Bald Truth Exclusive: Seminole Tribe V. Stern? Hard Rock Cops Want HKS Subpeona Quashed

When Howard K. Stern tried to subpoena all police records related to the death of Anna Nicole Smith in the files of the Seminole Tribe of Hollywood, Florida, he didn’t get very far.
On December 28, the tribe filed an emergency motion –obtained exclusively by The Bald Truth — to quash Stern’s request for records to use in his defamation case against a Texas lawyer who called him a murderer on national TV.
And his lawyer, Lin Wood, learned a quick lesson that classic civil litigation rules rarely apply on tribal lands, where the ex Playboy centerfold died of an accidental overdose at the Hardrock Hotel & Casino in Feb. 2007.
Under federal law, tribes like the Seminoles are treated like sovereign nations, immune from most legal motions, and civil suits, and Florida open records laws don’t apply either.
“This court lacks personal jurisdiction over the Seminole Tribe,” declares the motion to quash Stern’s subpoena, citing legislation dating back to 1934 and upheld by the Supreme Court.
While Stern apparently hoped the subpoena would force the public release of all files from the exhaustive investigation, including any contacts between police and Arthur’s investigators, the tribe’s lawyers balked.
Citing tribal immunity, the motion also says the Seminoles cannot be made to give depositions or hand over files or documents related “to the ongoing criminal investigation of Ms. Smith.”
That brief phrase was a reminder that some aspects of the case remain unresolved, as Virgie Arthur investigators work overtime to fuel suspicions about Stern, according to prosecutors and police who tell me they’ve heard from a former FBI agent who claims new evidence in the case, but has yet to produce any.
Tribal police chief Charlie Tiger, a former homicide detective, has closed his probe into the cause of Smith’s death, ruling out any foul play, while the Broward County Medical examiner, Dr. Joshua Perper, found she’d died accidentally from a toxic mix of prescription drugs, citing the sleeping aid chloral hydrate as the main culprit.
According to law enforcement sources, the so called “on going criminal investigation” cited in the Seminole’s motion to quash involves California’s hard look at the doctors who prescribed Anna Nicole’s medications, for possible medical board violations, or worse.
Those sources say the Seminole police have opened their books to agents with the California Bureau of Narcotics.
Indeed, state drug agents recently obtained search warrants for the homes of two California doctors who treated Anna and her son, Daniel, and have paid visits to the reservation.
Bahamas forensics experts say he died from an accidental overdose of methadone and two anti depressants, according to testimony from his Bahamas inquest in November 2007. Where he got the methadone that killed him remains uncertain, but medical records show he struggled with a valium dependency and was hospitalized for depression two months before he met his mother in the Bahamas.
California laws prohibit physicians from dishing out narcotics to a “known addict,” experts explain, while Florida laws are less strict. Anna Nicole’s friends tell me she had aches and pains from past surgeries, a bad back and other ills that dictated she take a laundry list of meds.
Stern has also filed burglary charges in the Bahamas against South Carolina developer Ford Shelley, who admits taking Anna Nicole’s computers, hard drives, video tapes, paintings she made for her daughter, Dannielynn, and other items from her Horizons home after she died.
Shelley claims she’d asked him to take her personal items and protect them if anything were to happen to her. But friends say she’d broken off their ties after Shelley pressed her to sign a mortgage to Horizons the day after she buried her son, Daniel, friends say.
She refused, claiming the house was a gift from his father in law, Ben Thompson, and refusing to allow Shelley onto the property. Ford’s final smackdown was caught on video tape that aired on FOX News.
Meanwhile, Shelley turned in some of the items he took to the Horry County Sheriff’s department in Myrtle Beach. Seminole police flew in to retrieve the possible evidence, then hit a wall, unable to look into Smith’s computers without a search warrant.
Unable to convince a judge there was probable cause a crime had occurred, they had to do what was unthinkable back then — request permission from the man Virgie suspected of playing a role in her daughter’s death.
When Broward prosecutors asked Stern, he said no problem; they searched Anna’s computers and found nothing to raise suspicions of foul play, nothing to implicate Stern in any way, Florida investigators told me.

