The Bald Truth: Daniel Smith Inquest Resumes

At the Bahamas inquest Tuesday into the death of reality television star Anna Nicole Smith’s son, witnesses fleshed out the emerging portrait of a shy, troubled 20-year-old once admitted to intensive care for a valium “misuse” whose death came about from an “intentional” overdose of methadone, according to the lab director for Miami’s Dade County Medical Examiner.
Dr. Lee Hearn didn’t come out and say he believed it was suicide, just that Daniel Smith, 20, died after taking too much methadone in a short time span, according to press accounts and others in the courtroom. To rule suicide in or out, he said officials would have to look at statements to the family and the behavioural history of the victim.
Known as a heroin substitute to wean addicts off the powerful opiate, experts say methadone has a long half life and can rapidly — and dangerously — accumulate in the body if not carefully monitored.
Wayne Monroe, Stern’s lawyer, told the court Daniel had been prescribed anti-depressants, and hospitalized in California in the intensive care unit for pain and “serious depression” in July 2006, possibly over a recent break-up with his girlfriend.
Sources tell me a physician had also prescribed Daniel methadone for back pain, like his mother, but the late Playboy centerfold also had concerns her son was raiding her Studio City medicine cabinet, before she moved to the Bahamas, and sent him to live with a family friend.
The trigger: her once mild-mannered son was acting erratically, even abusively, friends tell me.
Ford Shelley, a former family friend who was in a bitter fight with Smith over ownership of the Bahamas home arranged by his father in law, G. Ben Thompson, testified Tuesday Daniel was struggling to “break free” of his mother’s fame, become his own man. “He loved his mother, but didn’t want to be known as her son,” he said, volunteering that Daniel would never kill himself, a young man “who was afraid of his own shadow.”
Regardless of how Daniel obtained the methadone, Dr. Hern testified her he’d likely ingested it about 5:30 a.m., then became lethargic and fell into a deep sleep leading to death probably 2-3 hours later. Hospital workers have testified previously that an emergency Code Blue sounded at 9:40 a.m.
Shelley testified Stern found two pills in Daniel’s jeans shortly after he died Sept. 10, 2006, “walked into the bathroom and flushed” them. Daniel had flown to the Bahamas to visit his mother three days after she gave birth to her daughter, Dannielynn, in Nassau. “I asked Howard what he had done, and he said he ‘took care of a problem.’” Stern has called that claim “a ridiculous lie.”
According to Stern, Anna Nicole’s long time companion and estate executor who is expected to testify, Shelley threatened to make up the pill flushing story only after the former Guess Jeans model refused to sign a mortgage for $1.5 million, or move out.
Shelley’s family reportedly paid $900,000 for the house, and Anna Nicole said she felt she was getting ripped off. She refused to let Shelley in when he showed up with mortgage papers, an incident caught on tape that friends say signaled the end of their relationship.
Friends tell me she was also “devasted” neither Shelley nor Thompson attended Daniel’s funeral after they promised her they’d be there, even though their friendship had been brief, and sparked, Shelley testified, by his attempt to help her get away from Larry Birkhead.
In an interview with a real estate magazine, Shelley said he aimed to sell the Horizons’ house for $10 million, a tidy profit based on its new star tenant he soon expected to be moving, and served Smith with an eviction notice the day after her son’s funeral.
When the courts allowed her to remain, Shelley’s father in law, Thompson, sued for title, then skipped three court hearings, and refused to post a $100,000 cash bond demanded by the judge to guarantee court costs if he were to proceed and lose. Thompson finally dropped his claim altogether.
But that didn’t end his Bahamas court battles. Thompson also faces criminal contempt charges stemming from efforts to evict Anna and Stern, in violation of a Supreme Court injunction, and allegedly orchestrating the Horizons’ break in the day after she died of an accidental overdose in Florida almost a year ago.
That was the day Shelley says he took Smith’s computers, dvds, paintings and other items, claiming she’d asked him to protect her property if anything ever happened to her. Within days, her personal photos and videos were all over television and the internet.
With burglary charges still on file by Stern, the probe remains open, police sources tell me, but it was unclear whether Bahamian police were trying to interview Shelley Tuesday. Last spring, he rebuffed their investigators when they flew to Myrtle Beach to try to interview him about the incident, citing a dentist’s appointment as a conflict.
I phoned the Bahamian Attorney General, Neil Braithwaite, to ask about the status of the investigation, but there was no call back by deadline.
On Tuesday, courtroom observers say Shelley refused to answer several questions from Stern’s lawyer, Wayne Monroe, who challenged Shelley’s claims of a close relationship with Anna Nicole and her family. Shelley claimed he didn’t have a lawyer, so it wasn’t fair to put him on the spot, at times raising his voice at Monroe and the judge, I was told.
After Daniel died, his grief-stricken mother, fearful he might have committed suicide, hired Dr. Cyril Wecht to do an autopsy that found he died from an accidental overdose of methadone and two anti-depressants, Lexapro and Zoloft. Bahamian police have ruled out homicide or foul play. Still, the coroner’s jury has the authority to recommend a criminal investigation if it determines it’s justified.
Responding to a question from Milton Evans, a Bahamian lawyer who represents the interests of Smith’s grandmother, Virgie Arthur, Dr. Hearn said it was possible the methadone could have been diluted in a drink.
Arthur also attended the inquest Tuesday, accompanied by the syndicated show, Access Hollywood, and its reporter, Tony Potts, her lawyer, and investigator, ex-G man Don Clark.
It was unclear if she was being paid. The show, along with its parent company and Bravo made an exclusive one million dollar plus media deal with Birkhead during his paternity fight, arranged by his now estranged lawyer, Debra Opri; both attorney and ex client are embroiled in a much publicized fee dispute.
In response to a question from Milton Evans, who represents the interests of Smith’s grandmother, Virgie Arthur, Hearn said it was possible that the drugs had been diluted in a drink.
For Wednesday, Thompson, the South Carolina developer, along with his daughter in law, Melanie, are said to be on the witness list, as well as Larry Birkhead.
Sources tell me Birkhead won’t be there in time to testify, after falling ill in California, but does plan to fly in with baby Dannielynn to remember the anniversary of her mother’s death in less than two weeks, and aims to testify in March, when the inquest will resume.
I hear Birkhead is expected to shed new light on Daniel’s drug use, first revealed by medical records introduced at the inquest in November, and his relationships with his mother and grandmother.
If Thompson does testify Wednesday, Stern’s lawyers may try to use court transcripts and 20 year old prison records to attack his credibolity; the documents show the businessman plead guilty to tax evasion and smuggling planeloads –and at least one boatload –of marijuana from South America, via the Bahamas, to the states. He drew a five year sentence in federal prison before he was released in 1988, according to a copy of court records obtained by The Bald Truth.
Sources close to the separate California drug probe into Anna Nicole’s prescription medications — and death — tell me investigators have taken long statements from Thompson’s family and find them credible so far. But Lin Wood, Stern’s aggressive Atlanta attorney, says he’s also put state investigators on notice any items they were shown or given that come from the house were stolen.

