The Bald Truth: Anna Nicole Baby DL Sole Heir!

A Los Angeles probate judge Tuesday declared Anna Nicole Smith’s daughter, Dannielynn, as sole beneficiary of the late Playboy centerfold’s estate.
“It was a long time coming, but we’re delighted the court upheld Anna’s intention that Dannielynn be named sole heir and receive all her assets,” said Smith estate attorney Bruce Ross in an exclusive interview with The Bald Truth.
The ruling clears the way for the baby girl to inherit as much as a half billion dollars from the estate of Texas tycoon Howard Marshall, late husband of Anna Nicole who had fought to inherit her fair share from the brief marriage –a drama still hotly contested by his heirs.
In the case of Anna’s intentions for her offspring, Smith’s lawyer and long-time companion Howard K. Stern went to court to clarify that a will drawn up in 2001, five years before Dannielynn was born, applied to her only surviving child—after son Daniel died of a shocking drug overdose in the Bahamas hospital while visiting his mother and newborn half sister in 2006.
“The original will wasn’t artfully drafted, so everyone was saying it disinherited Dannielynn,” attorney Bruce Ross told me. “They were wrong; the court agreed Anna never intended to leave Dannielynn out in the cold.”
The judge also paved the way for a trust to be established for the 18-month old toddler, and designated Stern and father Larry Birkhead to administer it together as joint trustees.
Under probate law. if someone dies before a will takes effect, he or she would stand to lose their standing to claim any assets, which would then go to named or intended surviving heir(s), in this case, Anna’s only living child, Dannielynn.
The ruling doesn’t affect Birkhead’s custody of Dannielynn, lawyers say.
Dannielynn’s grandmother, Virgie Arthur, embroiled in several lawsuits surrounding her late daughter, has not challenged the will.

I had to come here to get away from those vile fools at TMZ. I can’t take it anymore. Howard is wrong no matter what he does. Co-trustee’s are so common in this type of case. God these people are idiots! I say congrats to Dannielynn, Howard and Larry for getting this dealt with. Howard and Larry are taking care of the baby as they should be. They’re good men, even if I don’t care for Larry! He’s trying I think.

I’m happy with the way the judge ruled on Anna’s estate, it is what she would of wanted.No matter what anyone thinks Anna trusted Howard and would want him involved in DL life.
Hopefully no one will contest this, but I wouldn’t be surprized if someone tries, nothing is ever easy in this sad saga!!!
Now if only the rest of the court cases could be setteled this easily maybe Anna and Daniel could rest in peace, and Howard would be able to grieve without all these other distractions, but I doubt that will happen!!!!

Glad to hear the will is finially settled the way ANS would have wanted it to be.Why would Annas mother challenge it it would leave her out if DannieLynn gets everything and she keeps trying for custody she most likely hopes to win though I don’t know her reasoning. I am gld to see it was put in a trust and the two men will administer it.IMO Vergie will do something in the Bahamas as that is where the money is.Am just glad this was settled before the inquest resumed.As it shows at least the Judge in California trust howards judgement along with Larry.

Great News! So glad these two are still working together. United they have stood for the benefit of Dannielynn and have won the battles!
I could not imagine Virgie disputing this; guess she didn’t want the headlines of “Mommie Dearest fights for Baby’s Money.”
I hope the end of controversy and court battles is near for these two men and they can go on peacefully in the future.
I hope we see the Marshall millions, Anna Nicole’s rights as a wife that most do not have to battle this long, deposited into this trust soon.

Larry I do too wish you the best in your efforts to raise Dannielyn. She is a very beautiful and precious little girl and despite your tumultuous relationship with her mother, that would have all been forgiven by Anna sweet as she was, as long as you did right by Dannielyn always.
Don’t let your feelings get in the way of true judgement. I hope always that you retain a respectful and united force with Howard as he meant the best for your daughter’s mother then, now and always and I know he has Dannielyn’s best interest at heart then, now and always.

This is wonderful news. Howard has done a great job watching over Dannielynn. Larry and Howard have worked together for this child to have a great life. Now it’s tiime for Virgie to just back off and O’Quinn. Virgie did all this vendictive action for what….Now she has no family from Anna side in her life. She only thought of money when she should have thought more about being a grandmother. But that was to much to ask of her since she wasn’t really a mother to Anna.

