Bald Truth Exclusive: Stern Libel Suit Win! Federal Judge OKs Expedited Discovery Request; Order Says He’s “Troubled” By Rita Cosby Actions
Larry King Live Airs Nanny Denial Cited in Judge’s Ruling

In a world wide web exclusive, The Bald Truth has learned a New York federal judge Tuesday granted Howard K. Stern’s request for expedited discovery in his $60 million libel suit against author Rita Cosby, who wrote he engaged in a gay tryst on tape with Larry Birklhead.
In his motion, obtained first (and posted below) by artharris.com and reported exclusively by ETonline, U.S. District Judge D. J. Chin writes that he ruled for Anna Nicole Smith’s executor after reviewing “substantial” and “troubling” evidence showing Cosby apparently tried to “improperly influence witnesses,” when she flew to the Bahamas and offered to pay two former Anna Nicole Smith nannies she’d never interviewed for the book to back gay sex charges in her bestseller, Blonde Ambition.
In the book, Cosby writes the nannies saw the late Playboy centerfold watching Stern and Larry Birkhead cavorting on a gay sex tape. Both have denied they are gay and ever had sex. No tape has yet to surface.
“Because Stern has presented substantial—indeed , troubling—evidence that Cosby has sought to improperly influence witnesses, the application is granted,” writes Judge Chin, siding with arguments made by Stern’s pitbull attorney, Lin Wood, and perhaps signaling legal hurdles ahead in his courtroom for Cosby and her publisher, Hachette.
“The order speaks for itself,” Wood told us in an exclusive interview, and that’s all he would say.
But the ex-MSNBCer has denied any wrongdoing, and her publisher stands by the reporting in her book. In motions to the court, her attorney, Elizabeth McNamara says a different picture will emerge when all the facts are presented.
The dramatic 20-page ruling appears to be a small, if significant, early victory for Stern in the early stages of the suit; Judge Chin says he’s reviewed transcripts of audiotapes secretly made of Cosby offering the nannies’ lawyer money for an affidavit, and interviews with representatives for the nannies who appeared on Larry King Live, Greta Van Susteren’s Fox talk show and other information filed by both sides.
Meanwhile, the judge cites damaging moments of Cosby caught on audiotape that aired on the show, Larry King Live, and Fox’s On The Record, with Greta Van Susteren October 12, 2007 “purporting to be a conversation between Cosby and Lincoln Bain,” the nannies PR man.
“The transcript,” writes the judge, “shows Cosby talking to Bain about a payment of $3,000 or $3,000 an hour that would ostensibly be to pay the nannies attorney for drafting an affadavit, with the understanding that “she (the attorney) can do whatever she wants with the money once I give it to her.’”
The order cites Cosby’s “reluctance to pay more.” Chin quotes from Cosby on Bain’s audiotape:
“I cannot do much more because then it would look outrageous,” she says. “You know what I mean? Because the problem is now that I’m dealing with the court thing, yo have to understand, my thought’s it’s going to come back.”
“This doesn’t mean that down the road I can’t do more,” the judge quotes Cosby as saying. “You know what I mean?”
According to the court document, television talk show transcripts show why Cosby wanted an invoice from Elizabeth Thompson, the nannies’ attorney, who has denied the two Haitian immigrants ever discussed or witnessed a videotape showing the gay sex detailed in the book. Cosby claims she got the information from a private investigator who working on the case, who claims he or she got it from the Nannies.
In an exclusive interview with The Bald Truth Thompson said she met with her clients and two private investigators for a Texas lawyer working for Anna Nicole Smith’s mother. But she denies they discussed the purported gay tryst with former FBI agent turned private eye Don Clark and a sidekick, Wilma Vicedome, a freelance investigator from Houston. Clark has said otherwise in an interview with Geraldo Rivera on FOX, where Clark also works as a news consultant.
“They played good cop, bad cop,” said Thompson, who also tells me she was wary when she spied briefcases left by the investigators in the meeting room when they left for lunch. “We didn’t know if we were being recorded, so we passsed notes back and forth over lunch.”
In the transcript, cited by the federal judge, Cosby says:
“If I can get her (the attorney), if she gives me a bill saying, you iknow, that it’s for consultation, investigation, however you phrase it, consultation, investigation, preparation, execution of the affadavit, for the nannies relating to, you know, whatever, the sex tape, or however we want to phrase it, you know, or this affadavit that that way. And then she can send copies of the affadavit. Then I wouldn’t you know, I don’t see that taking up alot of her time or alot of the nannies time.”
In effect, Judge Chin’s motion orders that depositions be taken as fast as possible to preserve evidence and prevent any possible witness tampering by either party in the future.
“Stern’s application for expedited discovery is granted to the extent that expedited discovery is hereby allowed on the issue of whether Cosby attempted to interfere withy potential witnesses and the extent and nature of those alleged efforts,” writes Judge Chin.

