The Bald Truth has learned a federal judge has dismissed the $100 million civil rights suit against Howard K. Stern filed from behind bars by an ex-Anna Nicole Smith boyfriend serving time in state prison for assault with a deadly weapon.
In a world wide web exclusive, The Bald Truth reports Mark Hatten, a California prison inmate serving six years for assault with a deadly weapon against Smith’s neighbor and for making threats against Smith, had no standing to sue Stern, judges or prosecutors, according to an Oct. 31 ruling in federal court and obtained exclusively by www.artharris.com.

A jury convicted Hatten of attacking Smith’s neighbor and threatening the actress.
Like others who now face defamation and libel suits from Stern, Hatten accused the Anna Nicole executor of murdering Smith and her son, Daniel after two police investigations ruled both accidental overdoses.
Hatten is also the big brother of Jackie Hatten, a primary source for the purported gay sex scene in Rita Cosby’s book claiming Stern and Larry Birkhead were lovers and co conspirators.
Those who know Smith tell me Hatten never even met Birkhead and got bounced from Smith’s life long ago after her brother turned violent whacko. Recently she championed her brother’s claims, making headlines when they filed suit in September.
Hatten’s convict rantings about Stern’s purported plot to poison him, claims Daniel confided in him like the self-contradicting PI named Jack Harding and other hard to follow scenarios can be heard on his website.
In comments about the merits of his lawsuit claiming Stern conspired with other public officials to railroad him, the judge observed that Hatten never did offer any evidence that they’d even met, much less conspired to do him wrong.

The lawsuit isn’t officially dismissed yet. That requires a separate and distinct court order, and this is merely a recommendation for dismissal based upon a motion to waive filing fees (which is also recommended to be denied).
The lawsuit itself will undoubtedly will be dismissed, though, for reasons of immunity and failure to state a cause of action with regard to the civil rights claims; and lack of standing insofar the death of ANS and her son.
He may try to refile insofar as the deaths as a “private attorney general”, since that trick is not unknown among jailhouse lawyers. It also will not stand, but prisoners don’t care if they abuse the court process since they have nothing to lose by doing so (since they can apply for waiver of filing fees) and nothing better to do with their time.
I therefore suspect this will not be the last lawsuit filed by Hatten against Stern and others. If he does it often enough, eventually the courts will declare him a vexatious litigant, at which time he will be required to gain court approval prior to filing anything.

I am so happy that stupid law suit was denied, I’m sure they knew this when it was filed but I beleive there were more people behind this law suit than just Hatten, he just wasn’t smart enough to figure out that they were after other things and not really concerned about him at all. Some people just won’t give up and they should of known when they started strolling prisons for there next victim that they had hit the bottom of the barrel with him. Now hopefully him and his wanna be Anna sister will disappear. Seems to me their 15 minutes of fame was up along time ago.

I would counter sue him and his sister for future earnings they will try to make soon, from shows to book deals. Imagine Jackie and her bro finding out the news a few days ago, after her big dirty mouth said those horrible dispicable things about Howard and Birkhead, on every single network that would listen to her along with Larry King.
Right after ANS died Jackie went on his show to say that Howard was responsible for her death along with Daniels death, and how controlling Howard was and how Howard never let ANS see Jackie again or her brother and said he was also responsible for Larry and ANS breaking up, and being ANS’s drug dealer an feeding her the drugs. Jackie Hasbeenhatten really bad mouthed Howard.It was slanderous!
Well this is great news and of course Howard had to know it would be thrown out of court, this was just a diversion of sorts, to keep his lawyer too busy to fight the other suits and was probably caused by none other than that low life lawyer of Virgie”s ,Oquinn, the mega dirty mouth of the south.
Or as we affectionatly call them all “team stupid.”
I guess this has now caught Jackie and her bro in a very comprimizing position, she will probably have to testify about her statements in the book and probably have to explain her actions on King. However I don’t believe she can ever explain the whys of why she was banished so long ago from Anna’s life nor will she take responsibility for the role she played in that dismissal. There is a total lack of the word Integrity in this case, it reeks injustice, along with all the assumptions.
Howard I hope you have the stomach to deal with it all, actually I believe you do if you could fight something for Anna for 12 long years well I guess you can handle anything.

I am so happy Mark Hatten’s lawsuit was DENIED and we all know who was behind it. These people are unbelieveable. They are throwing everything but the kitchen sink, at HKS and just keep on losing. This was a very wise judge and he saw completely through this farce. I am happy that this is one less situation that Howard has to deal with. What a great ruling.

