Bald Truth Exclusive: Larry Birkhead Fee Deal? Debra Opri Turns Down $300,000 To Settle!

In a world wide web exclusive, The Bald Truth has learned attorney Debra Opri recently turned down a $300,000 offer to settle her fee dispute with former client Larry Birkhead over a legal bill she handed him last year for just over twice that amount.
The deal would have saved all parties further wrangling over $620,000 in legal fees for representing Birkhead in his quest for custody of baby Dannielynn, sources close to the negotiations tell me.
While Opri confirmed the settlement negotiations gone bust, she disputed the deal on the table. She said she’d dug deep to advance $100,000 to fund her fight, travel, pay lawyers in Florida and the Bahamas, making the offer unacceptable.
“The numbers are incorrect,” she told me in an exclusive interview. “We have $100,000 in out of pocket costs and six months around the clock services across three jurisdictions. How can anyone expect me to take only $200,000 in fees for all that?”
During the talks, after several hours of back and forth, Birkhead told her to take it or leave it. “It was more than fair,” says one insider privy to the intrigue. “It was her last shot to get out clean,” from a bill Birkhead has called outrageous. Why did she turn it down? “Greed or stupidity,” says the source.
But Opri calls it a “matter of principal,” and is pressing her case for binding arbitration.
After losing yet another round in court when a Los Angeles judge ruled against arbitration after freezing $591,000 remaining in her client escrow account, Opri filed an appeal in November, and says she’s willing to go to trial, if necessary.
“I don’t consider this story newsworthy,” she tells me. “It’s on an appellate level now. Everyone needs a reality check. I’ve certainly had one.”
According to sources close to the talks, Opri and Birkhead agreed to discuss settling their financial falling out on neutral turf – an office high atop Century City in Los Angeles, for a secret meeting refereed by a firm that specializes in dicey conflict resolution, from mega-million dollar Hollywood divorces to business deals gone bust. Here’s how sources tell me it went down:
Opri and Birkhead never saw each other. They sat in separate rooms with their lawyers, coffee and pastries, as a retired LA Superior Court judge shuttled offers and counter offers back and forth for hours.
Birkhead has disputed what he calls inflated legal fees, including dry cleaning bills, pricey dinners and at least one Opri trip to the Bahamas.
He also says that after TV journalist Rita Cosby introduced them, Opri leaked the former MSNBCer confidential client information for her book, Blonde Ambition, a charge Opri denies. Indeed, that relationship is expected to be a factor in the $60 million libel suit Howard K. Stern filed against Cosby, over a gay tryst charge she writes happened with Birkhead both men deny.
As part of the proposed settlement, insiders tell me, Opri’s insurance carrier agreed to pay $50,000 to Birkhead, who agreed to sign the check over to his ex-attorney – and give Opri another $250,000 from the frozen client escrow account, for a total of $300,000. In effect, fifty cents on the dollar.
That offer to Opri lawyer David Owen also came with a message from Birkhead lawyer Michael Trope, the sources tell me: it was Birkhead’s final offer–take it or leave it. He would never make that offer again.
Deal or no deal? Opri conferred with her attorney and sent back a message: no deal. Trope and Birkhead declined to comment. Both sides are scheduled to see each other in court Feb. 4, 2008.

Too bad that Opri couldn’t have met in the middle of Larry’s offer and her overprice bill. That would save them, and the taxpayer’s (who pay for the Courts) time.
Now, that lawyer might very well end up paying Larry. A jury is not going to see her as a victim do to her court costs for causing this mess.
Maybe she is trying to make up for the high bill she never got paid from the Hasselhoff case?

HAHAHAHA Ohhh Opri trying to appear strong and on top, I almost sense a crack in the statute. Little does she realize that many of her “boo-boo’s” are covered by her friends ((cough *cough* rita * cough)). The courts seeing the disection of the bill will see what the true message is. Opri tried and falled to pull the “wool” over Birkheads niave eyes, and in the end is being shown for what she truly is. ((fill in the blank))

Ok Yall as much as I do not like her or Larry for that matter…he hired her he knew what the fees were, this is not a surprise. This will probably be a very expensive lesson to him to check into people before he hires them. He is not the sharpest knife in the drawer or are both sticks in the chowmein.
He is just plain Larry, going against a very shrewd business woman who is college educated with a degree. She will win this one and she will fight till the last penny, that is how she got her reputation.
So if he Larry, thinks which is a challenge for this individual that she is going to change her personality or goal, or be frightened by this frivilous lawsuit which is to make the most amount of money for this case, he is deadly wrong…Debri Opri gets excited by the very nature of the word Sue it is verb not a noun in her religion or makeup!
Howard now is the time to seriously coach Larry if he will listen to you which is doubtful, in matters of business and law, and Howard, be careful because he might end up sueing you for payment for all the stress and lawsuits that he had to endure in order to enable him to get his daughter back..
Howard coach him about the people that he is hanging with lately, Paris Hilton which is a dui felon and other low life celebrities, Larry needs to hang with good church goers that is the only way he is going to find a good wife and mother which will set a good example Larry are you reading this or do you need someone to read it for you… for his Dannilynn.

