Bald Truth Exclusive: New Stern Complaint: Virgie Lawyers Behind HKS Smear, Cosby Book!

It took a few months to unravel and a pattern to emerge, but Howard K. Stern says he’s now put it all together in a shocking new court document, obtained exclusively by The Bald Truth, that outlines a calculated crusade to defame and destroy him, and purports to show how and why all roads lead to Texas.
To hear Stern tell it, Virgie Arthur attorney and “legendary litigator” John O’Quinn, motivated by the Marshall estate pot of gold, has used the same playbook against him he’s used before to win major settlements from corporate evil-doers like Big Tobacco. Only in this case, he’s using a grandmother banished from her daughter’s life as a victim on a mission–to emote pain and suffering, and cast suspicion.
Meanwhile, JOQ dispatches his PIs to dig and dish to a writer who apparently takes their reports as gospel, and publishes a book in lockstep with The Message, at the same time, hawking his own anti-Stern spin on talk shows, newspapers, the web, churning a tsunami of hatred and suspicion, says Stern lawyer Lin Wood.
According to Stern’s new amended defamation complaint, JOQ has orchestrated the attacks against Stern as a double murderer who killed Anna Nicole and her son “for his own financial gain,” “kidnapped” her baby, Dannielynn, “with the intent to ransom her to Larry Birkhead,” and blasted him as a crook, pimp, enabler and worse.
In the lawsuit rewrite, filed against JOQ in federal court in Florida, attorney Lin Wood says “Texas” has used the same take no prisoners tactics he’s used to win billion dollar settlements from corporate evil-doers like Big Tobacco. Only this time, the complaint says, he’s using the JOQ elephant gun against one man, Stern, and it’s loaded with lies.
Why? As executor of Smith’s estate, Stern stands in the way of his client’s access (VA) to a baby her estranged daughter banned her from seeing, and control of a possible half billion dollar inheritance if the Marshall estate ever settles.
If Stern goes down, or goes to jail, legal experts tell me, the defamation suit against JOQ goes away, and maybe even the Cosby libel suit, too. So there’s alot riding on bringing Stern and others down, whether it means a railroading, or a public lynching, facts be damned, get him at all costs. That’s what the lawsuit suggests is happening.
According to the complaint, JOQ and his firm “drew upon (his) many years of waging corporate campaigns to conduct…a campaign against an individual—Stern. As one of a thousand cuts,” JOQ and his law firm “made these indefensible false statements in a calculated effort to smear the reputation of Stern to benefit themselves and Virgie Arthur in ongoing court proceedings and in the eyes of the public.”
It didn’t matter, says the suit, that after Smith’s death from a combo of prescription drugs in February at the Hardrock Hotel in Florida, Seminole police chief Charles Tiger said it was not murder, that he was “convinced based on extensive review of the evidence that this case is an accidental overdose with no other criminal element present.”
Regardless, the suit says, JOQ pressed on for Virgie fighting to bury Anna Nicole in Texas, against her wishes, and lost, then got hit with a $3,000 court fine for a frivolous challenge to stop the funeral in the Bahamas.
According to Stern’s complaint, JOQ went on to “smear” Stern on talk shows, in “at least a dozen interviews to the print and broadcast media” and fielded over 50 media requests on Arthur’s behalf,” says the complaint.
“O’Quinn’s strategy,” says the complaint, “was to injure Stern’s reputation in the public arena so that defendants (JOQ and his firm) and Arthur could gain a competitive advantage” in court and the media frenzy surrounding Ms. Smith’s death, paternity and custody of Ms. Smith’s daughter, and/or control of the estate of Ms. Smith.”
A key element in The Plan to “intentionally slander Stern”—how to cook Rita Cosby’s book in progress with input from JOQ investigators and Virgie suspicions. In fact, before she lost her MSNBC show, Cosby gave Arthur quite a platform to make her case against HKS as a double murderer, though at one point she did remind Virgie no charges had been filed.
After Cosby launched the book project, the complaint says she used at least one JOQ investigator as a key source for “false accusations about Stern” that were later published in Blonde Ambition—all part of the plan to “publically discredit Stern and permanently injure his reputation.”
On her show, for example, Cosby also gave JOQ airtime to launch the bogus trial balloon that Stern had requested that a copy of Anna Nicole’s will be faxed from LA. “Why did he need to read the will unless he knew she was going to die?” sneared JOQ on the air.
Such tidbits were raining down like bomblets for months, even after Stern lawyer Krista Barth explained the time stamp on the LA fax machine was wrong and the will charge never happened.
Despite publically available evidence that would refute numerous “cuts,” the complaint says, the anti-Stern spin machine marched on, and on, and on.

Anyone in their right mind knew O’Quinn was behind Rita’s book. I’m sure O’Quinn gave her money for travel and expensives not to mention cash under the table. He set her up with the publisher. But this time O’Quinn will be caught in his dirty works, Lin Wood will be his match. Howard will not let loose like others have when O’Quinn has gone after them. O’Quinn thought he could bully his way around and get away with it, NOT THIS TIME. In the end he will be loose his licence.