Well,the little magpie are still at it.Art after reading your article,HOW could anyone believe Howard had anything to do with both deaths,A guilty person would never go through all this.IN MY OPINION,Don Clark was going to get what he wanted as evidence from the inquest,but that of course has not happened.That is why the outburst of (Bingo) he needs the inquest to help him out.Anna was no different than a lot of people that get pain meds,she had a lot of medical problems,plus (THE ONE BIG PROBLEM,GREEDY VIRGIE)

An Evil and Ruthless tactic for the Team Money Hungry to have manipulated the naive CA State Attorney to look into the doctors again in order for the investigation to be considered “ongoing”. However, the case has to be CLOSED at some point - and the G’Old Seminole folks could be gracious enough to make everything *Transparent* IF they don’t feel the need to cover up any impropriety (in which case they would not oblige for sure because they don’t have to - Although the “immunity” law probably was intended to cover matters involving the Seminole people).
Even if any doctor is charged with a violation(s), Virgie can’t try to collect a dime from it, since she is not the next of kin.
The Team Evil also asked for favors from the Florida authorities to redo the entire investigation for them (which didn’t work out so far). No doubt they are still brainstorming to be persuasive. If any authorities are tempted to cave in to the Team Evil, THEY SHOULD REREAD the thick volume of papers compiled TO PREVENT THE VERY THING THEY ARE BEING ASKED !!! Redundancy of that nature would be EXTREMELY COSTLY and because of that as well as the media scrutiny, no stones were unturned; and “chain of custodies” were meticulously conducted and documented for beyond-doubt integrity purpose; everything was multiple checked; and a TEAM of Medical Examiners were involved, with one acting as the chief examiner — In another words, *EXHAUSTIVE*!!!^#*&%#!!! — As Reported!
At this point, if the team evil conjures up a “new evidence”, I would be highly cynical: It would need to be THOROUGHLY investigated.

I think it is wrong for the seminole tribe to refuse to give info into any case not just this one, they should not have special priviledges over any one else in the country.
Everyone should follow the rules of the country, no one should be allowed to have different laws govering them.
If everyone wants to be treated the same how can we have different laws for different people??

Seminole Tribe has their own rules and doesnt surprise me. Why does it seem no one wants to work or help HKS but make things harder for him. This poor guy has been through enough. Just give him the records he needs people. The proof is out there about O’quinn calling HKS a murderer. And the tribe filed an emergency motion against HKS, come on…..Go get them Lin Wood….
Glad to hear HKS filed burglary charges in the Bahamas against South Carolina developer Ford Shelley. FS needs to pay for what he did. If you or I stole, we would be locked up for it but FS has money and thinks he can get away with it…..wrong…Its about time HKS, make them all pay for what they have done to you, Anna Nicole Smith and Daniel.

I like Isabelle’s post, no. 8. Virgie, Clark and O’Q will invite the Seminoles to a pow-wow when they go to trial in Florida. If things go wrong for them in court, they can sacrifice Rita to the flames or stake.

IMO they don’t want to be caught in the middle of this lawsuit,rich against small.They could lose out big time.A lot of their customers at the hardrock are rich people who would want their privacy protected.I just read an article from Dec 20th about a sioux tribe that went to washington and declared themselves a sovereign nation.IMO Don Clark would have already knew that they would not have to give this info out and relied on that fact.I am sure Lin Wood will be talking to them about this matter again and maybe asking for less so it would not interfer with any ongoing investigation in california.Anyone out their think maybe this was all orgastrated to fall at just this time? Just a thought as JO has been known to look that far in advance.

Art, thanks for the article, even though I am more inscensed after reading it for the third time. I knew the tribal laws were different from the laws that govern our nation, it still raises my hackles due to the wording in their document. If we get any more “Soverign Nations” in the United States, who are exempt from our laws, Poor Americans. How long before we are no longer states, but soverign provinces?
It didn’t help any that I was on the New York Lawyers blog and a person who presented himself as a Texas lawyer took issue with an article that he had read. He stated that he was not an American…he was a Texan.
It is a little odd IMO that Howard’s attorney’s (especially the ones in Florida) didn’t know about having to get a Waiver to request that information from the tribal leaders?
Just as I was feeling good about the situation…this comes along.

The Indian Nations or Tribes have their own rules and laws. Their laws and rules are very different from State
or Fed.that most of us are familiar with. They have their
own Judges and Lawyers.
We were exposed to The Indian Tribal Rules and Law, thru
a custody battle of dear family friends. The children are
of American Indian Heritage thus the Indian Court of OKla.
became involved and overturned the Texas decision.No
chance of this case being heard in either Okla. or Texas
Courts.Hard to understand, however these Indian Courts
do have their own laws and rules!

I don’t think the non-release of records to Wood is a big deal. The Seminole officials already deamed Anna’s death as a non homicide. She overdosed according to their view and their investigation. As far as OQ- he is on TV interviews making the statements against Howard with no proof or legal charges to back up what he said.. many times. I think that is all Wood needs. Trying to get records from the “Indian nation” is merely a formality. I can’t see where Wood would need them. Bottom line. There is PROOF that OQuin made false statements to slander. There is no PROOF that Howard murdered anyone.

