Bald Truth Exclusive: Rita Cosby Shoots Back! Howard K. Stern Wants “Speedy” Discovery: Read Libel Suit Court Motions First Here!

In another world wide web exclusive, The Bald Truth has obtained the first round of fiery motions in the $60 million libel suit suit Howard K. Stern filed against author Rita Cosby and her publisher over salacious gay sex charges in her book about Anna Nicole Smith, “Blonde Ambition.”
Stern has accused Cosby of trying to “influence the testimony of two witnesses in this case,” nannies who worked for the late Playboy centerfold, and cites his fears other witnesses may be tampered with unless depositions are taken fast. But the author’s lawyer dismisses the need for speedy discovery.
It’s all in motions filed last week in New York’s U.S. District Court (hot links on next page) and obtained exclusively by The Bald Truth.
In her opposition, respected attorney Elizabeth McNamara argues Stern “fails to articulate good cause for this court to deviate from” standard rules of discovery, thus no need for speed.
But Stern’s aggressive lawyer, Lin Wood, in a motion filed Friday, insists audiotapes made of Cosby discussing payments to the nannies offer “good cause for … limited expedited discovery” of her “attempts to interfere with potential witnesses” in the libel case.
Wood cites the audiotape transcripts secretly made of Cosby discussing payment as proof something was rotten in Nassau, and that the tapes show “Cosby offered to pay two critical fact witnesses” for an affadavit in support of her reporting that never did include interviews with them earlier.

“With such clear intent, the question then becomes to what extent did Cosby attempt to influence other fact witnesses, and…attempted to illegally shape or stymie discovery of the truth,” writes Wood in his reply to support asap discovery.
“Cosby’s actions have potentially compromised both the integrity of the judicial process…and Stern’s right to a fair trial.”
Wood is asking that Stern “may immediately depose Cosby on the limited topic of her attempts to influence” the nannies, but reserve the right to question her further on other aspects of the case later.
But McNamara says speeding up the process would not just create a “sideshow,” but be costly and, with witnesses in different countries, slow down the six month schedule the judge has laid down as a timetable for all discovery to be completed.
Beyond that, she attaches transcripts of audiotapes Cosby made of the nannies’ PR man, Lincoln Bain, who released damning tapes of the ex-MSNBCer apparently attempting to pay the nannies for an affadavit.
But in dueling tapes counterattack, McNamara attaches an exhibit featuring phone conversations Cosby says she secretly taped with Bain later, and claims he confirms the nanny gay tryst allegations the women insist they never made. The Cosby tapes were aired on FOX News on October 15; she insists the PR man contradicts himself and should not be trusted.
But Bain has questioned why her tapes appeared on FOX News Oct. 15, weeks after he released his, implying she had plenty of time to alter them.
There’s also the implied issue of criminality.
If Stern is charging Cosby attempting to influence potential witnesses and the case is ever investigated by law enforcment authorities in the U.S. or the Bahamas, anything she says, in even limited discovery, could be used against her.
In other words, McNamara appears to be suggesting if speedy discovery is ordered before all the facts are determined, her client might caught in a conundrum of self-incrimination, and be forced to plead the 5th under questioning by Wood, if it ever gets that far.
The publisher also files a brief in support of Cosby.

She did try to tamper with the witness and she was trying to validate what she wrote after the fact because shefailed miserably as a so called reporter to cross her T’s and dot her I’s. That said, Howard has broken a few laws himself… But having sex with another man is not one of them. That seems to be all Rita’s thinks is important. She needs to butt out and mind her own business and let the authorities handle this mess. They do not need Rita to figure all this out. She is out for the money, just as Howard is. I wish Larry would tell the Marshalls to forget about it. It is not worth it. IF Larry told the Marshalls to forget everything, everyone would go away. There would not be a reason to keep this boat afloat.

Rita was caught red handed. L. Lin Wood should win this round, however, it has been my experience that may not be the case. It seems to me that EVIL, LYING people who was caught red-handed breaking the law usuallly seem to side step the law and win over what is really legal and right - but with Lin Wood on this so I feel a lot more confident. So many bad thing have happened to Howard and it’s way passed time that things start going in his favor. He should win every case he has going at present against them all - then take Shelly and Thompson down where they belong - especially Shelly. Good luck Wood and Stern! I hope you have Rita scared to death - hope she can’t sleep, eat or even think about what evil deeds she could still do (and probably was planning to do)to hurt Howard even more than he has already been hurt. Just how stupid is Rita anyway? Anyone would know better than to do the things she has done but then again all of them have gotten away with some of the dirtiest deeds I have ever witnessed. I want to see them fall - one by one and quickly.