Just got back and was reading,and catching up.Mr Ledger parents,have acted with such,class and dignity.they are hurting so bad,and yet not one bad word,to anyone.it is in respect for there son.i have also read,in a statement,danniel did not do drugs,Well,what was he in the hospital for,and why ?was he told to go to counseling.I think Ford Shelly is a liar along with teaching his daughter to lie.if howard gave anna a drug,as the daughter claimed,why? would he ask anna if it was a mushroom trip,I am sure he would already know.I have also read QV,statements it sounds to me,like howard did not kiss her butt so she is mad.she needs praise.SOME FRIEND.mr harris,I am glad you are stong enough to brush them off.My friends in Italy,have asked why a grandmother,would want custody of a child,was the father abusive?,did the father not want the child? what has the child to do with danniel and anna overdose.just like in the bahamas,the italian woman are for family,my advice before I LEFT WAS,LET GOD TAKE TAKE OF THEM.

This is a load of CRAP. Saying that he took the Methadone to kill himself rather than to ‘get high’ just shows what a joke this is. Methadone does not get a person ‘high’! He SHOULD know this. And no one can tell me that a young man who grew up around that medication didn’t know that!

Mr Harris,my statements are made from what I read,and watch on tv.my comments about Virgie are from what she has said and done on tv.and what I have read about her,I was not aware,posters went into such detail as to interfere with private matters,(to many cooks spoil the pot)To many people playing MURDER SHE WROTE,Howard has a PI,that is his job.and he sounds like a real smart guy.so is Lin Wood.I ALWAYS,will believe in Howard,going by my inner feeling.It was good for me to go away,for a vacation,and to see and talk with old friends.Howard and Anna,s life,was a different lifestyle,than most of us,most young people today have to much money in movie town,just like Anna,who grew up poor,and found herself with a lot of money.in the 1950,s we were talking about drugs,it is now 2008,the problem has gotten way out of hand.How many young people can handle millions of dollar,s.Over dinner one night we talked about how hard we had to work for are money,and got little pay.FORD SHELLY should be so proud of himself for smuggling marijuana to the US, how many young people did he hurt,so please do not say one word about how good ford shelly is.