The resident Lawyer, cough, cough, over there is saying you got it all wrong and they are now going to pool their funds together to get MH the 350 bucks he needs to re file, or something? Anyways they are saying you are wrong and the document you posted dosen’t dismiss anything. Can you think of what horrible people would actually send money to a man like Mark Hatten,just because they need Howard to be guilty to validate all the hate that has consumed them for over a year now? Now that this ones behind them - one has to wonder …with all the frivolous lawsuits that were started with VA Team …I wonder what they’d do if someone ever really paid any attention to them…I would make them spend their cash on lawyers and then have the judges deny them one by one..and also take on a case manager so that they can only go before the same judge over and over again…sooner or later they would stop.

The attorney who agreed to file that lawsuit for Hatten is in the same league as O’Quinn. He is learning, give him time and he will become the pro that O’Quinn is.

I don’t know about anyone else, but I don’t think anyone in prison should be allowed to do anything like this. They are supposed to be paying for their crimes, not filing lawsuits. In my opinion, they have NO RIGHT to do anything! Their rights to anything, should all be taken away as long as they are serving time, period! On a prisoner incarcerated, it does NOT take a separate court order… If it were for JUST the money, the first two pages would have taken care of that. The judge had her clerks do some research (I. E. they could have waived the filing fee as they did with Hatten vs. the Warden), but this judge who has both cases attached her “opinion” after the two pages dismissing, denying and closing the case. If you go to the court site you will see that the case was closed, terminated thrown in the garbage can that Hatten and sister dear deserved on Nov. 5, 2007. If it has just been about the money that would have been done by the Magistrate on the Oct. 17 signature of it…
My blog (sadly at times having a server problem) has a long discussion of the “Opinion” attached to the dismissal. Now Hatten has another case against the Warden and the only thing ordered to be paid and paid was $5.00.

The fact that Howard won this legal battle (if you can call it that) is not shocking in the least. As far as any sane person could see, Hatten didn’t have a leg to stand on, and this is just one to add to the pile of frivolous suits brought on by the characters in this sad drama. I hope that someone talks sense into Howard and Larry before they embark on the granddaddy of all frivolous lawsuits and pursue the Marshall estate, because as we all know not only would that drag on forever but almost undoubtedly there would be any number of “spin-off” lawsuits that would emerge and who knows by the end there might be too many suits in play for Art to cover.

If the going gets tough, hopefully Mr. Harris can hire assistants to help him wade through all the lawsuits In Howard’s path. I bet all these people bringing lawsuits wear crosses and other religious trinkets to show the world how godly they are. These admirable people have been assured there is a place for them in heaven and my guess is that they will arrive just as surely as those expecting a seance with all those virgins.
I can no longer tolerate reading the comments on TMZ, for I cannot understand how odious these Texas hired hands are. I used to believe those bloggers were merely brainwashed ignoramuses but now that I know they are following their leader, there is no point in subjecting myself to read trash.
For Virgie to have so much hatred, there is no way that woman can possibly have ever felt any love. Those husbands must have been trapped against their will or better judgment for whatever reason and never loved that woman, thereby making her feel worthless and hateful. She is too vile. Same goes for O’Quinn. They are unlovable, vile, greedy creatures.
Hatten, IMO, is an unstable person who was never treated for whatever ailed him, resulting in the worsening of his problems. For his sister to join in and shamelessly flaunt herself publicly while unleashing all those lies reminds me of someone I have encountered who suffers from a histrionic personality disorder. I really wish more attention would be paid to the treatment of emotional disorders because that is what causes so much pain and suffering in this world. In my opinion, heart disease, cancer and whatever else is horrible, pales in comparison to the horrors of untreated mental illness which is so common and causes such havoc in so many lives.

Seems Mr. Marshall was busy being a wealthy old man, and he probably felt a lot of pain…and Anna, while trying to relieve his pain…and hers…got so caught up in all of ‘that’ that they, meant to, but didn’t really take care, of the little boy.
I think ‘they’ thought so much…and cared so little.
A mind is a terrible thing to waste.
Maybe the ‘old man’ tried…and just didn’t have enough energy left.

I hope Howard pursues it with all his heart. Mr. Marshall wanted Anna taken care of, I’m sure he realized what a horrible life she had bee raised in with her family. Mr. Marshall knew he had more money than his family could ever spend, and I hope Howard gets every dime coming to him and to Anna’s estate. And I hope the money is where Larry can’t touch it,,he is too immature, but that is just my opinion based on having a son that acts just like him and he’s the same age.

On a lighter and more poignant note.
Anna would have celebrated another year today and seen the joy in her daughters eyes and enjoy the the different milestones, first word, first smile, first step. She would be happily married to Howard probably expecting another child not forgetting but getting stronger over the loss of her son. RIP Anna …Your sweet carefree attitude is missed. May your soul truly rest in peace. No more hurtful words to hear, no more court battles, no backstabbers to dodge. The greatest loss is not seeing your daughter grow.
I will pray for Dannielyn that she is protected and loved and that angels will surround your little darling and that Dannielyn become the woman that God intended her to be and not saddled with the snickers and hate that spew around her from day to day.