HKS made a huge mistake when he became involved with ANS. She was a very unstable woman and created chaos all around her. Unfortunately, Howard has been spinning in her mess since she died. As far as VA and OQ are concerned, they are nothing better than hate mongers and liars. They will do ANYTHING to win and don’t care who they ruin. I have no vested interest in HKS but truth should mean a lot and the hate mongers should be shown for what they are – evil people with NO regard for anything but what they want.
HKS and the baby end up being the damaged parties in all of this.

Hi Art. IMO, it has been abundantly clear to me from the get go that O’Quinn, Virgie, Clark, Cosby, Opri through Speer(s) IMO), and others, have engaged in exactly what this amended complaint states! I remember JOQ’s interviews and was so shocked by his statements that I immediately reported him to the Texas Bar through their website! I felt then and still feel that his comments were unprofessional and against the cannons and Texas Creed. We in society cannot allow the media to be the conduit in which someone sets out on a pattern of behavior that seeks to destroy a human being just because it is advantageous for them to do so. These people need to be held accountable for their blatant disregard for the truth and reckless disregard for the rights of Howard. NO ONE should ever be treated the way this man has been treated by the media, O’Quinn, and others! In addition, I have noticed, over and over again, that these people have also set out to discredit any professionals who have been involved with Anna’s investigation in Florida. It is my opinion, that these people will stop at nothing to get their truth accepted and will use any means of doing so! SOMEONE needs to stop these people in their tracks! Stay strong Howard…Truth will prevail!

This Texas bunch are dispicable!! I can’t even think of words bad enough for them. It’s about time they get shown for what they are. I think we’ve all pretty much figured that O’Quinn and Virgie were after the big Marshall money and they have to destroy Howard in order to get him out of the way. I figured it must be possible to get it, or O’Quinn wouldn’t be spending all this time and money on Virgie.
It seems as though, the more money some people have, the more they want. They are bottomless pits.

Well ladies, (and gentlemen) it would appear that none of us were so crazy after all! We were all so outraged at what we saw happening with the media regarding these events as they unfolded that we couldn’t stand it! While Art’s site has given us the most accurate and up to date news, there were a couple of “live” sites that coalesed around this topic and, except for the inevitable trolls that popped in from time to time, we used to just go OFF everytime Rita or Greta or Nancy Grace, among others, would cheerlead VA and OQuinn’s lies and slander and fake “witnesses” and the like over and over and over!
OMG, I remember the first time I was on one of the sites and Greta was on her show just trashing the hell out of HKS and I wrote, “I hope someone that can do something is getting every word of everything these people are saying and doing down on tape,” and someone else wrote, “don’t worry, it’s being done.” The worst part was the people on some other sites that bought into every nasty evil rumor that was spread. A real mob mentality was being cultivated. I guess those were the kinds of people OQuinn was counting on. Talk about a high tech lynching!
When we found out Lin Wood had been hired we were jumping up and down!
But the arrogance of those members of the media, who were just repeating every evil nasty thing that people like Jackie Hatten and Don Clark and that fake PI that said he knew Daniel said, was just so revealing. I mean, THEY JUST INTERVIEWED ANYONE WHO SAID ANYTHING JUICY LIKE IT WAS THE ABSOLUTE TRUTH AND NEVER QUESTIONED ANYONES MOTIVATIONS IN MAKING THESE SERIOUS ACCUSATIONS!!! (Obviously, I was quite outraged about that…but it was such a relief to find other people who also saw past the hype.) It really showed how shallow and lazy and snide and holier than thou most of these media people really are(and I had actually respected a couple of those media clowns before this- now I question everything they say, which is probably very healthy, actually) How they go for the cheap thrills!
I always believe that there is a larger purpose to every bad thing that we cannot totally understand. I think that many larger purposes are being served here. One big larger purpose has been the unmasking of so many members of the media, law enforcement, the judicary, you name it…to those with eyes that can see it.

There are two comments made by Sustern and Grace one in the first interview where Sustern claims that Oquinns remarks about murder are on a different level, and Graces remarks questioning why Stern might be prosecuted for many charges against him?
Both Grace and Sustern after hearing it from Oquinns mouth were surprised and taken off balance,one of them speculated that because Anna had not spoken to her mother for many many years how could that Virgie even speculate, what went on between them when they were alone, Grace and Sustern had to choose their words carefully, they were very measured when they spoke, which amounted to the statements in the affadavit which could be a very good thing for Howard.Aren’t yall supposed to be innocent till proven guilty instead of the other way around?