This just proves that Birkhead knows he owes her the money and it was never pro bono… especially since Dana Lynn Walker’s depo on artharris.com proves Birkhead knew he owed the money and he gladly took her advanced money to even get him in the game. Opri bought him suits and airfare, etc… He needs to pay up! Opri got him his Baby as the Bahamas only enforced the California order Opri secured… no matter what Birkhead and Stern say. Anna died the day before she was to be forced by the California judges order to submit the baby to DNA testing or appear in his courtroom. These are facts!

I have to give LB credit for trying to settle this out of court.IMO it was a fair offer.I disagree that this is not newsworthy.If it was to Opri’s benifit she would have spoken of it on every station she could have.Using the same tactics she used aginst ANS and HKS and after she was fired or quit,whatever happened, against LB.LB has got to be tired of always watching his back.

She doesn’t find this story newsworthy? When it’s someone else’s dirty laundry she can’t peel her face away from the cameras. When it’s her own sh!t she’s sitting in, suddenly she doesn’t want anyone to know about it! Something tells me that one of her high-priced attorneys finally told her what an idiot she is, because I’m certain she’s not smart enough to figure it out on her own.
Hopefully, the judge will remove all charges for anything in Florida and the Bahamas, since she never filed anything in either location.

let me say upfront that i am not an opri fan. i do have some questions about this settlement offer. larry has said in court documents that he has filed that opri agreed to represent him for free so why did he offer to give her any money ? did larry offer opri the settlement money so he could get his money minus the $250,000.00 that she has been holding hostage (hostage imho)? did his attorney advise him that if he paid opri the settlement money that it would be cheaper for larry than continuing to fight opri in court? does larry’s attorney think that $300,000.00 is the maximum that opr would get if she won the court case? also does opri not care that if this goes to court her employees and associates are named in larry’s lawsuit against her? if she settles then larry will probably drop the suit against opir’s employees and associates.

if opri’s insurance didn’t think she had done something wrong then why were they willing to pay larry $50,000.00?
is larry trying to get this dispute with opri to go away so that he will be ready to sue rita cosby after howard gets through with his lawsuit against rita?
opri-birkhead-suit-seim?pt-24.pdf – read paragraph 13 of this document where it says that larry paid opri $20,000.00 on his cost account in january 2007. so this would mean that larry would have given opri $320,000.00 if she would have accepted his offer. is opri saying that this $20,000.00 was paid on money that she advanced to larry while she was representing him? this is the way i understood it when i read about the $20,000.00 payment in this article.
does anyone have any answers or opinions about the questions i have asked about why larry offered to settle with opri? i would really appreciate some feedback on my thoughts.

Larry is starting to gain his weight back and he looks really good. I think he a good looking man. That said, wahtever he does, it is amazing how so many mean ppl cannot say anything good about him.
I think he should move on in 2008 and forget about 2007. Forget the Anna/Danny case and go forward and not worrry about anything except him and his daughter. Annna and Danny are gone and no one has any proof of purpose foul play. Larry can not be responsible for what Anna, Howard and Danny did or took. He was not around them when all the stuff went down. So why should he be the one to try to “get” everyone. He and Dannylynn is all that is important now.
My only advise ( and who listens to me and who cares, LOL) is that if he has any say so at all, and I would think he does, is tell Howard to forget the Marshall caes, it is not worth the trouble. Drop that case and watch JO, Virgie and the rest of them crawl back into their holes.

HOW GREEDY can she be! See Opri has nothing to loose in going to court she has the money in the bank. Opri wants to drag this thing out until Larry has nothing left. Even if Larry was awarded any of HIS MONEY it will be eaten up in attorney fees with Michael Trope. That makes me sick because it will hurt Dannielynn in the end.

