Bald Truth Exclusive: Was Virgie Arthur Defamed? What Her Own Agent’s Shocking E-Mails Reveal!
Virgie Arthur Testifies in Florida, 2007, Talks to FOX’s Greta Van Sustern

Within six short days of Daniel Smith’s death, Virgie Arthur hit television shows to accuse her long-estranged daughter, Anna Nicole Smith, of negligence, or murder in connection with the apparent accidental overdose of her own son, and warned her to be careful about companion Howard K. Stern, fingering him as a possible killer, too, out to make a buck.
Now shocking e mails from Arthur’s own photo agent, David Leigh of Splash News, obtained exclusively by The Bald Truth, reveal a grieving grandmother hustling her own media deals. In hawking exclusive rights to cover her own memorial service for Daniel in Texas, to TV shows and magazines like In Touch weekly, the e mails suggest a case of the pot calling the kettle black.
“If you do want to have exclusive coverage inside the church, we’re going to need a firm commitment pretty soon,” David Leigh writes Entertainment Tonight in an e mail dated Sept. 29, 2006.
“We haven’t even mentioned it to any of the other shows yet,” Leigh goes on, “but we will need to do so very early next week as the details will come out in the local press and there’s been mention of it from Virgie” on air.
Later, Virgie would identify him as a “family friend” when she testified in Broward County probate court after Anna Nicole died of an accidental overdose in Florida, pointing out Stern as the only one making any money.
When his attorney, Krista Barth, questioned her about any deals of her own, she dabbed at her eyes with a tissue and plead confusion.
The e mails were attached to the CBS response to Arthur’s claims of defamation against the parent network of ET, Stern and a local Houston station filed Dec. 26 in federal court. The so called fighting words came from an interview Smith gave ET several weeks after her mother trashed her on TV in the wake of her son’s death, and were played at the contentious Feb., 2007 hearings in Florida to determine where the former Playboy centerfold wanted to be buried, in the Bahamas, or her native Texas.
“The hearings included testimony and other evidence focusing on Smith’s long estranged relationship with (Arthur) which was further exacerbated partly as a result of (Arthur’s) prior statements to the media regarding Daniel Smith’s death, as well as her public statements about Smith’s drug use and the parenting of her son,” says the CBS response.
Ironically, argues CBS Houston attorney Charles L. Babcock of the firm Jackson Walker in objecting to Arthur’s request to send the case from federal, to a friendlier Texas courtroom, it was Virgie’s own lawyer, John O’Quinn, who “insisted that a tape of the entire ET interview with Smith be played in open court.
“The proceedings were televised,” he writes, “and we attach that portion of the hearing where Mr. O’Quinn makes his demand followed by the playing of the interview in question of which Plaintiff now complains.”
While Arthur claims to be a private individual, and denies any monetary motives, only a desire for visitation with Dannielynn, Larry Birkhead has said she stood him up for a visit she’d set up, and her personal attacks and lawsuits suggest other not-so-hidden agendas.
As for her conduct in the media, the straight-faced CBS lawsuit suggests Arthur’s legal posture is almost laughable, calling her a “willing participant in multiple television and print interviews (many of which she solicited) regarding controversies surrounding her daughter.”
Further shooting at her non-public figure claims, CBS argues Arthur said she “reached out” to her daughter “through the media” in her own lawsuit, suggesting the defendant Stern/ and/or Smith had murdered Smith’s son, Daniel, and that Anna Nicole should “be careful about who she hangs around with because you (Smith) could be next.”
For six weeks, Anna Nicole grieved her 20 year old son and grappled with this conundrum, friends say: how could a mother attack a daughter in her darkest hour? Slowly, sadness turned to rage and Anna Nicole exploded in the chilling, unforgettable –and spontaneous– ET interview, where she charged her mother with childhood abuse, and worse.
Now, Virgie claims Anna, Stern, ET and others conspired to defame her, but friends say no one could ever tell Anna what to say or do, and if she called her mother “Mommie Dearest,” that’s how she felt.
So why would Arthur file what some first amendment experts say appears to be such a frivolous claim? In their response, CBS lawyers say the court only need eyeball the defamation suit Stern filed against Virgie’s lawyer, John O’Quinn in Florida, for calling him a murderer on national television to surmise revenge.
“It does not take a giant leap of faith to suggest that this litigation is retaliation against Stern for the Florida case,” says CBS, using Splash e mails in an effort to demonstrate Arthur’s public figure status.
What’s gone unsaid is a not so subtle attempt to use the courts – and the internet — as a club to try to intimidate and bully the media, including bloggers, from reporting anything but a pro-Arthur party line, including alleged hypocrisy reflected in the e mails of the man hustling deals on Virgie’s behalf.
Indeed, shocking e mails from Splash News Florida representative, David Leigh, obtained by The Bald Truth, suggest a calculated effort not only to turn the grandmother’s grief into profit, but to use talk shows, Rita Cosby’s book, Blonde Ambition, and paid bloggers, as part of a brazen PR attack strategy to whip up public support for Arthur’s accusations of murder.
But not every talk show was a homerun, even by Arthur’s standards. “Virgie did an interview with Nancy Grace (and) didn’t enjoy it at all!” writes Leigh in a follow up e mail Oct. 13. “It was done in a van or whatever you TV people call it outside her home and she said she couldn’t hear properly and wish she hadn’t done it. Now she’s possibly going to do a Heraldo (sic) interview on Monday.”
And in perhaps the most telling line of all, he adds: “She’s keen to keep the story being talked about.”