I am very pleased to see Larry and Howard working together to carry out Anna’s wishes! Stand tall and stay strong…you are both doing a great job in doing what is in Dannielynn’s best interest. I only wish that others could see the damage they are doing to this child…damage that will not be felt by her until she is older and can understand. Virgie is challenging the custodial law which is worse than the will because she knows if she gets her hands on that child chances are granny lives well in her older years thats whats its all about, just money. Dannilynn is only an asset to her if she gets that money if not she is so outta here who wants to take care of a baby when you reach your supposed golden years anyways? Right Vergie you are just going to turn the playpen over like a cage to watch her, just like you did for your other kids?
They now need to protect Dannilynn and all her assets till she reaches legal age or they deduce that Larry is her father and with the other guardian they can decide together in the best interest of the child how to disperse of the funds.
I sincerely hope that Dannilynn does win that case for her mother and late brother.
I am really hoping that Elaine Marshall looks into her heart and comes up with a settlement otherwise if she does not settle it is going to be very dirty and nasty. just a few words that come to mind.

I’m glad that progress has been made on that front. I’m sure now that some people will be saying that Stern and Birkhead made a deal to split the money between them rather than give it to Danielynn and that this was their plan from the beginning or something equally as crazy. Thanks for the news and hope more will be coming soon. I believe April is the date that discovery has to be in for the lawsuit Stern filed against Rita Cosby. It seems to me that the inquiry into Daniel Smith’s death is supposed to resume soon also. It’s funny that there was daily news for a short time about Rita Cosby, Lincoln Baines and more and that all of a sudden it was so quiet and still is. I guess that everyone was told to be quiet on the subject.

I am very glad that HKS and Larry are ‘joint trustees’.
It is like Howard is representing Anna as the mother and Larry is representing himself as the father. It is only right and fair for Dannielynn. Howard is who Anna chose to take care and make sure if anything happened to her, that her child (at that time Daniel)would always have someone making sure they had what they needed. I am very glad that the Judge realized that Anna never wanted her biological family anywhere near her children or her estate. With Anna and Larry not being on speaking terms, or having more than a decade of everyday contact like she did with Howard it was the right and just decision to make them joint trustees.
It probably wasn’t what Larry wanted, but better to be HKS then Anna’s family. Just my opinion on the matter.
Hope to hear a comment or two from Mr. Nazarian, if not now then after the inquest in a few weeks. Pray all is well.

Personally, I cannot wait until it is over. It will stop some of these people from wild false accusations.

I don’t know what on earth Larry would ever do without Howard there to guide him with Dannielynn. Howard is so mature and knows what is best for this beautiful little girl and he will always do what is best for her. She is fortunate to have Howard watching out for her.
I also want to say that I think it is wonderful for Howard to start a foundation in Anna’s name. I read that online somewhere. I think it was on ET online. Isn’t that just like him? He ALWAYS does what is right and good and I don’t know how some people can’t see that.

Virgie’s talons are probably being sharpened to get a hold of the loot. Hopefully, Dannielynn will not be able to touch the bulk of whatever she may have until she reaches the age of 25. That would force Virgie to makes plans for her future. If she expires before Dannielynn reaches the magical age, she will probably arrange to have her body preserved so that she can rise and shine when the time is right.

This is wonderful news. I really felt Howard K Stern was just in this for his own personal gain, but He and Larry both just want to honer Anna Nicole’s wishes.
I think it is great that Howard K Stern is a part of DL life, that little girl is lucky to have so many people with pure intentions love her so much..Vergie,I think all she see’s is dollar signs and being in the spotlight.
I did not see where she really cared about Daniel, and i do not see unconditional love for DL either.

TG! Despite Virgie, Ford Shelley, GBen, Rita and Opri Howard has won every important battle for Anna and for Dannielynn. Anna is obviously watching over Howard and her daughter and making sure those who treated her badly in life are haunted by her now….Howard will continue to make the greedy, hateful, bitter, nasty people who caused Anna so much pain pay…literally.
And Howard DOES have a job, as executor of Anna’s complicated and difficult estate and as co-trustee for Dannielynn’s Trust Fund from Anna. If it wasn’t for Howard, Horizon’s wouldn’t be part of Dannielynn’s inheritance so his living there while he settles Anna’s affairs is only right…what’s an 18 month old going to do with a house in the Bahamas? Howard also has to continue with the Marshall estate battle and the inquest into Daniel’s death - not to mention his own lawsuits against O’Quinn and Cosby and defending himself against Virgie’s suit against him. I’d say Howard is pretty busy right now, and ALL of it related to Anna Nicole. Working as a lawyer for another client wouldn’t be fair to the client or to Anna’s estate or Dannielynn. Would be darn near impossible to have a “job” with his focus on taking care of Anna’s affairs and Dannielynn’s trust.
Keep up the great work Howard, Anna is looking down with love, pride and satisfaction.