I know you are going through a rough time but forget these people for a day and celebrate you. You have accomplished much and weathered much, you have life and things are changing. The hurt is still fresh but it will ease with time. Just take comfort in knowing that despite everything Ana knew that YOU cared and loved her and loved her son and daughter. Those who don’t see, won’t see, don’t care to see. Above all they are not worth the time and energy. Stay strong, enjoy your family and the love that surrounds you. Keep your head and fight on for you, for Dannielyn and for Anna and Daniels memories.

I am of the same opinion. I suppose all of you have seen Larry’s shopping trip on Robertson Blvd. with Dannielynn this week. He, of course, knew the camera’s would be there. I just don’t think he is capable of the job facing him. He is such a child himself (the same age as Howard but what a vast difference in those two men)!!! Bet Howard would know how to dress her properly (no shirts asking “Who’s your daddy” I bet), Bet she would have a sippy cup and not a bottle for a baby her age, bet she would have on proper shoes for a baby her age. Bet Howard would not throw her in the air time after time, kiss after kiss while makeing sure the camera’s got a good shot. There is just something (several things) about Larry that troubles me, just like there is NOTHING about Howard that troubles me. A child needs someone who is honest, strong, loving and always willing to put their best interest FIRST. Howard has and would always do just that. I can’t help but worry about Dannielynn and I would not worry about her if she was with Howard. That, of course, is not to be. What a shame and how unfair to Anna’s little girl. Larry may be okay but he is not, nor will he ever be, a Howard K. Stern. JMHO.

Concerning Anna’s birthday, Howard, Anna’s longtime love, says…..”I feel like Anna felt on Daniel’s 21st birthday after he had passed away. I hope that someone talks sense into Howard and Larry before they embark on the granddaddy of all frivolous lawsuits and pursue the Marshall estate, because as we all know not only would that drag on forever but almost undoubtedly there would be any number of “spin-off” lawsuits that would emerge and who knows by the end there might be too many suits in play for Art to cover.

I am sure you are not the only one who believe in giving people the benefit of the doubt. But the Hattens and Virgie and company did not even try to give Howard the benefit of the doubt and what they have been doing to Howard is not funny, it is very vicious and have most of us seriously concerned. It should have you also concerned if you are this wonderful fair person that you try to portray.
At this site we support Howard, and we do not apologise for that. 99% of the media joined in the trashing of Howard. All of the hypocrites who are now complaining that this site is bias towards Howard, did they complain when everybody else were biased toward Team Stupid? Fairness is not their concern, the fact that we say NO to the vilifying of a fellow human being (which happens to be Howard in this case), that is their concern. So we do not claim to be good people, we try to be fair in giving Howard the benefit of the doubt.

Anne…I agree with your post about Larry. I’ve said this before and now I’m saying it again. Dannielynn needs to have hard soled shoes on if she is ever going to walk right. She should have been walking by herself by now, even for a late walker, but she needs shoes to help with her balance.
Larry also needs to let her walk while he holds her hand. She needs to get the feel of balancing herself on her feet, WITH SHOES. He also needs to stop bouncing her constantly and she should have been completely weaned from the bottle several months ago.
A child has to be constantly taught things all the time. You can’t just wait until they happen. They need constant guidance. I hope he’s reading story books to her, also.
It seems like Larry is giving her too many “crutches” to lean on so that she can’t progress as she should. Maybe that’s what happened to him, hmmmm. Maybe that’s why he never grew up. I think she is an intelligent child, but needs to be taught these things.
Sorry, but it’s just the mother in me that made me say these things, lol.
That’s all I’ll say for now. I could say a whole lot more, but I won’t.

Since I was talking about being a mother, I couldn’t help think of Virgie and her being Dannielynn’s grandmother. Has she no idea how wonderful it would be to be a grandmother? To have a darling little girl to love and cherish? It just boggles my mind when I think of Virgie only wanting control of Dannielynn’s money one way or another. She has proved that over and over in everything she has been doing. She wants Howard out of the way so she can try to gain control of Dannielynn’s money. She cares not about seeing and holding and loving that dear little girl, only control of money that isn’t hers to control.
I have no grandchildren and would be the happiest woman in the world if I had one, especially a little girl, after having all sons. If Dannielynn were my grandchild, the only thing I would want would be to love her and sit and read to her and and rock her, and sew little dresses for her, to nurture her and just be a grandmother to her.
Virgie, what in the hell is wrong with you? Why do you have such a beautiful grandchild that you don’t care about and I have none, but would love with all my heart and soul had I any? YOU explain that to me Virgie.