(and I realize you do know this, lol) I really believe they were motivated by $$$ (via ratings, via sensationalism) because Greta, for example, is a fairly sharp trial lawyer; and I don’t believe she “bought” everything those unethical people have said at face value…. However, there’s a chance that all those “learned” professionals believed in their own “psychoanalysis” and once they recruited all those who were eager for vendettas/motives/ trying to make bucks/15 minute fame, they forgot about logic, ethics, and professionalism….. and things spiraled out of control… and since so many “learned” folks were in agreement, vilifying HKS, without basis in fact, they started to assume them as facts.
It has been absolutely shocking to observe how they (the talk show hosts) were milking on and on with the same hearsays and conjectures, without stepping back and self-checking themselves!!! Either they are not as bright as they think they are or they are in reality very unscrupulous people (of course, some must be both) who wants their high paying jobs at all cost. I believe they could have gotten high ratings just the same WITH BALANCED VIEW (you can treat “balanced” with the same hyper, urgent, sensationalistic tone — that would no doubt attract a ton of ads for ED or other patented slow-killers), but they apparently believed otherwise…. Everything and every area in this country have gone deep south for the past several years — and the media (and control of the media – although abated a little recently, don’t know for how long it’ll last)

Good job, Art. Let those nasty vultures keep coming. I still say they’re not going to win. More and more people see through them than ever before. They underestimated Howard with Anna still by his side. She is still by his side in spirit motivating him to keep fighting and beat their ass. It’s so awful what they’ve done to him, but he can’t look back right now or he will lose sight of where he’s going.

If John O’Quinn thinks he can discredit Howard and take over the Marshall estate he sure does have to have a lot of things go his way. Ron Rale is named executor if Howard can’t be. Even if they discredited Howard and Ron Rale wouldn’t it be Larry’s place to appoint a new attorney to represent Dannielynnn in the Marshall case? So in order for O’Quinn to take over the Marshall case he has to discredit Howard and Ron Rale and Virgie would have to have custody of Dannielynn so she could appoint John O’Quinn to represent Dannielynn in the Marshall case. It seems to me to be a long shot that O’Quinn could accomplish all of this. But I guess O’Quinn is just arrogant enough to think he could pull it off. We know he was arrogant enough to think he could say anything he wanted to about Howard in the media and get away with it. If O’Quinn thinks Howard will get tired and quit fighting he better think again. Since ANS is gone and Howard can’t work as an attorney then Howard can spend all of his time fighting all these charges against him. Howard has been relentless in his pursuit of the Marshall case for ANS. Why would anyone think he would be any less determined to clear his name and to defend the picture that has been painted of ANS? I wouldn’t put it past O’Quinn to have either told Rita or had one of his representatives tell her that she was legally safe where her book was concerned. Why should O’Quinn care if Rita is sued and loses? Is the money to pay Howard going to come out of O’Quinn’s pocket? Is O’Quinn’s law office going to lose business if Rita loses? It also wouldn’t surprise me if soemone representing O’Quinn’s law office told Rita to go to the Bahamas and try to talk to the nannnies.

What has voting or not voting got to do with Howard’s prediciment. Virgie, O’Quinn, Rita, Hatten and the whole bunch look like slime balls. What has been done to Howard is just about the worst thing I have ever seen. Granted, Richard Jewel suffered terribly, but no one has ever been as viciously lied about as Howard. Greta, Nancy Grace, Jaimie Floyd, Katherine Crier and the group at Court TV set out on a mission to try and destroy this man and were almost triumphant. They knew O’Quinn was a drunken liar. That Shelly and Thompson were thieves and liars. The only good thing, what goes around comes around and someday, Greta, Nancy, Geraldo, Guilfoyle and the loudmouths at Court TV will all get theirs. This is not an ‘official’ or ‘political’ election…yet…well, just read the meaning of the ‘word.’
It’s all about opinions…not fact.
Since we don’t know the facts, do we?
Well maybe you do, maybe you know, but I don’t.
I’m really just watching and reading and trying to ‘figure’ it all out…because what I watched on TV was just spin, spin, spin.

In my opinion, derogatory lawyer jokes sprung up as a result of someone having had nightmarish experiences with the likes of John O’Quinn. May O’Quinn’s ignorant nastiness land him before all those whose cases he has mishandled and may he be forced to answer under oath questions posed by those whose lives he had destroyed.
May O’Quinn lose all those stupid, ugly cars he has undeservingly acquired.

i agree with#41,all lawyers to represent the law —–innocent untill proven guilty!!!!!!! not this bounch they are for guilty untill provrn innocent toooooo bad they are procted by some law that gives them protection from being sued. they should not be able to treat their program as a court room !.with people like that who needs a courtroom or a judge and jury?????

I will be so glad when all of these incorrigibles are exposed for the worms they are. I have never seen such a despicable group of people. Good grief, no wonder Howard and Anna felt it was them against the world.
This is nothing about justice and peace for Daniel or Anna. This is about money and revenge that Howard dared fight back.
Virgie sees the autopsy photos of her grandson and then comes out of Court grinning from ear to ear??? This woman acts like she is possessed.

NY is not a bad place…all that concrete and steel was ‘made’ by men supporting their families and making a living.
Subways and trains are a whole lot more economical than cars or planes…
Pollution…and pollination…and plastic.
I don’t like big cities…yet, I love big families…