I’ll assume you are not a lawyer.
This suggests, since you are a competemt journalist, you
sought the opinions of attorneys you know to parse the pleadings and decisions of this case.
It would be natural for you to seek out like minded people
that share your philosophies and biases…..
You have from the very beginning of your comments, in my opinion, shown a proclivity to favor anyone who isn’t
Rita Cosby.
I would think it is not too far a leap to say that you are guilty of that which you accuse her: Influencing not witnesses; but worse, a possible jury pool.
Why not come out with the bald truth and explain why you are supporting an individual, who by a video tape (asking for another pill for Ms. Smith} is shown,
at the very least, to be one of the authors of this tragedy! Which by the way, is not money; but, the wellfare of a one year old baby.
I am not saying Ms. Cosby is right or wrong, I have not made up MY mind; but, I wll not be influenced by slanted journalism, whoever the source.

hi art, look i hope howard wins this one. he has proven that rita with her own words, would pay the nannies for this statements by going thru a third party. the intouch magazine. she even stated she would lie under oath. l. wood needs to keep the pressure on rita. the publisher should try and settle out of court because they know she has lied and wrote a book of pure fiction.
i’m also want people to leave howard alone. i saw that so called videotape and i didn’t think she was drugs. i too believe it was edited. how can fox and ford shell show videos that were stolen from the house that now belongs to the estate.

It was my intention to just say thanks Art. Then, I got caught up in the moment…
Rita and all the âLegal Analystâ on television certainly did underestimate Howard K. Stern when they were so sure that he would not sue. The realization that they severely misjudged him surely is giving all of them second thoughts about invoking the â13th Jurorâ technique. That is, except for Geraldo. We can only hope that someday heâll mature and realize that âhe is not the message.â.
Rita was foolish enough to use the âtwo months warningâ period to mean that she had two months to âpromoteâ her salacious book and party, rather than prepare for court.
The very notion that she wants Howard to produce discovery first is laughable in more ways than one. She has become aware that indeed Howard is the gentleman that is portrayed for all to see, and gentlemen always say âladies firstâ. Lol
Lets see where we are nowâŠ.Mistake no.1 Writing such a defamatory book of lies. No.2 Using sources that are much less than reliable. No3. Not checking the reliability of the sources or their âfactsâ
No 4. Attempting to bribe a witness. Totally violating the code of ethics of journalism.
Art, you must be right, weâre down to the 5th, or else âno contestâ.
Indeed the âconsideration of the administration of justice outweighs the prejudice to the responding partyâ.
Last but not least, Howard never perjured himself by saying âIâm the biological fatherâ. With so many idiots coming forward to get their âface timeâ on tv, and one in particular that did not, why would Howard want to step forward for a dna test , just to save those idiots the embarrassment from their need for attention It was theirs to prove, which Larry did. Howard was a gentleman and stepped back.
Canât wait for the eventuality that Rita’s witness who says that Howard destroyed evidence is on the stand. We know who that is. As far as âintimidating a witnessâ, is she referring to Moe? Iâm not an apologist for Moe, but when someone you love and are close to dies, you go through those stages of grieving, would of, could of, should of. No matter how blameless a person might be, you always beat yourself up because you didnât in some way keep that person from dying. Thus, his statement âweâre all to blameâ. Iâve been there myself. However, thereâs no excuse for him trying to peddle Annaâs photos.

I just wanted to let everyone know that EJ has just called me and said that her husband’s condition is still the same, critical. He has been on a ventilator. I wrote down all the names of you, who have wished EJ and her husband well, and told her, and she asked that you all continue to pray.
I’ve never met EJ myself, but we have very recently been communicating by email and phone and she is a very nice lady and I feel so badly for her and her husband and family. So please, keep praying and thank you so much.
Art, thank you so much for letting me post these off topic messages here. You are a gem.
EJ is a very big Howard supporter and hasn’t forgotten about him through this ordeal.