I truly feel for Howard because this woman does it over and over again, last week with her remarks from her attorney to the doctor,suggesting that the meds could of been ingested by drinking something and the methadone being placed in something.
Virgie is not as stupid as people make her out to be, she is sourounded by her entourage of lawyers,suggesters,she will stop at nothing short of anything to prove her point. No matter who she takes down, or destroys. example she did a great job of destroying her relationship with her daughter and grandson and look where they are now, and who she is pointing a finger at for blame. IMO People can be their own worst enemies, as is evident in the legal responses to the plaintiffs. It would seem that they have sunk their own boat by their own words and actions. I especially like that term “all purpose public figure”. Enough said, other than the old adage that keeps coming to mind….It is better to stay silent and be thought a fool, than to open your mouth and remove all doubt”. lol that applies to me as well.

I was appalled by Virgie Arthur’s behaviour towards her own daughter Anna and grandson while they were alive and in their death. On “national” tv she was defaming her own daughter while she was grieving the death of her son.Then wanting to be paid for pictures of her grandson!s funeral. The words mother and grandmother should never be used in association with Virgie Arthur’s name because she has failed badly. Her mission with the O’Quinn team to defame Howard Stern and Larry Birkhead publicly just reenforces her horrific behaviour!

I just read a book called “The Sociopath Next Door” and the people in that book really reminded me of VA. Also, there is another book called “In Sheep’s Clothing” that really describes how people like VA (and Rita and O’Quinn, who all deserve each other, IMHO) think and operate. If you want to protect yourself from these types, these books are really good guides for identifying them and either avoiding them, or developing protective strategies from them if you get stuck working with or living next to one.

If the courts determine she was a public figure, even limited, then we all need to worry that our protection from defamation has been eroded by the courts simply because the media became involved in a family matter.
I do not think that Vergie is evil, as most on your site seem to believe. I also believe that Anna and Vergie could have worked out their problems.Forgiveness is a wonderful thing. While it is awful if what Anna claimed was true (I think the truth has yet to be heard), Anna made choices as an adult, for which she alone is responsible, and surrounded herself with enablers, in my opinion.
I assume that I will be badgered as I have every other time I have spoken up on this matter on your site. Don’t you find it odd that your site attracts so much Vergie hatred? Oh, and I disagree with the assessment that Vergie was bashing Anna. She was bashing those around Anna and that was CLEAR from her statement.
Obviously you have never had an adult child who refused to talk to you because of some perceived wrong. I have and they eventually got over it. Grow up, people! Stuff happens in families. It doesn’t mean you throw your entire family out of your life!!!

