will more than likely continue to benefit from a wealthy lifestyle through Dannielynn, and Virgie will not. Does Larry deserve this more than Virgie? No, IMO neither of them really deserve it, but Larry lucked out. What is, is. If Virgie had treated Anna better, things might be different for her now. Who knows if Virgie had gone to Anna when Daniel died to love and comfort her instead of running to the media trying to profit from her daughter’s tragedy, maybe things would have gone differently with Anna. I’m a great believer in “what goes around comes around” and I think life is going to hand Virgie the bill for how she treated Anna, both monetarily and spiritually.

If the readers will please check back on #47, Virgie gets a total of $17,000.00. Money she profited on after her grandson’s death, pictures she sold… She has received more we just haven’t seen the paperwork on it yet and she hasn’t let it ’spill’ in an interview. How do I know this? Because why would she get paid for holding up a Bible and crying over Daniel’s grave once and not all the other times?
Yep! This money is paying for an outside makeover, but there is nothing that can fix the ugly and evil inside that person. There are some things in life that are unforgivable!
Purposely hurting your own children, and lying about others to gain profit is not OK in my book! A team of the best PR people could not undo Virgie’s past and present, there is no type of spin in the world to make this person seem to be a normal caring human being.

Art Harris, I need help!
Last night Don Clark gave an interview on radio station.First he compare both system Bahamas(british law) and U.S.Then he started on saying,the crime scene were not seal.So for him it is a crime,no dought.After he mention the false infos.He said there were no rules to avoid “HOMICIDE”in this case??? Both Americain and Bahamian newspapers saying exacly the opposite!!!He also said Daniel had in his systeme the amount of 25 pills of meth.when he died.Accusing HKS,he mention the day HKS took the plain to return to Bahamas Daniel went direcly to the hospital for depression.My question is Who say the truth?
and if the verdict is open,is FBI can go in Bahamas and investigate? Like Don Clark was trying to reopend Anna’s case in Florida?

You know just for the sake of record, there really should not be any bashing of anyone and that includes Howard, Anna, Lin Wood, Neil McCabe, John O’Quinn and Virgie Arthur and I have seen some bad behavior on all sides! Everyone should just let this whole saga play out in the court system. I believe more than ever now that Howard Stern did not have anything to do with this (enabler maybe still, I still don’t know) but I really think Larry and the baby should be left alone and plus all this character assisination on all sides really should stop.

I, too, feel like I need help. Whenever I hear anything Clark, Virgie or the rest of those misfits, my heart races and I so wish I could turn them into mincemeat.
How can anyone not understand how tragic this horror has been and the irreparable harm that has been done to Howard is incomprehensive. They are inhuman and if there ever was a reason for people to protest en masse, this in my opinion is the one and only reason. The court should have thrown this garbage out and forced all the piranhas to privately and publicly apologize to Howard and in print for all to see — in addition to imposing the stiffest fines on all the culprits.

I may not get the chance to pop in and catch up as often as I like on your great site Art. Back to summertime activities soon. Here I thought I had kept up pretty well when this all started but seems I missed a few tidbits along the way. But Google is your friend.
I know there may be a decision on the 31st and one chapter may be closed but as for the rest, it will probably go on for years. And the little spin doctors will carry on. Every one will find their way eventually and maybe I’ll nolonger be bewildered at the antics of some. Maybe the torch will be passed for the next big contraversy. Maybe people won’t be so gullible. Maybe someone will get a bit part in a movie.
It’s been real and it’s been kinda fun but it hasn’t been really fun considering how we ended up here, looking for answers. Thanks for all your time and bandwidth that you’ve devoted to helping those searching. I really appreciate it.

#70 Ann and #80 clues good comments. As far as “enabler”. I think Anna lived longer under Howard’s watchful eye than she might have without his care.
I started thinking of a Texas lady I was in contact with several years ago regarding relatives we had in common. She was well off, and elderly, with no immediate family. Her once sharp mind was getting spacey and she was trying to get her affairs in order while she still could.
She was under a lot of pressure from relatives trying to influence her. They were adamantly insisting that “money should stay in family, rather than her favorite charities” etc., she wanted my opinion. My opinion was to follow her own wishes, and not be influenced by others.
A lot of families feel that money should stay “in the family” and not distributed to persons not legally related.
Some are so determined, as we all know, that they take the matter to court. Who gets the money? Lawyers in MOST cases.IMO

As I wa sitting in the living room,by my fireplace,I sat back in the lazy boy,to relax.and this just popped in my head.McCabe is still making the statement of homicide,So I GOT TO THINKING,Virgie is trying to work the bahama people like Rita Cosby did,Make false statements then get the people in the bahamas to back them up.