Thank you Judge Chin, thank you for your great wisdom and intelligence, and integrity, to see through the crimes of this media reality gossip engine, to destroy innocent people, that this supposed award winning Loser journalist has been allowed to do without checking into her facts.
The worst thing was, all the pretend people that she interviewed, and the pretend video that Crosby swore existed on countless news shows, than she swore it was all true over and over again…the only thing she gave this story was momentum so it could not end.

U.S. Attorneys move very slowly, but I can assure you the judge does not like that Rita was messing with his courtroom. Bribing witnesses is despicable, and I have no doubt the judge has forwarded this to the authorities. The publisher and the insurance company of the publisher must be crazed by now. The insurance company can dump the publisher for criminal acts and gross negligence if the policy is properly written. I heard Rita say on numerous interviews that the book was properly vetted by the attorneys for the publisher, not that those with a brain believed a word she said.
So the marshalls are coming Rita. They like to show up aroud six in the morning when you are in your jammies and your teeth are soaking.

I think your right when you say team Texas will come up with something else, as long as they see dollar signs they won’t give up. Hopefully they will have to pay Howards lawyer bills someday.
It is absolutly amazing how many twists and turns this case has taken. The vultures that were always suing Anna have gotten even more hungry and are multiplying like rabbits.
Lets just hope this gets through the courts quickly and Rita will pay big time, and then with any luck she will have to face the criminal court.

I am so happy for Howard that the judge ruled in his favor regarding the expidited discovery. I want Howard to know that I have been a loyal supportor of his from the beginning, and have never wavered. RC and her friends got caught up in destroying Howard that it is coming back to their door steps. I just watched Fox News and GVS thinks Rita is in big trouble. I was surprised GVS said that, since they have gone out of their way to support Rita. RC did not respect the people in the Bahamas. She thought she could fly to the Bahamas and payoff witnesses and no one would be the wiser. She could get her affadavit from the nannies, and no one would know the time she acquired it.

Please don’t stop moderating this site. I know it takes time and that we have to wait a while to see our comments. I have been to several other sites that aren’t monitored and most of the bloggers spend their time waging cruel and nasty personal attacks at other bloggers. If a blogger raises “what if” type questions to promote intelligent discussions the blogger is attacked by someone assuming they know what the other blogger thinks. Again, thanks to all of you who are supporters of Howard and Larry. These two people who could never have predicted in anyway the misery that has befallen their homes, families and themselves.
It is true that they are both very differnt, I have spent time with them both and like them both. Howard is my client and my position with him and my thoughts are very well documented and I still stand by him. Larry and I have a great relationship and I trust him, again he is different than Howard, in good way also.
In saying that I am curious why no one at this point has questioned the issue of Foreign Nationals going into the country of the Bahamas and conducting investigations without the proper authority? Mr. Controversey? This whole plan I beleive was to try and turn the people and the legal system of the Bahamas against Howard and thank god it backfired!
I have to tell you something, I am very comfortable with the legal system in the Bahamas. I also predict that they will be on guard for any more shenanigans by ‘Team Stupid’ and would be ‘writer’and her ‘Team Silly’. They are all done!It has been shared with me that ‘Team Stupid’ and ‘Team Silly’ should not be surpised to see picketers expressing their discuss with all of them! Thanks Sandra for that tip!
Now her in California we still have Jerry Brown, Attorney General. Many years have passed since I was a police office, however, in saying that, does it make any difference that the tape that was given to him by Mr.Barresi maybe one of the tapes STOLEN from Anna’s houes or a copy? Also does the ‘fruit of the poison tree doctrine’ have any significance here? I am not 100% clear on this, however, I am positive it will come into the picture, and fast!
Also all of those involved, FS, PB, and anyone else connected directly or indirectley in getting this tape to the AG will all be brought into court. I am now talking about the Dr. Kris and Dr.Kapor’s case. None of this will be fun for any of these participants.
Also, back to the assitant of Good O’l Don, Wilma, what exsposure does she have in all of this. There is reference given that ‘an investigator’ gave info to someone. Now if we are talking about Wilma as an investigator, she is as much of an investigator as ‘Elmer Fudd’ was a hunter. Good O’l Don says it wasn’t me so who was it! Having been doing research on Wilma, she does not have a license that I could find or some pals of mine in Texas…….so under whose license did she function and how did she get involved? I know all of these answers, however this is food for thought for all of you future sleuths out there.
And again the tips and the reports I have recieved on all of these people have been very helpful! Please dont stop contacting me, all of this is helpful. And for all the great people in the Bahamas who are keeping the lines open I thank you too! Maybe someone can get Mr. Bains to speak to some of these questions I have asked as to how did these people try to hoodwink the Bahamian Government by coming onto their soil and investigating and did they have the permits and authority to do that? As we all know Mr. Bains was a breath of fresh air when he nabbed Rita and ‘Team Silly’!