Joni……. I have read your post now for a very long time. I know the sort of person you are and feel as if I know you. You are a “good” person. There are so many good people on this site. It seems to me that good, honest people who can think for themselves have supported a very deserving person (Howard) from the beginning and none of us have faltered - nor will we. The vicious lies and attacks on Howard never fazed us. From the beginning we listened, we watched and quickly made up our own minds about the kind of person Howard was and is. His honesty, his basic goodness, his kind heart and devotion to the people he loved touched our heart and soul. How anyone could have missed these wonderful qualities and set out to destroy him is something I will never be able to understand. I think it was you (joni) who said you would like to thank Mr & Mrs Stern for raising such a wonderful son - I certainly feel the same about them.

Anne: I have always noticed that we have seen things the same way. I can’t remember if I said that about the Stern’s raising a wonderful son, but I certainly wish I had if I didn’t say it. It sure is true, isn’t it? He is a fine example of what a man should be like and we should all be so lucky to have someone like that. They did a fine job raising him and it shows. Howard has also done a fine job of being the person they raised him to be.
There are some people that have been making fun of us on another site, for supporting Howard, but they don’t bother me a bit. I’ll keep supporting him no matter what anyone says. Anne, you are right in that we could see that Howard is a good man and I guess some people just can’t take goodness.
Howard could be wearing a halo and angel wings and those other people would still be calling him evil. They are incapable of seeing anything good. It’s really sad that people are like that, isn’t it? I actually feel a bit sorry for them.
Anne, I think you are a good person also, and you are right, there are many good people here on this site. It doesn’t take much to pick them out from the bad ones, does it? It’s been the “good people” all along who have been supporting Howard and continue to do so.

Regarding the comments on these sites about Dannielynn not being allowed to walk on her own, I think it is dangerous enough to have her out in public. Why be distracted watching and guiding her while surrounded by strangers?
As for those concerned about the possibility of Dannielynn’s little arms being dislocated, something similar happened to me as a child while someone was playing with me. Funny that I do not remember anything about it other than my mother having a “coronary” over that incident.

Anne and Joni-Just for the record-sorry I have eight kids and I gotta say it-The American Academy of Pediatric Orthopedists (sp?)recommends that children just learning to walk go barefoot or wear soft soled shoes with a wide toe box UNLESS they are walking on dangerous surfaces. My kids Dr.s had to DRILL this into my head!
Also, Joni-I just had my first grandchildren this year. A boy in Feb. and a girl in Nov. (and I still have a 2, 3, 6, 8 15,and 17 yo at home!) My point is what you said about VA is SO TRUE! She has this amazing little granddaughter, and all she sees are dollar signs. How truly sad. I don’t care much for Larry, esp. after I saw him parading that poor darling in front of the cameras like that. You know, people are always accusing Howard of ‘pimping’ out Anna. But Anna LOVED being a STAR! And they at least arranged for the photos! If there was (well, there IS) a lot of interest from magazines, etc. then how about once a year or so, set up an actual photo shoot for the baby. Put the money away for her, or donate it. But don’t pretend like it was an accident. That was just a sad scene.
As for the Hatten siblings. Every time I hear that name, all I hear is that woman’s screechy voice saying “Anna was my FRIEND” every five seconds per interview…GOD that drove me NUTS!! ICKKKK!!! I KNEW she was a LIAR from day one! Good riddance to the icky brother…for now.

Sorry, I have to add something else, for those of you who don’t go on Art’s Forum. Thank you Art, for having this site. You saved my sanity when I was starting to think I was Howard’s lone supporter! And everyone that also supports Howard, thank you all for having level heads, open minds and brains that function. You’ve given me new hope. I always felt a special kinship to Anna. We were only a few days apart, the same year. And then she died where I was born. About a block away. And, I’ve had some similar problems..but with a great(late)Mother! I was rooting for her and Howard to get together from way back when her show was on. I have a big ole crush on Howard for the amazing, supportive, strong man that he is (the fact that he’s hot doesn’t hurt either..hehe). The fact that he cared for Anna, even through her other ‘relationships’, and his love never wavered tells me he is a most incredible man!

Margie, when my kids were learning to walk, my doctor told me to go from the soft soled shoes to the hard soles. They were better able to stand alone when they had a good hard sole on their shoes.
Maybe that is outdated now, I don’t know, but I still think she would be better off at her age with hard soles. Kids do learn things at a different pace, but they also need some help.
Eight kids? Wow! I wouldn’t have been able to handle that. I have three (all grown now) and that was a handful, lol. Best of luck to you.

OK. I see what you mean. You were talking about babies’ shoes and Flowerz was talking about something else. I mixed them up and my comment ended up not making sense.
