Bald Truth Exclusive: O’Quinn Motion To Dismiss

On the third day of the inquest in the Bahamas, Houston lawyer John OâQuinn Monday was busy in West Palm Beach, filing an amended motion asking a federal judge to dismiss the defamation suit Howard K. Stern filed against him for calling the Anna Nicole Smith executor a murderer on national television.
In a 17 page brief, OâQuinn argued whatever statements he made came on the heals of public discussion of the suspicious nature of two deaths, Annaâs and son, Daniel, and his status as a lawyer for Virgie Arthur, Annaâs mother, who had a bonafide interest in her dead progeny.
âThere is little doubt that all of the challenged statements were made in the course of judicial proceedings and were related to the litigation in question, and that OâQuinn has absolute immunity,â he said in the motion.
Whether the judge buys it or not, the legendary litigator also claims heâs protected under freedom of speech protected by the 1st Amendment, and was only echoing the tone of the news that talk shows were already spouting.
Whether OâQuinn and his investigators or bloggers or client had anything to do with kicking off the finger-pointing that sparked the news tone is sure to be raised, legal experts suggest, but the lawsuit only addressed it as an aside, and heâs arguing the court shouldnât look too closely at his talk show soliloquies as defamation.
In fact, he argued the court should ignore any “transcripts taken off of the internet because they clearly say âThis is not a legal transcript for purposes of litigation.”
Curiously, there was no mention of the flames fanned by the book under fire by Rita Cosby, who said she relied on O’Quinn’s investigators as sources.
Stern’s response is due Dec. 24th, but itâs unclear how long after that the court will make a final decision.
In the meantime, one of OâQuinnâs investigators, Wilma Vicedomine, is scheduled for a deposition by Lin Wood December 17th in connection with O’Quinn’s defamation suit as well as the $60 million libel suit Stern has filed against Cosby.

how can oquinn lie and say that there is an criminal investigation into anna’s death has been reopened? the invesigation is over and florida has determined that anna died of an accidental drug overdose. don clark letter from the prosector stated he had new evidence, but when he didn’t deliver they sent him a letter back. the letters are here on this site. can’t he be charged for lying in his motion to dismiss? this guy is some piece of work and i can’t wait until howard takes him down.

O’ Ginn needs to pay up. This is not the first time he has slandered Howard. He gets his drunk self on these shows and tries to be both funny and threatening. When Greta pointed out to him about his words, he laughed and said what about the “7″ 1 million dollar insurance policies? Even I knew this was a big lie. It is time for someone to pay for all the hell they have put Howard through. Virgie and O’Ginn need to ride off into the sunset on their judgment against them.

1) O’Quinn is an attorney and should be held at a higher standard. He went on national tv and slandered Howard and
knew he slandered Howard. He may have immunity in court but not on tv.
2) The doctors had not determined how the deaths occured.
3) Free speech doesn’t shield you against slander. Ask the National Enquirer, they had to pay out many times over the yrs

To call this ‘vilmer’ an investigator is an insult to any female or male who has ever had to go through the process to become a ‘Private Invesitgator’. Texas has a wonderful group called TALI, Texas Association of Licensed Investigators. Over the last 16 years I have worked with their members and a better group cannot be found! PROFESSIONALS, TALENTED, and HIGHLY TRAINED! All talents this person lacks, and she is not a licensed anything!
We keep seeing this titled bantered about, it is very difficult in most states to become one! There are many ‘pretenders’ and this is a classic case of someone going to Toys R Us and buying an outfit meant for a child! And poof! showing up looking like Sherlock Stupid! Oh! She is a lot of things and I am sure that will come out, but a Private Investigator? Mr. O’Quinn himself had no idea ‘he’ even existed or was it a ‘her’……Again, it is an outrage and insulting to all those women who have gone through the process and recieved there credential. Just because you hang around with ‘Superman’ does not mean you can fly!

We will have to make sure it is broadcast throughout the nation and the world, knowing fully well there will be no consequences. Better yet, let’s name EVERY SINGLE person, neglecting NONE, who has ever said anything derogatory about Anna and Howard.