He fired her because he blindsided her,, when he went to the Bahamas and realized that he was going to get his daughter back, because he had a secret meeting with Stern.
Larry is not so innocent, in life you reap what you sow..
Howard was just protecting Anna and her last remaining heir. Howard was doing his job, and he loved Anna unlike Larry who at this point hated her.

louise IMO HKS dropping the Marshall litigation will stop nothing it will just give o’quinn and VA a better chance to go after LB and Dannielynn,Other attorneys are in this also everyone seems to think it is onlt HKS and it is not.He is just one of the attorneys representing her.Sara from Kt. I believe she(DO) said she needed the 20,000 before she would move forward in the case.His attorneys may well have told him it would be lest costly to try and settle than go on.Most attorneys,at least the honest ones will tell you straight out about matters like this.Just in case you would lose and even if you win it may not pay off after you pay your attorney.Say he settled for the 300,000 plus the 20,000 he already paid if he ends up paying his attorneys what would he have left? Unless the courts make DO pay his attorneys.

I wonder… if perhaps the reason Opri did not accept the $300 grand was maybe Larry had stipulations attached.. Such as admitting her usavory actions in billling , etc. Seemslike Larry is trying to be more that fair with offering the $300k, because he does not have to offer her anything. Now, when it goes to court, it will open the cans of worms of Opri’s over billing, and the money she illegally kept.
What ever information Larry shared with Opri, as his attorney, SHE broke the law by going on TV, and to Rita..running her mouth with confidential info. Larry should be compesated for her breach of contract. Lawyers are not allowed to talk/discuss confidential info.

Hey Joy – Virgie is not getting Dannylynn. I don’t think any court would take her from her true dad as long as he is a good dad. Besides, look at Virgie’s family, who in their right mind would put a child in her care. Her track record speaks for itself.
I appreciate your input, but Virgie would have no legal right to go after the Marshall money. You may be right, OQ would no doubt try and he does have connections with the Marshall family, but so be it. Larry’s offer to Opri may be explained by this excerpt from an article I was reading about Rule 167 in Texas Law. I found it interesting that the author compared the explaination of the rule to the rules of the card game “Texas Holdem”. Don’t know if the rule 167 would apply in other states.

If an offer of settlement is rejected, the case proceeds to trial,and the amount of the judgment is significantly less favorable to the rejecting offeree than the rejected offer, then the court must award litigation costs to the offeror. Perhaps you’ve seen others do it, but it’s wrong…basically theft of content, of the hard work others spend researching and writing.
Some bloggers will lift whole stories without any link backs to this site, or others, perhaps in an attempt to cut down on the visitors who might wander over to take a look-see. Hey, if they can do what they do and sleep at night, they are made of different stuff. Of course, they are anonymous. Just wish they had the ovaries to at least cop to what they are doing, maybe sign posts, ‘content stolen by thieves in the night.’ Lol. -ah

Mr Harris,I was just told,Dannielynn is loseing site in one eye,could you check on that,i am so sorry for the little sweetheart.my heart is heavy for Larry,he has had so much to handle.I am glad Larry has a supportive family,the good LORD HAS ANSWERED MY PRAYERS,I WILL PRAY FOR larry/

Isabel- Was any pics of Larry taken that showed anything un-becoming of him? All the pics I saw was Larry being a gentleman. As far as the “company he keeps”. He was at a party…being friendly to the other people there. I don’t think he keeps company with any of them on a regular basis. That said, he is a celeb photograper, and a very good one at that. Nothing wrong with making contacts with possible future clients if he decides to do that.
A lot of people were at that party, a lot of respectable (for H’wood) and well known celebs, not just Parris Hilton. Heck – Paris is everywhere, I don’t think anyone can avoid her. LOL- He cannot be rude and tell her to “go away, I don’t want to be seen with you”? Please, it is Hollywood. No one in H’wood has a perfect reputation. And the way you slam people that you do not know, judge them and tell them how they should run their lives, evidently, you are not perfect either. None of us are. But with all I have seen, Larry is doing a good job in raising his daughter. Just because you have children does not mean you have stay home 24/7 and wear a priest collar around your neck. Larry is a 34 year old man, he should be out mingling with his own age at times. He cannot stay at home with Danny 24/7.

Mr. Harris, where are you?
I wandered over to Rosespeaks to see whether anything new was going on and even though I found it difficult to maneuver in a strange territory, one thing was clear. I was mystified to find that a bogger who was posting here favoring the “ugly side” was there at Rose’s sounding as though she were on Howard’s side.
I really do not understand this deal and wonder whether the person suddenly came to her senses or whether the person is working for both sides.
Why in hell’s name are people doing this to Howard? I refuse to believe this is brought on by anti-semitism. I would rather believe these people are a very sick bunch, thrilled to have found a punching ball to let out their lifetime’s frustrations.