Actually ‘teri’ Anna reached out to her mom on 2 occaisons after Daniel died. Virgie SPIT IN HER FACE,and decided to go on her ‘tour of hate’ and show up on TV to stab Anna in the heart with her pitchfork in front of the whole world.
I really believe Virgie tried to push Anna to her grave knowing she was vulnerable and knowing she had a prescrition problem…Just like in Judge Seidlin’s courtroom when she pointed her stubby finger at Howard and accused him of raking in the dough, while all the while she was wh*ring herself to the highest bidder.
Anna and Daniel were nothing more than CASH COWS to Virgie, she had no problem expoiting them and encouraging publicity good and bad, but especially bad because it meant a BIGGER PAYDAY FOR HER.
Mama ‘double-wide’ was Anna’s enemy and aligned herself with other Anna enemies to bring the poor girl down.She is at the inquest for publicity only.Plus she is getting a free ride from her sugardaddy attorney.
THANK GOD Virgie wasnt allowed to open Anna’s casket, because if she was I am sure she would have ripped off her dress and SOLD IT ON EBAY.

Does anyone else see the startling parallels between Virgie and Larry? Both latching on to their one claim to fame (being their relationship to a tragic figure who passed away before her time). Everyone loves to claim the media exploits public figures, but I can’t think of a statement further from the truth with Larry and Virgie. They affirmatively seek the media as their bread and butter, I wonder how much longer they can keep this going, the endless coverage, the lawsuits etc. I guess as long as there are lawyers and photographers we’ll have to deal with Larry and Virgie

They prove Vergie is not in any way a private person.The video also shows she lies,two shows with different answers to the same question.
They also show how ANS was right in saying her family used her to make money and I for one do not blame her for wanting to keep away from them.Terri what VA had been doing was not something that could be forgiven easily if at all and contributed to Anna depression.

By Virgie going on two, three shows first of her own free will to get herself known as the ‘grieving grandma’ of Daniel…THIS IS WHEN SHE MADE HERSELF KNOWN TO THE WORLD; therefore a public figure. Virgie became involved in her estranged daughter’s family; she did this of her own free will. Those first few interviews on TV, go ahead…READ THE TRANSCRIPTS! She kept saying things about Daniel’s NON-EXISTENT TRUST FUND, and where’s the money going to go if Anna marries Howard?
“Anna and Vergie (sic) could have worked out their problems.” Are You Kidding Me! Maybe Anna did make some choices that she regreted… that in NO MEANS gives Virgie the right to go on national television and insinuate that Anna or anyone around her was responsible for the choices that a 20-year-old made! She became a PUBLIC FIGURE the minuet she told the world it was not an accidental overdose. (SHE WILL BE PROVEN WRONG, just wait for the results of the inquest)

Think about thiis as a possible scenario.
David Leigh contacted ET as we now know by email. He was trying to get VA a deal to cover the memorial service that VA was planning for DWS in TX.. It never enters David Leigh’s mind that these emails would become a part of a lawsuit and made public. He never gave it a second thought about using the emails to contact ET. After all, using emails as a means to communicate between people is pretty is one of the most popular means of communication these days.
After doing some research it is my understanding that David Leigh approached ET before ANS did the Mommy Dearest interview with ET. David Leigh says in his email to his ET contact that Va had been interviewed by Nancy Grace and that VA didn’t like it.
I wish I had been a fly on the wall when David, VA, O’Quinn and McCabe learned the news that these emails existed and that they were being used by CBS in their defense in VA’s defamation of character lawsuit that she has filed…
Let’s say that David tells Va he has been in contact with ET about getting a media deal for her.but he doesn’t think it was necesary to inform VA that he had contacted ET by email..
VA never questions how David is contacting ET (phone, email, in person).
When CBS filed the emails in regards to Va’s lawsuit against CBS, HKS, ANS’s Estate, and a local radio station in TX, David Leigh was shocked that his emails had been made public.
VA , O’Quinn, and Mc Cabe had the wind knocked out of them because they had no idea that these emails existed. The emails have torn apart the very core of the foundation that O’Quinn and McCabe were using to build VA’s lawsuit on..
Will VA’s lawsuit now be dropped wihout ever going to court? How much longer would a wealthy attorney(thow good money after bad?
Does anyone else think that David Leigh and Team Vrigie were totally blind sighted by the emails being made public?