WOW quite the story.I really did not think Shelly would show up but than again after going on national television and saying he would what else could he do.His not wanting to answer questions put to him says a lot. It also says a lot that VA still is trying to say someone did harm to DanielSeems like even though it has been shown that Daniel hada prescription for methadone she just will not come to terms with what happened.She seems to be looking for anything to discredit Howard K Stern.

I will be so glad when this drama is over and then and only then, can Howard try to put his life back together. It will never be 100% again, in my opinion, but he will be able to breathe a breath of fresh air. This is totally lucicrous. Ford Shelley and Ben Thompson should be resting in a Bahamian jail.

Sure is taking awhile to get to the meat of the situation.
Kids. Sometimes, and just from speaking from personal experience, age doesn’t factor into adult decisions.
I don’t think it was suicide. He may of been stressed wondering where is life was going to take him, as is common for any young man trying to find his own way. Overdoses are just that. Not knowing how many is too many. Unfortunately, knowing Mom had a steady diet thru the years of various meds, he probably figured he would be OK. Not factoring in the tolerance factor tho.
Still such a sad situation. I can understand Anna and Howard not wanting his life and death to be tabloid headlines. They tried to protect his memory but seems there are enough bystanders that didn’t have the same moral compass.

So, it comes out that Daniel had been prescribed Methadone. That kind of puts the theory “it was given to him” out of play. He was known to abuse drugs just like his mother. That’s plausable considering he watched her do it for so long. Kind of like when a parent smokes, the kids usually end up smoking. In some occasions they will wind up absolutely hating smoke. Sounds like Daniel went with the forward.
I don’t believe he committed suicide. I believe it was accidental.
Funny, Ford Shelly wouldn’t answer questions from Howard’s lawyer. WHAT CHA GOT TO HIDE SHELLY???? WHAT CHA AFRAID OF??? I actually surprised he showed up. I would have hoped he would have been arrested for the break in on the spot. Apparently that didn’t happen. Art, try to find out if they got to question him since he was on Bahamian soil and under their jurisdiction at the time.
I guess this kind of deflated the whole “victory, we got Art to stop writting about Anna stuff” theory…..

I don’t know if we will ever know the whole truth to this sad saga, I think it will always be questioned by some no matter what the outcome is.
It must be a very hard time for Howard it’s like a never ending nightmare for him. My thoughts and prayers are with him.
I wonder what all the nay sayers will spin now, as for the last little while you have all been saying Art is shaking in his boots and was to afraid to report on this anymore.

When did Larry become ill?
Was it before or after his much publicized birthday celebration on or about Jan. 22?
What ever happened to the grave marker Howard K. $tern & Larry claimed they were going to put up?
Merv Griffen died in Aug 2007 & has had a marker up for months now.
Anna has been dead close to a year.
Sept. 10, 2007 marked the one year since Daniel died & he still has no marker.
So the excuse from $tern supporters claiming they are waiting for the one year anniversary (for Jewish people) doesn’t fly.
Also what happened to the BOMBSHELL that Rose claimed she was going to drop?
Did she drop it & knock herself out in the process?

My understanding (and I could be wrong) is methadone stays in your system for a very long time. The user takes another pill before he should thus the unintended overdose.

After reading articles in both Bahamian newspapers regarding the inquest, one of which asked for comments, I couldn’t resist offering to them my opinion of Ford Shelley.
For me, the question remains: If the court in Bahama finds him uncredible in his testimony and impeach him as a witness, and if they arrest him for the robbery of Horizons, will that affect the court in California?

Please,I will say it again,is there any time Virgie will go to the bahamas without the press,such a difference,in the low class way Virgie behaves,and the high road taken by Heath Ledger family.I am saying this because of virgie,s actions.if danniel had a order for methadone,he took it himself .I agree with no 10 no longer bewildered,I myself,took 2pains pills once,in Nov,had my (r) kidney out got the big (C)i was in a lot of pain,I should know better.I bet danniel never gave it a thought,if he had back pain,sleeping with his mom in the same bed,may have hurt his back

I loved the part where the witness became hostile and refused to answer certain questions and hollered for a lawyer. He doesn’t have a lawyer any more in Nassau, since Pro Pinder got nailed too.