Note: no real friends of anyone would ever behave that badly about them or their chosen group of friends they would keep things private the ways things should of been kept that is the reason for Anna divorcing all those losers in the first place.

Hey I am back, one of my associates asked me if I thought it was a good idea to be so verbal on Art’s website? On some issues we are very closed mouthed and cautious as to what we say, this case is the exception! Why you ask? I want to tell you, Myself and my team, we are all about telling the truth! The lies are so outrageous that the only way to keep the cancer at bay is to be vocal! Never once in 16 years have we ever handled a case this way, never. This case is so vicious and full of hatred and greed that it is in fact very dangerous. There will never be any winners here! Vindication perhaps, but winners, no way!
And the feedback from the ‘otherside’ is off the chart, that too never happens in most cases, yes readers the darkside is contacting us on the QT and that too is very interesting. (all I can think of is the rat scenario I mentioned, you know put a bunch of rats in a cage and watch them bite and piss on each other and that is what is happening to the accusers ) I also mentioned the ’snitch’ syndrome, am I right Don? Wilma??, well maybe not Don as this is something that street cops deal with and the assistant is more of the gopher thing, you know get me this get me that! LOL

Hey Art, I was wondering is some of your readers in far away places might know if any of these people( from the US) working in the Bahamas ever had work visa? Hmmm? I was wondering if they are needed when private investigators go and investigate in the Bahamas? Or if someone is doing research( wink wink ) is that the same? I know for a fact that when I visit places I always go as a vistitor and would never violate the laws of another country. There are some very talented P.I.’s in the Bahamas and if I was them I would be plenty upset that my beak did not get a little wet with all of these visitors pussy footing around and all getting paid big bucks! I was sitting on my throne and thought of good OLD Jack Elmer Harding! Sitting on the throne is the best place to think of the players in this ‘Fairy Tale’! This is how Jack’s card got into Daniels pocket and you are hearing it here folks for the first time. I spoke to Ray Martino and he is as truthful as they come, no splitting hairs with Ray! Ray told me that he did in fact introduce Daniel one day to Jack at a local coffee shop and it was as brief as ‘Hello and Good Bye’, in that short meeting a card was given to Daniel…….END OF STORY! People! how many times do we give cards out and never know were they will end up? Hundreds of time every year, some do it automatically, I dont as I never seem to have one with me and at this point in my life I dont care if anyone calls anymore! Interrupts my movie time!
Daniel never called this guy and Jack never caught me climbing his fence! Hey it is written in the ‘Fairy Tale’, Jack caught me trying to climb a fence, a fence that all I had to do was slide it to the right, yes folks it was one those fences that you pull to the right and it slides on rollers! But Jack! he sees me climbing it! Funny thing is that I was not alone that night and I never climbed that fence!

However for many the opportunity to be important, be connected and have some ‘juice’ is a goal that many in this racket never get to be and then BAM! A wonderful youngman’s life is cut short and a card of some ‘neverbeen’ is found in his possesions! Has Britney Found Her Howard K. Stern?
Is the stage being set for a new version of Anna Nicole Smithâs life and death? Insiders fear that Britney Spears â already described by her family court judge as a drug addict â is busy putting into place her own iteration of the Smith nightmare. Sheâs even cast Howard K. Stern and Virgie Arthur.
Indeed, Stern, they say, is being played by Sam Lutfi, aka (real name) Osamah Lutfi â and Virgie Arthurâs role â the part of the grieving mom â goes to Lynne Spears.
The story goes like this: very quickly Lutfi, who has little prior experience doing much of anything (see Tuesday’s column), has taken over Spearsâ life. Like Stern, heâs filled a void as Spearsâ svengali, confidant and toady. The only difference is that Lutfi doesnât have a legal degree and isnât married to Spears. He has no formal binding connection to her yet.

Last week, the first lady of California, Maria Shriver, told her former employers at NBC News that she is not coming back to work at their offices. She cited that the coverage of Anna Nicole Smith’s death in February as her reason for not returning. Shriver took an extened leave of absence when her husband, Arnold Schwarzenegger, began running for governor of California in 2003. After he won the election, Shriver did only two appearances for NBC Dateline.