JJN…as usual I do enjoy to hearing your thoughts. You give us just little hints to what is next. Wonderful indeed it will be to see everyone fall one by one. What they have done to this innocent man is beyond comprehension and the human being. You are correct, the Bahamian people are very sweet and loving. It is a most beautiful country and I will continue to go there always. They love their tourists and treat them respectfully. A little slow, but hey that’s okay, when I am on vacation I want to take it slow, so that is fine by me. They are not in the fast lane like we are here in the states, they take it slow and easy. That’s a good thing in my book. JJN, you just keep doing what you do best.
There are two very anti HKS sites. One is on this site and wish it would go but Art choses to show all sides and that’s okay. They have two petitions to boycott the Bahamas. I totally disagree with doing that and we should ALL let the Bahamians know that it is just a small portion of what everyone believes. My thought is, they couldn’t afford to go there anyway so they boycott it, or have never been. I would enjoy seeing picketing signs at the next hearing. They need to send these horrible folks back home.
I also agree with some, that name calling and talking about weight has nothing to do with being who you are. It is what’s inside, hate, greed, and dishonesty that makes one evil.

Yes my mom was on the heavy side and that did not mean she was a bad person.IMO wight should not be an issue.I think that some people just don’t know how to express their discust with her and use the weight to express their anger.

You know dont get too upset over the weight issue, VA is just short for hers, hell if she was 8ft 6inches she would be just fine! I had a sister who was big enough to eat hay at one time, I too have to be careful, as an X copper I still shed a tear when I pass a donut shop!
Again, Art’s sight and RoseSpeaks are well read sights and for the most the readers are very supportive of Howard and his team! Why would they not be who wants to be on a team of loosers and liars, NO ONE!

On the subject of Just My Opinion: It is said that those with a rich vocabulary do not resort to name calling. I believe that those possessing a bottomless well of words merely use different words to arrive at the same destination, thus creating the same ill will. While others with a more limited vocabulary well, when in private and pissed off will resort to whatever suits the occasion. Words are meant to hurt those who hurt us — definitely not a good idea. Challenging others to a duel is dangerous to the sword, not to mention the recipient. The only solution is to live in Utopia. I am all for that and waiting for my ship to come in. What is taking it so long?

Hmm: You made a good point there about thinking that some people can’t express their disgust about Virgie so they go for the weight thing.
I can’t even think of words that really describe her. Greedy is one, but that’s only the tip of the Virgie iceberg. I don’t think any exist. Maybe we should make up some and get them into the dictionary. I’ve never seen the likes of her in all my years on this earth.

Larry Sue: What’s so obvious is that most of us can see and hear beyond all the TV tabloid jokers that have been spinning anything they can get their dirty hands on, just to boost their ratings.