Unbelievable! He is claiming that his comments that Howard is a murderer were related to a “judicial proceeding”. The only judicial proceeding going on at that point was where Anna was to be buried! The law he quotes relates to a [murder] trial where a lawyer/prosecutor may call a defendent a “murderer”. What a desperate man o’quinn is!
I also laugh that he cites “Florida” law and yet at the same time he says he is not bound to Florida’s law’s!
One of the reason’s talk shows and news print/shows talked about “murder” was because of o’quinn’s and vergie’s statements in their venue! He tries to hide behind their reporting saying he “just weighed in with literlly dozen’s of other commentator’s, journalist, ….. in the media frenzy”.
This “lawyer” is sure showing the public how unethical lawyers can be IN MY HONEST OPINION! He definitely was speaking “with malice” of his own (not just representing vergie’s) when he uttered his contemptible statements! Ah, I watched ALL of the shows o’quinn, not just a portion so there is no “out of context” when I formed my opinion of your actions!
He states that a criminal investigation into Anna’s death has recently been “reopened” and there is “no conclusive cause of death”????? This is news to me! What’s up with this Art? Who has reopened a criminal investigation?
His whole defense seems to be that it was all right that he say the things he did because “vergie believed it” and “everybody else was saying it” so he could too! WOW! Reminds me of a little kid’s excuse.

Dear Mr O’quinn,
I wonder if when you were born did the doctor hold your head too tight with the clamps? Perhaps a little brain damage? I think that would be your only real defence that you could use after saying all those nasty mean things on TV and than you try to yell Free speech, only when you are not slandering a person, not demeaning public property etc etc, I guess your form of free speech is your perception not anyone elses.
I really hope that the judge on this case has integrity.

I thought O’Quinn WANTED to be sued by Howard and that’s why he called him a “murderer” on national television.
I thought it was ALL part of O’Quinn’s “master plan” to get Howard on the witness stand.
I thought he wanted to “GET” Howard good.
But, John O’Quinn, if you want to GET Howard, why would you file for a dismissal? It doesn’t sound like you want to “GET” Howard at all. It sounds like you want to worm your way out of this lawsuit and you’ll do it any way you can. It sounds like you were LYING when you said you wanted to get Howard on the witness stand, since you’re fighting to get the case dismissed.
Hmm….I guess I’ll just add it to the long list of lies that O’Quinn’s already told over the course of this saga.

Why! is it that O’quinn was the only person that came straight out and sad quote” Howard killed Anna ” and he said it more then once, no one else used those words but O”quinn. As a attorney he should know what to say and what not to say, I think he was so caught’ up in the moment being on TV, and all the news media, that he did not care what was coming out of his mouth, he was trying very hard to make Howard look bad, which by law is called” slander”, I think that he should be held responsible for his action and his request for a motion to dismiss Howard’s lawsuit should be denied.
The laws says you can sue” a person for slander’ why should O’quinn be any different!

This was pointed out by a friend so take no credit for catching it in the motion JO filed.
Sorry but I have a family lawyer program for my home computer that prints more precise language that his from a law firm does. It says he should give great consideration to retirement. Same with the one VA filed against the TV stations, looked like those were written by a grade schooler. LW needs to have it simply thrown out for false information. Now wouldn’t that be the cat’s meow?

What an abuse of free speech! OQuin as a lawyer should know better than anybody else that you cannot accuse someone like that without proof. What he did was calculated and meant to hurt Howard and turn public opinion against him. And he did a good job at that, search the internet and you will see. There should be protection against such vicious slander and an example should be made of OQ. What about Howard’s right of being innocent until proven guilty?

While I don’t profess to know ‘legaleze’ from Mr. O’Quinn’s statements, it seems to me he is taking the same road Rita took. ‘Didn’t know what I was talking about at the time facts were presented’. And so both of their mouths ran which fueled speculation and commentary and what’ifs. And most of it began after Virgie’s denial that Daniel’s death was simply an overdose. I know the inquest has not conculded but that seems to be the general conculsion, so far.
Did Virgies involvement with DARE throw her into the ‘drugs are evil and I know Danny would never be tempted to try them ‘hisself’. Did she have any knowledge that addiction runs thru generations and not always out of the blue? Did Virgie prop herself up on a barstool or two and just maybe had a battle with addiction herself?
I’ve read bloggers thoughts and opinions, and listened to newscasters trying cases in the court of public opinion before a jury is even selected. And he who is the most snarky, and outspoken, gets the best ratings. And the bloggers. Some of them could put Rita to shame for writing a best selling fiction piece. Oh and must not forget the ‘evil’ element. I swear that some must still have monsters hiding in their closets for their outlook is so much tunnel vision.
And since it seems that the major networks are on to defame and prosecute the next sound bite that a court room may be the only place to slow it down. Is that why Court TV is going off the air? Liability issues just like the tabloids?
Don’t forget this Art. Don’t become one of them. If nothing else, Anna made her impact on the world by showing just how corrupt some people will stretch the truth. Not all the general public can be snowballed and coerced to think that we are just mindless dummies without thoughts and opinions and wanting to be shown facts instead of who can yell the loudest.