Sounds likke no matter how you look at it Rita and Tom are in real trouble.Her Tape does not really mean much it just sounds like a way to get her down there for the sting.Rita had plenty of time to get an attorney she just hoped like hell she would not get sued.Maybe taken in by the o’quinn team.How could anyone believe Jackie H..IMO there should be fast tracked discovery.No telling how many others have been paid in ways made to seem legal.As Lin Wood said she bought this on herself so she should face up to what she tried to do.

Joni, first and foremost again I’m sending my prayers and well wishes to EJ and her husband. I have them both lifted up in prayer that everything will be okay.
Mr. Nazarian, THANK YOU!! You’ve given we Howard supporters bragging rights to go back on the boards and yell “I told you so!” about Jack Harding. First of all his story made NO sense, why would the Royal Bahamian Police execute a swat like raid for the sole purposes of speaking to someone who’s card was found? Then there was the fact that his story kept growing in leaps and bounds everytime he told it. With each appearance the story got wilder and wilder with the final performance being him FORGETTING Howard’s name in that Nancy Grace interview. I’ve been asking the idiots who swear he’s telling the God’s honest truth WHY IN THE BLUE HELL isn’t he on the Inquest list if he’s so gosh darned important?

Isabel, don’t pay attention to anything FOX says. They’re just pissed they picked the wrong villian and he’s knocked over every one of their little tricks and lies. It also doesn’t help that he (rightfully so) won’t lower himself to be interviewed on their network, all they have left is snide remarks and spin. Bitterness doesn’t become them!
As for Rita’s response, I’m feeling more and more that they will try to settle before it even gets to court. Now that there is the cloud of possible criminal ramifications hanging over her head that they don’t want being held against her when Lin Wood deposes her me thinks they might think the best thing to do is make this disappear as soon as possible. All the better for Howard, even though I would LOVE to see Lin Wood rip her a new one on the stand.

Stern, especially with regard to his lawsuit against Rita Cosby for $60M. I hope and pray that no connection is made in the end between Howard K. Stern/Mr. Controversy/Lincoln Bain/the nannies/the âstingâ operation against Rita Cosby etc. which would jeopardise his case. It is enlightening to know that you will not be influenced by slanted journalism, since there is so much going around in todayâs world. Perhaps you have actually come to the right web site in visiting âThe Bald Truth”.

I just read the Crosby response material and, once again, I have to ask, if Rita did nothing wrong, why is she so worried about the “hows” or “whys” or “whens” of an invesigation into her conduct? Why is she attempting to control the circumstances of the investigation? Too bad she didn’t pay this much attention to detail when she was actually writing the book. But then, if she had, there would be no unfounded and salicious claims upon which to actually base the book. Giving her more time will ultimately just give her - and this is key - her trusted “sources” - just that much more rope to hang her with anyway.

Johmn N I always wondered why people believed harding when at first he said daniel wanted someone to be looked at then after talking to am investigator for o’quinn it suddenly was changed to HKS and other words he used from the media.It was really funny when Harding said you were crawling over his fence. one more way the media was used to propagate things to someones advantage.Just like the story about surgar pie and how that went around the internet.The other side was using that to make peopel think badly of HKS.I for one am glad you use Art’s page to kind of ley us know what is what from time to time.If I was Howard I would be hard pressed not to jump all over these people who are disrespecting ANS and therby her Son,Daughter and HKS.Keep up the good work

John Nazarian, I lived in Bermuda,most island law is the same I now live in Canada no matter what you do if you are working or planning on working in the islands you need to go to immigration, and request a work permit that could take up to 6 months to get.
You need someone to sponser you for a job say, and you have to prove that you are not taking a job that someone else could do on the island.
It is very subjective and can be annoying the process is very long, and you can be refused.
According to the Bahamas government,
“Necessary work permits for key personnel will be granted. Businesses requiring permits for persons other than key personnel are encouraged to discuss these requests with The Bahamas Investment Authority in advance.”

Funny you mention that famous HaHa~Harding business card. I have been stating from the get go the only real reason that Daniel would have it would be because of his mothers fame and the obvious need for background checks when it came to breaking into the inner circle. I found it truly hard to grasp that Daniel would have an ill word to say about Howard considering that Howard was the ONLY one constent (aside from Martino) in Daniel & Anna’s life.