I would like to know why on earth Creep Shelley wasn’t nabbed the moment he stepped foot in the Bahamas. I thought that was what the police were waiting for. Hmmmm, wonder what happened there? If he doesn’t pay for breaking in and stealing those things, then I guess it’s up to the rest of us to make him pay, lol. I am chewing at the bit, lol.
As for Virgie, what decent grandmother would show up at her grandson’s inquest with a tabloid crew and the likes of Don Clark with her? Hmmmmm. No decent grandmother would, now would they? Nope. But then no one ever said Virgie was decent did they?
I don’t believe for a minute that Virgie wouldn’t get paid for that. No way, no how.

Two things which are very disturbing to me, one the intentional dose, from the Doctor and the time line . He basically said that at 5:30am he Daniel took this intentional dose of methadone that did him in 2-3 hours later.
This is odd it smells bad, an I am not comfortable about another lawyer from none other than Virgies camp, questioning Dr Hearn or even leading him to say that it was possible that the drugs could have been diluted in a drink…. they can assume allibi and with this statement, and this statement is cause for concern for Howard.
Virgies camp is going to do what ever they have to do to Howard to be blamed for Daniels death.
This is an inquest and from this, a story line will develope and it goes on and on.
They Virgies camp only need to show speculation or an idea to make it just cause a possibility..
Even though Daniel ingested the pills himself for whatever reason maybe he had his own stash and waited till everyone was asleep when he knocked them back, it was his dirty little secret. Maybe Daniel after he saw his new baby sister thought o I better protect her and took them so his mother would not take them, thinking that this would solve that problem, he could of flushed them down the toilet too but he Daniel chose to ingest them.
I do not know Howard personally. however I do know he is not a murderer. kids do dumb stupid things for attention, they do them every single day. Daniel was probably tired the other drugs were not working, and he was up, his mind was racing, he could not sleep, why not take some methadone that sleep deprivation is cause for concern it is most often a sympton of depression.
Virgie back off,all of a sudden you think you can save them it is too late you should of could of been there years ago you made your choices too..frankly Virgiemiester you are not in Kansas anymore, whatever you say or suggest could and will be held against you. The country you are in has their laws and in Rome, you do as the Romans do otherwise you leave.
Ford Shelly may you reap what you sow, and become some male Bahamian’s girlfriend in the slammer for stealing items that did not belong to you. I really hope that he is questioned and locked up and forced to give it all back or forced to stay in a Bahmaian jail till he does.
Next week will be a year next Friday, I still remember where I was when I heard the news about Anna being deceased,it paralyzed me, I hope that all of us for just a moment take a moment of silence to remember her and her son at 1:30pm eastern standard time next week Feb 8th. I am glad to get an update on this saga. I do hope that justice will prevail. The money hungry grandmother and all involved with her need to give up and go home so that Howard, Dannilynn, and Larry can move on with their lives and healing from all of the lies and accuasations they have had to contend with.

I will take anybody’s answer. Who is doing what (other than the scums being horrible bloggers) to believe they got Mr. Harris to stop reporting on this saga? I am not privy to the crap that has been thrown Mr. Harris’ way, so I do not understand the comments about being scared to report this story. I thought maybe Mr. Harris was fed up and took some breaks; or else, I thought, it had to do with the judge not being happy about some documents being made available for publication.
If the authorities in the Bahamas allow Shelley his freedom despite his many televised admissions of theft, proven again and again by the stolen tapes he distributed to foxy Fox, I can imagine what else is allowed in their shores.
The Shelleys’ daughter has some wise parents. If she is lucky, she will grow up to be the opposite of what she has been learning at home. If she is unlucky, poor child!

According to a report on the Diana matter that is currently taking place in England, Diana’s bodyguard stated in court that there were not enough bodyguards to properly protect Diana and Dodi. The bodyguard’s request for more protection was turned down by the very same person — Dodi’s father — the man who has been accusing the Royals of oschestrating his son’s and Diana’s murder!
Sounds very familiar to Virgie’s incessant accusations. Could Dodi’s father and Anna Nicole’s mother be paranoid or could they be extremely evil people?