Being the âreasonableâ person that I amâŠ..I did not believe OâQuinn when he called Howard a murderer on national tv as a statement of Fact. But I did believe that it was Defamatory, in every sense.
As far as OâQuinnâs âallegedly defamatory words cannot be view in isolationâ âŠ(well, Iâm not guilty of that. ï ) I have read every article that was printed regarding his past history, reasonable person that I am.
The one about him bribing jurorsâŠthe one about .that poor Ms. Edward that wittnessed against him in the SC case…How she received threatening phone callsâŠhad a brick thrown through her window. How she was scared of him. How he (once again) didnât pay her for the clients she had brought to his firm.
Thatâs just to name a few. (So..âviewed in isolationâ is out as far as Iâm concerned. All articles can be found in archives in the Houston Chronicle. Perhaps QâQuinn will possibly learn the the 13th Juror can back-fire on you. I hope so.
By the wayâŠ.there is an error on pg 9âŠâalthough Stern claims that Stern uttered falseâ. Could be thatâs not the only error he, or his firm made.

I thought all of O’Quinn bloggers said O’Quinn called Howard a murderer because O’Quinn wanted Howard to sue him so he could depose him. They couldn’t wait to have John have a go at him. If this was John’s purpose then why is he desperately trying to have the law suit thrown out. Looks like those paid bloggers are wrong again. And O’Quinn will lose this one too. An attorney should at least be smart enough to know that repeating what other people say as gossip without proof is not covered under the first amendment. He should be disbarred at least for incompetency and drunken diarrhea of the mouth. This filing shows that he is grasping at straws and he is very worried as he should be. And it is sad to see a filing full of lies that he is hoping a judge will believe or else he is trying to buy time hoping someone somewhere will file anything even jaywalking on Howard.

This lawsuit should stand and O’Quinn must lose if nobody is paid off. He and VA were relentless (for a period) in their intent to persuade investigators and jury pool, in case it come to that (their hope was - and still is - to dig or fabricate for the “ham” to indict, lmao); after once or twice, I didn’t even bother listening to them knowing how Anna wanted to live her ADULT life without VA’s intrusion; I couldn’t help seeing their faces, but thank goodness for the TV control.
VA: You needed to allow Anna her free will; now even in death you are hounding her - all for money.
It’s sickening to see the media cover Daniel and Anna’s case ad nausiam, but because it was covered extensively and unfairly, it needs to be concluded properly according to court of law (including suing a number of people even though it has to be a pain), so that everybody can move on already! Tens of thousands die each year from prescription drugs interaction; Daniel’s was just one of those unfortunate cases…. As for Anna, I always speculated that she died of a combination of a broken heart (Daniel’s death), shock (the suddenness of Daniel’s death), and depression/stress (Daniel’s death, Larry battling her in public when she should have been taking it easy during the later stages of pregnancy and subsequent birth…. as well as VA constantly accusing Anna and Howatd of murder - how angering that must have been, and we saw the evidence of that in her face and quivering lips as she challenged VA to “bring it on”), and possibly post partum. I don’t think she would have OD’ed if she didn’t go through all those things simutaneously - at least not this early in her life (not knowing future). How much can one person take?!!??! On top of that, during the same period, she was pressured to move out of the house she lived in (which we now know was against a court order!)
Since HKS had been lynched this much BEFORE they got married, boy am I glad for Howard’s sake that it didn’t occur AFTER. Phew!!! Divine intervention, I feel in a sense!!!

I read somewhere that on Tuesday, Virgie “cried softly to herself” in court upon hearing the Bahamian Chief of Police describe the congested state of Daniel’s lungs.
I get the impression Virgie must have been practicing so as to give the appearance of being human and having feelings. It is easy to cry softly (but just loud enough to catch the attention of those nearly.) Next thing you know, she will be shedding real tears, with the help of freshly cut onions stashed away in her flowery pen.

#34, Isabel: Vergie Arthur will never win any Mother of the Year awards, but do you truly find it impossible that a person can make serious mistakes and even horrendous errors of judgment, yet at the same time have feelings? I do not. While I am no fan of Arthur’s, I would not presume her to be without emotion. I can imagine, even, that she has all the feelings associated with the death of a family member, albeit a distant one. Denial, Anger, Bargaining, Depression. . .and perhaps one day, Acceptance.
It is not always necessary to completely dehumanize on person in order to promote your faith and belief in another.