I only hope that Shelly is facing years of jail time for what he did to Anna and Howard. I am also growing weary and also hope I live long enough to see justice for Howard and punishment to those who have tried to destroy him. I seriously doubt that any of them will receive their due punishment from the courts but I would hate to be any of them on the real Judgement Day.

After reading through the above, my first question was: Did by any chance DC retire while being investigaged for having been hired by the one he was entrusted to investigate?
I am sure the Seminole has been hounded by Virgie and company to come up with something new. For a person to be so obsessed with trying to destroy another person, it is obvious she is a deeply disturned woman who must be stopped. Ooops, I misspelled investigation, lol. Another thing, if this tragedy happened with different people involved, it would have been over long ago.
It’s so unfortunate for Howard that he happened to be involved with someone who had such a horrible family and now he has to deal with this nightmare. I never knew people like Virgie and company existed. I pray that I never get involved with anyone like them. They are truly working for the devil and Anne is right when she says “I would hate to be them on the real judgement day”. It will be too late for them to redeem themselves then.

Wichita, Kansas, Dec. 28, 2007 (AP) The KS State Brd of Healing Arts is seeking to suspend the medical license of a Haysville physician who is charged with illegally prescribing drugs. Prosecutors allege Dr. Stephen Schneider illegally prescribed drugs in a scheme that caused the deaths of at least four patients. The emergency order seeking the suspension of Schneider’s license was filed with the Office of Administrative Hearings. Schneider and his wife, Linda, face 34 federal charges centered on writing prescriptions for painkillers and other narcotic drugs. It was not known when the case would go before an administrative law judge for a hearing. Approval of the motion would result in the suspension of Stephen Schneider’s medical license until the board’s full case against him was resolved. This man and his wife are in jail with a 1 Million dollar bail each as they are considered flight risks. They raided his home and office about 2 years ago, but did not shut him down at that time, it has taken this long for the investigation. Schneider and his wife own a home in Mexico and when they went to their home to arrest them, they had their bags packed at the door ready to flee. They have 2 teenage children. This man and his wife have been accused of dispensing drugs to many many people and the people have become addicted and at least 56 deaths have occurred in last several years under suspicious circumstances. People, beware, the federal is closing in.

1. Ok people let us respect that nation of Seminoles an realize that these people were on the land first and this is their law. We do not have to understand it or accept it however that would be called “diversity ignorance expectation. ” Your expectations are too high go to another country and try to see how their laws work you will be surprised not every country acts like yours..

I know we took the Indians’ land (WE? I don’t remember being a part of it though), but as I have mentioned, everyone has done something to somebody. If the American Indians had never been disturbed or displaced, there is no way they would be living as they are now, trudging knee deep in money from casinos as they presently do. They, the natives, hunted animals for their skin, food, etc. It would be just as fair for today’s animals to punish those who hunted their ancestors. Animals understand and communicate very well in their own way. Taunt a tiger and see what happens to you!
I know for a fact that cats can feel bad for various reasons and they communicate very clearly in their own way. If I ignore my cats when they want attention, I know it bothers them. Shouldn’t we worry about those animals who were being hunted by the natives? What I mean is that every single live being (homosapiens included) has been shortchanged in some way and we cannot go about it at the rate we are going. We must have laws to be obeyed by all (ALL) and those who claim to be special or of special interests, should be immediately shown the way out to wherever they came from.
For example, when Virgie goes to the Bahamas, Florida or wherever, the Bahamians or whoever, need to show her the quickest way out to Texas.

drugs are a huge business, it will never cease to stop ever, it does not matter whom you put in jail take away a license etc etc doctors are going to prescribe medication they get kickbacks too..federal does not have enough manpower to sweep each doctors office or answer all complaints. It is a sad reality it has been going on many years taken many lives perhaps you should elect a person who understands this perhaps you should search for an elected official whose pockets have not been lined from the pharmacuticals industry almost an impossibility. Unless the elected official has had a family member who has died from this nothing will ever change. Gidget a few years ago they showed a line of people going into see a so called doctor for pain pills,I forget whic kind they were,but thet were very addictive and the doctor seemed to be handing them out like candy.I mean long lines out in the street.This doctor was also caught.I never heard what happened to him.Big difference betweengiving someone pain pills like vicodin ect for bad pain and what these doctors were doin,Selling drugs to anyone that came in to see them.

It’s really sad that both ’sides’ are attacking each other while proclaiming how vile, etc. the other ’side’ is. You know, everyone can argue till they’re blue in the face..it doesn’t change the fact that Howard K. Stern has not been, and will not be charged with anything.