There is something about coincidences that always bothers me, they’re rarely coincidences. It is unusual that two young family members, in good health, would die months apart i nearly identical circumstances. Not impossible, but unusual.
When you add to this, that Daniel all but hired a private detective, because he feared his mother was being kept in a drugged state by Howard Stern, your mind goes, “hmmmm”.
Then Daniel travels to the Bahamas, and in the presence of the man he feared was keeping his mother drugged, he dies of a strange drug overdose.
Meanwhile, as Anna Nicole falls apart from losing her son, he “pretends” to marry her on a yacht. Weall saw the pictures of her diving into the sea in her white gown. The tragedy and pain were obvious, her grief was obvious, yet Mr. Stern thought it proper to marry someone in this condition? Give me a break.
Then Stern pretends to be the father of a child he knows is not his, and does everything in his power, to keep this baby away from the only parent she has remaining on earth.
Then, (gasp!) again, someone dies of a weird overdose. It’s Anna Nicole this time! My goodness, Howard was there again.
Some say coincidence. I say, 1 + 1 = 2.

This is a little long but I needed to give some background info before I made my request.
First of all, let me say that I appreciate the reporting that is done by Art and the commentaries from Rose at Rose Speaks. I hope that Art and Rose will continue to keep us informed on everything ANS related. I also think that there are some people that are trying to make HKS and LB look like the bad guys but I think Va is the bad one in the mix. VA needs to go home to Texas where she was during the last 12 yrs of ANS and DWS lives and stay there. If VA had put 1/2 as much effort over the last 12 years of ANS and DWS life trying to have a relationship with them as she has put into going to court and helping RC write a book ikn the past year then ANS and DWS might be alive today. If ANS had had a good mother that she had a good relationship with then just maybe her life wouldn’t have been so troubled. If ANS had had a mother that she could depend on for love and emotional support then maybe she wouldn’t have needed so much medication to ease her pain. Physical pain can be a result of emotional pain.
Now that I’ve made made it clear where I stand in regards to Art, Rose, HKS, LB and VA I’ll get to the point of my question.
It is my understanding from some things that I have been reading in different comments posted here on Art’s site and on Rose Speaks that there are some bloggers on some other sites that are allegedly being paid by VA and team to try to gain sympathy for VA, to trash HKS and LB and that on some other sites there have also been some physical threats made against Art and some other people.
I don’t doubt that this has been going on. I would like to read it for myself instead of just reading a few words and inuendoes that suggest that these things are being done.
Would someone please tell me where these things are being said. I’d like to read the full comments that are being made on other sites. I guess the reason I haven’t seen any of this is because I have stopped checking in at sites other than Art’s and Rose Speaks.

This is nothing but a BIG joke! There have been so many lies from BOTH sides! Howard is not the most truthful person you people are making him out to be. He also lied on the stand SEVERAL times. He knew good and well that he was not the babys father. He has lied about the drugs. He was strung out just like Anna was! He needs to answer for his lies too. Im not sure there is a truthful person on that witnss list. I think its planned that Larry didnt show up. He has alot of information that could hurt Howard. Larry is a somewhat of a truthful person and Howard knows that. So Larrys memory of events could really hurt Howards lies. (just my own views)

This whole thing has been a tragedy from the onset and whether or not closure is brought as to how it happened will not lessen that fact. Additionally, it was immaterial how Daniel obtained this methadone what mattered was that no one around him or Anna cared for their well-being. Anna surrounded herself and Daniel with an entourage of enablers and gold diggers who only saw them as a free lunch.

I just want to know what has happened to Mr. Controversy, Lincoln Baines. He was in this Rita Cosby news all the time and then complete silence. I realize that he may have been told to keep quiet since there will be a court trial for Cosby in which he will no doubt be called but I thought he was the roving reporter for Daniel Smith’s Inquest for Art Harris. I love his accent and wish I could hear more tapes. Thanks also for bringing us all this information on Daniel’s Inquest. I was starting to have withdrawls from not hearing anything about Howard. I think he is truthful, kind and not bad looking either.

It is unfortunate that Anna considered the South Carolina crew to be her friends at one time. Had she not allowed the riff raff to gather at the maternity ward where they did not belong, none of these lies would have surfaced upon Daniel’s death.
I find this whole parade of people in the hospital really strange. In a West Coast hospital where I gave birth many, many years ago, the only person allowed in the maternity ward was the father of the newborn.

For some strange reason I was surprised to read on the Internet that Dannielynn’s visit to her mother’s grave was a deal prearrenged with the film rights sold to two different organizations.