Howard is a trustee because Anna named him trustee in her will. The Judge honored Anna’s will and simply changed the sole beneficiary from Daniel to DL. Larry is co-trustee because he is Dannielynn’s father. That was also an add-on, not part of the original will.
I don’t think Larry is weary of Howard’s involvement. I think he knows that Howard loved Anna and loves DL and I believe Larry is grateful to have someone like Howard there to help him. Howard has connections that Larry doesn’t. Howard has the intelligence that Larry doesn’t, but at least Larry is intelligent enough to know that having Howard there is beneficial for him and for DL. He knows that Howard has a good heart. He knows it because he saw it. He was there with Anna and Howard, unlike you, who can only speculate about Howard.

The people who keep saying Howard doesn’t have a job, or should get a job: Maybe he could have got an additional job if certain snakes and vile people wouldn’t have DESTROYED his public image! It’s good news that HKS was named co-trustee of the baby’s trust. Stern deserves any dimes he gets for administering the trust. He put up with Anna for all those years. Now it’s payback time. IMO, Birkhead regards his daughter as a cash cow and Stern is the one who cares about the baby. I’m glad he’ll stay in her life as trustee of her estate.

Joni and Elle ……. I agree with both of your excellent comments. If Larry has any sense at all he surely knows by now how lucky he is to have Howard in charge of anything of any importance that requires a heart and a brain - leaving him free to do whatever it is that he does best. He can spend his time playing games with Dannielynn (which is, of course, important), shopping, make sure that he does not miss any photo opportunities and party fairly often while rubbing elbows with the stars. I just want to see Howard happy. If anyone deserves happiness and a little sunshine in his life it is Howard.

Hi Anne! I have a feeling that Howard knows that there are those of us who support him and always will.
I have to disagree a bit with Peppermint in that Howard should always be protecting Anna and Dannielynn for the rest of his life.
Anna is gone and Howard deserves to have a life of his own. I’m sure he will always see to Dannielynn’s best interests, because Larry doesn’t know how to put her above himself. Howard is a true blue kind of guy, but he does deserve a life of his own, and I hope that when all the smoke clears from this saga, he will be able to find some happiness.
One thing that I think about occasionally, is that if Howard would ever want to run for public office of some kind, he probably wouldn’t be able to because of the terrible lies the media people and all the other scum has put out there about him. They have taken his future away from him and they need to pay for that. An eye for an eye.
Howard, if you see this, I hope you will seek compensation for things like this that will affect your future. I hope you go after every single person who has maligned you. Please don’t leave anyone out. They need to pay. I also hope that before too long you can finally begin to live again and enjoy life. You certainly deserve to have some enjoyment out of life. I hope in time you will find a really nice lady and have a child of your own. You would make someone a wonderful husband and a child, a wonderful father. I for one, am very happy to hear that Howard will continue to be a part of Dannielynn’s life and will constantly be viligent with her inheritance so she always has what she needs. Larry is younger and still has some maturing to do, but I see signs of improvment in his dealings with his baby girl. Anna showed wisdom in choosing Howard to watch over her assets and in making him be the guardian of the inheritance she left behind. I think she is pleased to see Howard and Larry working together in taking care of the precious baby girl. I pray that the two of them will continue to work closely together for that purpose in the years to come. I know that Dannielynn needs both of them, and Howard deserves to have a big part in her life. They will always need to keep their guard up to make sure grandmothers, etc. do not try to sneak in and take anything away from the baby or to use her money for her as Virgie would if she is given the opportunity. Howard, hang in there and let your heart and wounds heal, and God bless both of you in your efforts to keep Dannielynn safe and secure and do what you can to restore her mother’s credibility and name. I don’t mean that Howard shouldn’t have a life or move on. I want him to do what is best for himself. But I believe that when I say ‘protect Anna and DL forever’ I mean that Anna was a celebrity, because of that her ‘name’ is an assest that belongs to her daughter. A prime example of what I’m talking about is what was reported today regarding the stolen idea for a TV show. Anna developed a TV program. It was turned down. After she dies, E decides to make the show, without crediting Anna. Somebody has to protect her name and DL’s interests. At least until she’s an adult.
As far as I’m concerned, and, from the report I read last week Howard is concerned, Anna was Howard’s wife. As her husband, I know he WANTS to protect his wife. Forever. Even if he ‘moves on’, the time..the 12+ years he spent with his wife..it doesn’t go away just because she’s dead. It’s as real to him now as it was then. And that’s what he did for 12 years, protect Anna. And, as he promised her at her funeral, that’s what he’ll continue to do until he’s with her again.
I agree so much what you said about what was done to him. It’s so sad. I hope to God people see this resolved..and PAY ATTENTION! I agree about Larry too…I’m trying though!
I’m sorry if it seems I over romanticize Howard. I see him as a rare treasure. I know enough ‘friend’s of a friend’s to know that Anna WAS happy with Howard, and she DID fall madly in love with him, as he’d been with her for a very long time. Joni and EJ, very well said. I do believe God is giving Howard favor because just as Howard knew Anna better than anyone else. God knows us all best.He knows Howard best. Howard has remained throughout everything a true gentleman through and through. Despite everything that was said of him he has not retaliated with a harsh word. He embraced Larry and accepted him for who he, Dannielyn’s dad. He has offered his time and help to see that Larry is comfortable because he knows that this is important to Dannnielyn’s upbringing. What Larry choses to do is on his own merit whether he fails or succeed. I do believe in time and pray that Howard will find love and have a child of his own. He deserves it. Rest assured that Howard will always do his best and use whatever is in his power to ensure that every option is available to allow Dannielyn to have a great upbringing. I also believe that whatever the future holds he will also make sure that there are no questions or loopholes or loose ends when it comes to Dannielyn’s financial future and HER ESTATE. It will locked tight and well guarded and leave no questions unanswered. So I hope all you naysayers quit talking about Howard and his family. You should only hope you had that much class.