Teri #50-I have a very disagreeable daughter. And seven sons..which is why she’s a brat. J/K anyway. I understand what you’re saying. But I truly feel that Anna and Virgie’s relationship was way beyond repair…and I believe the reason is because of exactly what Art is reporting here.
I hate to see a family destroyed. But sometimes there are poison people in a family. Not that Anna was perfect. But what Virgie did was wrong. Her grandson was DEAD. D E A D. I am a grandma too..a young one, but still. I no way, no how would have thought for a SECOND to go to the press with anything regarding my child or grandchild. Estranged or not. Please re-read those emails. You can like the person but not like…or defend her actions. She hurt her daughter beyond repair the day she did that.

Margie, You are right, Howard has been abused long enough. He never should have had to go through any of this.
So many people should be thoroughly ashamed of themselves and at the very least, apologize to Howard, but I know they won’t becaue it takes a big person to do that, and none of these people fit that bill.
Howard has been through more than seems humanly possible, but he is still standing and still fighting for Anna’s sake and for Dannielynn’s sake.
You can’t find a finer man that that. Howard, just know that the people who defend Virgie are in the minority. They just have louder mouths than the one’s that support you and every time they open them, we can all see what they are made of. I won’t say here just what that is, lol.

In my opinion they both want center stage and the money that goes with standing there. It is all I can do to watch Larry with Dannielynn. She is such a beautiful sweet and innocent little girl. Someone should tell Larry that all those tears and trembling lips will never make some of us believe that Anna was “the love of his life” - plain to see that he was NOT the love of her life. Now we have Debra Opri trying to make us believe that she is so sweet, soft spoken and caring. I know how angry I feel watching how they operate and can only imagine the pain that they continue to cause

My guess is that they will try and spin the rumors and lies they plant about Larry or Howard… I think they do this because they believe the world won’t think Virgie looks so bad. Anne: Good to see you. I agree with your feelings about Larry. I do not like him and doubt I ever will, because he’d have to transform himself into a complete different person and I doubt he’s capable of that, nor would he probably want to.
Anna DID NOT want him getting Dannielynn and I can understand why.
The difference between Howard and Larry is like day and night. Larry loves being in front of the camera and Howard stays away from it and goes about the business of what Anna wanted for her baby. Larry goes about doing what makes him feel good.
I believe she is being taken good care of, but I just hope he will be up to snuff when it comes to teaching her the important things about life. That worries me though, because he doesn’t seem to know them himself. I’m so scared she will turn out like some of those other girls we see almost nightly on TV.

Howard laid it out very clearly at Anna’s memorial. Apparently Larry kept his mouth shut, which was a good choice.
Howard said:

I just finished reading the article written by the Jonesbahamas.com reporter Robinson-Blair, regarding Anna’s memorial and Howards comments, republished in the http://www.chron.com (Entertainment section)
However, they cropped the article and left out Howard’s comments that I posted #77. I can’t help but feel that the Chron is now a biased newspaper like so many others.
I sent a note to Robinson-Blair asking her how she felt about this.

Hi, Joni! I agree that the difference between Larry and Howard is like day and night. Dannielynn does appear to be a happy little girl and I hope that SOMEONE is taking very good care of her. I would worry so much more about her if Virgie had any contact with her and I hope that never happens. IF ONLY…. Howard and Dannielynn could have stayed together after Anna died (as Anna wished)….. IF ONLY……Howard and Dannielynn has been left alone and Howard could have devoted his time and effort to loving her, raising her in a proper manner and keeping the image of Anna alive in the way she deserved - instead he was/is forced to fight battle, after battle, after battle against the most evil I have ever witnessed. I hope that good wins over evil for Howard and Dannielynn.
As usual, Howard’s words were perfect and beautiful at the memorial for Anna.
LaVone…. I agree that it was probably a good idea that Larry did not speak at he memorial. Nothing he says about Anna rings true so IMO it is best that he says nothing at all.

Beverly, I hope so too! I honestly was thinking the same thing the other day…(that O’Quinn’s costs has to be getting to the million dollar amount.) McCabe must cost a pretty penny by the hour, Don Clark, ect. In fact all of those flying back and forth to the Bahamas and at the inquest. Man, I sure wish that it would not keep getting postponed! It has dragged on long enough. Wonder what the next move will be on Virgie’s part when the inquest finds that it was an accidental overdose for Daniel. If O’Quinn will STOP paying for all of these frivolous suits, Dannielynn, Larry and Howard all would maybe have time to live their lives in peace.