Louise, I am nowhere near perfect and I judge myself as harshly as I judge others. I wish I could wave a magic wand and start all over from scratch; better yet, I would be perfectly happy to never have been. Knowing all that about myself does not prevent me from realizing when others do dumb things.
Larry’s judgment needs adjustment simply because he has all eyes on him and everyone listing for the Marshall money is salivating in hopes that he will make a mistake so they can grab the coveted baby.
Larry is free to go wherever he wants whenever he wants, but when he does something stupid, Howard will be the one cleaning up the mess for Danielynn’s sake.
I have never heard or seen any outstanding celebrity photographs attributed to him.
Dannielynn could stand to have a caring, loving mother but Larry will probably end up with someone with is as flighty and star struck as he is. Hopefully, there will always be a decent nanny for Dannielynn to love and guide her.

I know I am not Mr. Harris, but I would like to say that some people are cross-eyed or have “lazy eyes.” In my opinion, the press is just fanning the flames to get people upset.
If you read about that condition in the medical dictionary, you will probably stop worrying.
Calling a press conference to tell the world Dannielynn is cross-eyed is just as ridiculous as shouting from the roof tops about Anna’s misdeeds or Howard’s duffle bag. There is no Opri to blame this time for having a big mouth!

You are right about the Marshall money. Everyone wants it when they have no right to it. EXCEPT….Dannylynn. The Surpreme Court decided that Anna had the right to fight for HER HUSBAND’s money. After all, Anna was married to Marshall when he died and she kept the name of her husband after he died, which is what most women do when their husband dies. As you know it is the Marshall’s that is trying to avoid the law. That said. I think Anna got plenty from the old man but Anna wanted more. And I bet any woman in the same situation would be doing the same thing. The fight was on by Anna, via Howard as her attorney before Anna got pregnant with DL and before Larry got custody of his daughter. As executor and attorney , Howard is trying to succeed at what he has to date, failed to do because of the Marshall family resisting. Larry or DL cannot and should not be punished for something Anna did. THe little girl is being a victim by many because of what her her Mom was or did. As far as Larry. You know that he was trying to get his daughter WAY before Anna died. Larry was the only one, of all of the people that was in Anna’s “do as I say” group, that had the guts to leave because of what he saw and knew what was going on. Anna/Howard had made Larry sign a confidentiality agreement when Larry got involved with her. That is normal preceedure with famous people. The agreement, if Larry ever talked, I believe was $10 Million Dollars if he ever revealed anything personal. Larry probably did not know what he was getting involved in at the beginning. When Larry left, it was Howard that threatened him to stop giong around saying the baby was his. When Howard went on national TV and claimed the baby belonged to HIM, that is when Larry decided to go public with the facts of his and Anna’s relationship and indeed the baby was HIS baby. No confidentiallty agreement stopped Larry from trying to get his daughter from a man that was illegally claiming to be the Dad and from a Mom that was a severe drug addict. Howard or no one else in the clan had the guts to say no to Anna because all involved were receiving perks by being in the clan. Except for Larry, he walked, but he always wanted Anna to stop her drug use for the sake of their baby. Anna was too far gone and all her “friends” were only interested as to what they received by being in the clan.
Larry is doing all possible to make a good life for his daughter and anyone should see that he clearly worships the ground she walks on. IF ET ir anyone else want to pay him millions for pic or interviews, why not except the offer? DL will always be ANC’s daughter and people will always want to see things about her, including you or you would not be posting things on boards. You would not be watching TV for every glimpse of her and Larry.
Larry is a good looking single guy with a daughter and is taking care of her. That said, he deserves to go out and meet adult people and have a life. The decision of where he wants to live is his, not yours or mine. Give the guy a break and stop being so selfish with your feelings. People that are posting negative opinion’s about Larry is only jealous of him…pure jealousy is what is behind the negative posts.
Isabel, a quesion for you. Would you rather have had DL continue living at the Horizons with a drugged out Anna, as we have seen on meny tapes… and a man that was illegally claiming and knowingly lying in order to claim another man’s child? I hope you think about your answer.
Give Larry his due, he is making a decent life for his daughter and she has an extended family in KY that love’s her also. And the extended family loves her with no dollar signs in their eyes.

I’m told here’s the reason Larry went public about Dannielynn’s eye condition: word on the street had it that a tabloid was about to blast off with a crack baby tale of a condition caused by a mother’s addiction, when nothing was farther from the truth. He wanted to get the real story out factually and preempt the hate spin that has ruled the day for so long.
A doctor diagnosed the baby and Anna knew, but it’s a condition that can be treated, the last resort, surgery. And it doesn’t have to happen for a while. –Art

I think Opri is arrogant and a bigmouth. I don’t blame Larry for not just handing over a large sum of money just because she inflated her bill(In my opinion she did). Larry has to raise little Dannilynn, and has to look out for her interests. Opri should have accepted his offer. Since she didn’t…I hope she gets nothing.