Joni and EJ…….Good to see you. I sure miss being able to share our feelings in our support of Howard here as often as we once did. Sure wish we could all be present in the Bahamas during the inquest in support of Howard. EJ, you said “No matter what they throw at him, he will be victorious” - I believe that too.

If Howard is a lawyer. LOL then he would know that even the original will is a joke. But at the very least he would have prepared a new one when she was pregnant. What if she died while giving birth? I guess a good will would not have benefited Howard in any way. I am sure that he wants to look innocent now so he is setting it up in her name, that does not mean anything right now because there may be nothing left for her to enjoy by the time she is 18.

If Anna HAD died while giving birth, Daniel was still alive and everything would have gone to him. Sadly, Daniel died and Anna died months later, and everything went to Anna’s next of kin - her daughter, which is as it should be. What’s the problem? Larry and Howard are trustees but the heir is still Dannielynn. She would have been the heir with or without the will. Anna indicated in the will that she wanted Howard to be executor, and he is - minus the fee, which he waived. Howard as executor/trustee is the final way the courts can respect the wishes of the dead. It’s what Anna put in her will, and they’re respecting it, even though the heir is not Daniel, but Dannielynn.
So, how Howard “benefits” I do not know. The person he loved more than anything and who he lived his life with for over a decade is GONE FOREVER. He’s trying to make sure that her daughter has a good life. It has nothing to do with wanting to look innocent. It has to do with doing the right thing - and giving DL her mother’s estate is the right thing.
I have no doubt in my mind that if Howard had married Anna and she died without changing her will, Howard would have STILL given everything to DL. He would not have fought for a piece of the estate, he would fight to make sure DL got everything and he would be there to make sure it happened, and that she got to live the best life she could - just like he’s doing now.

I am very glad for Dannielynn, that’s what Anna would have wanted. I have a question though what exactly is going on the Daniel inquest? Like is it over? Is it still going on, did they find out why he died? If anyone can reply to me I would really appreciate it. Anyways, as to Virgie she deserves nothing! She is an evil bitch.

Shoulda, coulda, woulda but Anna didn’t update her will. There are people today after seeing the case surrounding that still have not updated or even made a will. Heath Ledger did the same. Not that they did not value their family. Neither expected to die. Quit trying to put the blame off on Howard. Anna was very strong willed and until everyone gets it through their head that Anna did what Anna wanted to do. I’m sure if she had updated it they still would have something negative to say about Howard. As much as everyone is up in arms, life for Howard is still going on. The negativity has not stopped him one bit. March on Howard march on. Behind you 100%. You are a very educated, loyal and caring attorney who succeeded in proving to the court Anna’s intentions and wishes. You are recognized as Anna’s attorney, husband, best friend, a good father-figure, protector, executor of the estate, co-trustee. Good job Howard.

Ahava #57……. Please read LeeakaHoward’s comments and just try and understand what he is saying. Nothing else makes any sense no matter how you wish it were different, no matter how much you hate Howard (for whatever reason), or how close (family or friend) that you are to people who oppose him. Try and accept the fact that (quoting Peppermint) - “Howard is a rare treasure” - “He’s a damm good man”

Peppermint: I think I took you too literally, lol. I couldn’t bear the thought of Howard spending the rest of his life protecting Anna’s name and not having a life of his own.
I do understand what you mean though and do agree with everything you have said. Howard is doing a wonderful job. I don’t think he could or would ever do anything less than that.