Art, I’ll be happy to tell EJ that the next time I talk to her. It’s pretty bad and they need all the prayers they can get. I’m not giving up hope and I told her not to. During a procedure, he went into cardiac arrest for awhile. He’s been on a ventilator since.

I have never seen anything like this in my whole life. I have been worried about Howard’s safety all along and still am, but I do feel so much better knowing he has people like you and Lin Wood looking out for him.
Howard does things the way they should be done…privately. He doesn’t believe in airing people’s dirty laundry in public, unlike all the other characters in this story. And by doing so, people then blame him for being a coward. There is not a cowardly bone in his body. He’s a true gentleman and I don’t think these characters have any idea that is how a gentleman handles things. They don’t even have a clue.
It’s almost downright amusing watching these clowns, clawing and tripping over each other to get their hands on the money, any money. I have never seen such greed in all my life.

Speaking for myself, I came to this site because I think for myself and will not be swayed by others. As a seasoned legal secretary (30 years+) I have come across many people in the legal profession. I respect the intelligence of a few of them, while being repulsed by the behavior of others for their coldness, selfishness and greediness. An “esquire” who proudly hangs his plaque for “pro bono work” referred by an AGENCY is the same guy who will sit on the case of someone who came to his office without referral but who cannot afford a high fee. Translation, legal malpractice is OK if he thinks the poor peon is too dumb to know any better, whereas, the client referred by the agency will get the proper attention because it makes him look good and he ends up with another plaque on the wall.
One firm may throw a lavish soiree in his home and invite the upper crust clients, then find a way to bill them for their digested meals. Another attorney will work his fingers to the bones and stay up all night (when necessary) preparing a brief and charge peanuts to poor clients, treat an AIDS client with kindness, all the while struggling to make ends meet, while his partner will chew him out and spit him out for not bringing enough dough to the firm.
All people are the same, some more worthy of respect than others. Those not easily impressed skip the Google.

Well it happened again this evening, one of those ’snitches’ gave me a hint, I was told that the Florida Department of Corrections had a Tasma Rolle, DOB 7/1989 5-2 black w brown eyes ‘knowingly making, issuing worthless check 832.05(2)
(a). Now not knowing how this system works could this be the same person who was watching the body of poor Anna Nicole? That Florida Department of Corrections that is just fancy talk for STATE PRISON!
Does anyone happen to have the date that Ms. Rolle and Mr. Brighthaupt, wed? That had to have been one very happy day!

I know all to well what you are going through having gone through it with my mother not to long ago. She was on a vent. also. I remember all to well her being in ICU and not being able to see her but for 15 minutes every 4 hours and seeing her in that condition was just heartwrenching. My prayers are with you.

I have been trying to find any info for JN that he inquired about the birth date for Tasma. I have found this info but am not sure it is the same person that wrote the check. Tasma Ann Rolle born July 12, 1959, in New Jersey. I am told that this is Tas that is married to Moe in 2006. Tas had a first marriage in Fla on 18 DEC, 1992 and divorced. Tas was suppose to have married Moe in 2006. Maybe one of your readers could check the first marriage with the state of Fla and see if they are the same person because there could be a typo on the BD. I hope that it is the same person that wrote the bad checks. I also read 2 obituary’s of her family and this BD seems to be correct. We know that she was older than Moe who is 38.