What O’Quinn did was just the same as yelling “FIRE” (eg: “MURDERER”)in a public venue when there was no cause to do so at that moment. He inteneded to elicit a hysterical response from the public based on false and “inflammatory” (no pun intended)speech. That behavior was determined by the Supreme Court long ago as NEVER/NOT protected by the First Amendment.

This is a prime example of what could happen! when a parent don’t raise their children right. You as a parent have to lead your child in the right direction, Because when they have children they are more likely to raise their child the same way you raised them. Anna start using drugs at a early age, She quit school at the age of what? 14 0r 15. When I see Ms.Virge out there in the news fighting with Howard flying to the bahamas, It’s sad because she was never there for Anna and she had not seen her grandson in 12 years or so, Where was she before Daniel annd Anna died. Now Ms. Virgie and her phony attorney got their hands out for money 4 $ that women don’t deserve a penny. and that phony attorney need to get ready for court. There will be not dismissal in this case.

It is baffling to me as how such a decorated lawyer can spout such nonsense. This man is the reason that lawyers are the butt of so many jokes about being unethical. To claim the 1st amendment is completely absurd, this is most definitely a case of defamation. I don’t know how O’Quinn thought he was going to get away with that, but he’s in a tough spot now. Between him and Opri it seems like everyone on this side of the saga has terrible representation, despite the fact that this is pretty much an open and shut case the Marshall’s may not even need a star attorney to beat this incompetent bunch.

I was outrage by O’quinn’s accusations on television. I have seen him many times on different programs and there is no doubt in mind his statements were defamatory and he had every intent to destroy Howard in the minds of potential jurors, judges and the public. I certainly hope the court does NOT dismiss this case. It should go forward and I hope that Lin Wood rips O’quin to shreds and that he has to pay Howarrd bigtime. The fact that VA turned around and sued Howard for defamation is laughable. Howard has been a gentleman and a true officer of the court in his public handling of VA. Smart man.

What I find fascinating is that Virgie never showed any emotion, even while shoveling and stomping on Anna’s grave. Recently, bloggers on this site wanted to know whether she had cried in court in the Bahamas, (someone asked Mr. Harris to ask Bain whether she had in fact cried when Daniel’s post-mortem picture was shown in court) and then BINGO, a few weeks later she manages to cry in court. How coincidental, I think!
I think it is great that those involved, or rather RESPONSIBLE for this horribly sad Anna/Daniel saga come to this site. If what we say causes temperatures to rise excessively, the NURSE can attend to them.

Barbara @39 While I agree VA has feelings I do not think she will ever accept the truth of what really happened.She and her so called team tried to dehumanhize both HKS and to some extent Larry B,Dannilynns father,thru their bloggers.Even to some extent Dannilynn by saying she should being certain things according to their timetable,when everyone knows every child moves along at there own pace.Some slower some faster.

I think OQ ,JUST LIKE VIRGIE,was counting on the inquest bringing Howard down.That is not going to happen,OQ LOST A LOT OF MONEY FUNDING VIRGIE,and now will lose more to Howard .The courts have 2 lies to sift through.ONE HE WAS LEVELING THE PLAYING FIELD,SECOND HE WAS REPEATING,THE SLANDER HE STARTED,BY FIRST CALLING HOWARD A MURDERER.HE KNEW THEY (FOX) WOULD FOLLOW HIS LEAD.I have never seen such NO TALENT REPORTERS AND ANCHOR,S THEY RIPED HOWARD DAILY,NOW THEY ARE ALL QUIET,MY CHRISTMAS PRAYER IS EACH AND EVERY ONE OF THOSE WHO DELIGHTED IN TAKING HOWARD APART,LAUGHING,AND MOST OF ALL GERALDO,THE 5 TIMES MARRIED FOOL,SUFFER THE SAME AS HOWARD,I AM ASKING THE GOOD LORD TO GIVE EACH ONE OF YOU,WHAT YOU TRULY DESERVE.

did virgie have a wet sock she squeezed on her face at the right times..maybe she had prune juice in her pen….everyone knows you can cry by removing a cockroach soaked in lemon juice from your armpit,and swallowing it right before you want the tears to flow. anyone who thinks otherwise is a liar and idiot.