Are you aware, Sir ( and I use the term Sir loosely here) that persons with grandiose ideas about oneâs self are deemed to be a danger to themselves and to others. The reason that you seem to think so highly of yourself escapes my mind at the moment. Ahh! I remember now. You havenât given any reason as to why you think that you are of some importance to those of us that participate in the discussions here on Mr Art Harrisâs site or to Mr Harris himself for that matter. You are of no importance to those of us who enjoy reading and discussing the articles and court documents that Mr. Art Harris puts on his website.
At least Mr Art Harris is willing to show enough respect for his readers to assume that they have a fairly intelligent working brain. Most media outlets donât publish the actual court documents. They assume the general public is too ignorant to understand them. They give us their opinion and expect us to accept it. I prefer to see it for myself.
The majority of us here have a least one working brain cell (although your post is prompting me to reconsider my thinking on this).We have multiple sources for our information and entertainment. We can read Mr. Art Harrisâs articles and agree or disagree with them on any points, but we do not disrespect him on his own website. Mr Art Harris is respectful to the people who post on his site. He always conducts himself as a gentleman. Being from the South myself, I appreciate a âtrueâ gentleman.
Mr Harris seems to be unique in his willingness to post the actual court documents. He gives us the opportunity to us read them for ourselves. Most of us donât all have law degrees, quote case law and legal precedents or have access to law libraries. We can most certainly read and comprehend a written legal document when it is printed in black and white in the English language. Even the most simple minded ones among us (myself included in this group) can determine which party the judge has ruled in favor of on a particular motion. We can read and comprehend what each party is requesting of the court.
I have been enjoying Artâs reporting for quite some time. Art asks questions that inspire thought and discussion. He doesnât use his podium to make malicious and damaging statements about people from which the effects will cause irreversible damage to adults and to innocent little babies.
I anxiously await the time when/if Ms Cosby presents us with true, legal documents and real evidence that has not been tampered with to support the claims that she has made in her book, on U.S. national television and radio stations and on Bahamian television. If and when this happens then I will reevaluate my opinion of Ms. Cosbyâs reporting and her behavior before and after the publication of her book. To date, I have not seen the necessary documentation/evidence to support Ms Cosbyâs claims. Until then, I will continue to stand by Mr Art Harrisâs reporting.

EJ: I too offer my condolences to you at this time. I did pray for your husband and visualized you at his hospital bedside, both of you surrounded by God’s light. Since I do not know you or your husband or the situation, I asked that God’s Will be done.
I believe we all have an allotted time on this Earth and we leave this earthly experience to continue in spirit when our work/our lessons/our experiences here are completed and sometimes when it is just too difficult for us to continue and we are allowed to be released from our “contract”. Some die peacefully in their sleep, some by accident, overdose. illness, war, or even by the “m” word -however death occurs, it is just the means/the vehicle to close this earthly experience for a clearer, more pure, true continuation on the other side.
As with Daniel as young as he was, his death occurred in a hospital environment and if he was meant to live - he would have been revived. Same with ANS, if it had been meant, she would have hung on until real help came. It was, sadly, their time to leave this earthly experience to continue on to a place that is very real, but one we just cannot “see” at this time - except on occasion in our dreams.

How are Ms Cosbyâs written and spoken words (words that have reached an international audience) going to affect Dannielynn Hope Marshall Birkhead?
The two men who love Dannielynn the most in the world (her father Larry Birkhead and Howard K Stern who was the father role for her the first 7 months of her life) are the main recipients of Ms Cosbyâs accusations along with the memory of her mother and her brother. They are having to defend themselves in a court of law to protect Dannielynn Hope Marshall Birkhead from being exposed to these accusations. Dannielynn will reach an age where she can read every page of Ms. Cosbyâs book, she can read every transcript from every interview and news report that there is to be read. What is she to believe when she reads these things about her parents, her brother, her motherâs dear friend Howard? If Dannielynn continues to have a relationship with Howard she will love this man. She will question the things that have been said about him. How will she feel when she reads about her grandmother Virgieâs support of Ms Cosbyâs words?
How will Dannielynn feel if Larry and Howard donât fight these accusations?
If these accusations were being made against you the way they are against Larry and Howard and you knew they were false what would you do?
If Dannielynn were your little girl and you knew that these things that were being said about you, her mother, her brother and her motherâs friend werenât true, what would you do to protect Dannielynn?

You have got to be joking! Larry was not married to Anna. He does not have any say on the inheritance matter. An illegitimate child is a child born of unmarried parents.
Howard, the executor, is looking out for Dannielynn. He adores her and her mother and wants the precious baby to be well cared for and that is why Larry is living in Dannielynn’s house. If Anna were still alive, Larry would still be the unknown celebrity photographer. Anna, along with Howard would be raising Dannielynn. Larry would be allowed visitation and he would be responsible for paying child support.
Look around you at the countless children born of unwed parents. Isn’t that their situation? Anna’s death is what has risen people to the throne. It is not by merit.
Bloggers need to put themselves in other people’s shoes in order to be more coherent.

Larry is the guardian of DL and also the estate. Howard is working for Larry now.
As guardian of the DL and her estate, Howard cannot make a move usless approved by Larry. This was a statement by one of Howards attorneys once the courts made that decision.
