Bald Truth Exclusive: Will Nannygate Bite Rita? “No (More) Witness, Evidence Tampering!” Howard K. Stern To Seek “Blonde” Injunction

Lawyers for Howard K. Stern will ask a federal judge Thursday to order author Rita Cosby to stop trying to influence witnesses and “destroying or altering evidence” related to the $60 million libel suit filed against her, according to a motion filed Tuesday in U.S. District Court in New York City.
At the center of the motion for a preliminary injunction lin-wood-motion-10-16-for-pi.pdf, Stern lawyer Lin Wood details Cosby’s alleged attempts to pay off two Haitian nannies who worked for the late Anna Nicole Smith who say she never interviewed them for her book. Cosby has been seeking their cooperation to confirm a gay tryst she writes they witnessed between Stern and Larry Birkhead that the women say never happened.
Both Stern and Birkhead call the charges “ridiculous.”
In the 24 page motion lin-wood-mot-in-supp-of-pi-with-exhibit-a.pdf, Stern accuses Cosby of trying to pay the nannies between $3,000 to $15,000 for a bogus affadavit to back accounts in her book, Blonde Ambition, detailing what the author says she was told by a private investigator.

The motion includes an audiotape transcript of Cosby outlining her plan to Lincoln Bain, the nannies’ PR man who secretly recorded their conversations. On a talk show Tuesday night, one of the nannies said they never gave that account to any private eyes for Virgie Arthur. In perhaps a unique twist to the online era, Lin Wood includes a link to a U-Tube video of Geraldo, who has feasted on the controversy, inviting all-sides to joust on his talk show.
Wood wants a judge to stop Cosby from using the same checkbook tactics she allegedly used with the nannies on any other witnesses, including the Haitian immigrants who are expected to be witnesses in the libel suit. You can read the motions here.
In the show cause order that’s part of the filing lin-wood-10-16-07-order-to-hear-motion-tro.pdf we’ve exclusively obtained, U.S. District Judge Denny Chin has ordered lawyers for Cosby and Stern to appear for a conference in his courtroom Oct. 18 at 11 a.m.
According to the court order, Judge Chin has actually reviewed “the alleged conversation between defendant Rita Cosby” and the nannies’ Bahamas PR man, and how he hears it could play a key role in whether he decides to grant Stern’s motion
In secretly taped conversations, Bain says Cosby can be heard trying to pay the women to say she had spoken to them when she had not, but used a major part of her book to base it on.
Neither Cosby or Stern are expected in court Oct. 18, just the attorneys.

Well one thing I have learned,is when in court,black is not always black and white is not always white.what I think is cut and dry somethings will not work in court,for example—RITA wrote and tell all book,with the main selling point (gay sex between howard and larry)claiming it is on tape.now NO TAPE ,SO YOU WOULD THINK THAT IS THE END.NO WAY.Now we come to he said she said. drives me crazy to think RITA got all this press.

Art Yes I bet her lawyer will be.I listened to a tape from lincolns site the Rita contends is a tape between her and Lincoln about the Nannies.Because of Lincoln saying he thought the tape was doctored I listend very closely and it does seem that the noises he talks about very greatly from place to place and even between her talking and him talking.I also heard Lincoln has now gotten an attorney and is also going after her.After what J Erdstom said I sure don’t blame him.I thought there was a hearing in California on the 18 also.Will be interesting how the judge rules on this as the laws from the US and the Bahamas are different.any way no matter the tapes clearly show Rita and BF trying to bribe people by offering them money for things.IMO she is toast and 4 or 5 dys later comming up with the so called tape sure seems suspect to say the least.Sounds kind of like the clown video It did not come out untill after it was edited.That team has enough people from law enforcement including VA to know how to edit a tape that they think will pass as unedited or I should say ex as none are now actually in or on the force.

IF I WERE STERN, GIVEN ALL THE INVESTIGATIONS GOING ON IN CALIFORNIA ABOUT WHO GAVE ANNA ALL THE DRUGS, AND THE UPCOMING INQUEST ABOUT DANNY’S SUSPICIOUS DEATH, I WOULD LAY LOW FOR A WHILE. I do not trust Lincoln Bain or the nannies. Yes, the tape incriminates Rita as it should. Be sure her sins will find her out.
The fact that lies could have been purchased from these nannies for $100 a piece to say what they did about Anna regarding Dannielyn does not sit well with me. I would hate to think what $15,000 and upwards would purchase. Lincoln Bain I think is trying to make a name for himself as with everyone else. It is a sad state of affairs that the media spins it however way they want and people buy into it because they are not given a moment to form an opinion of their own.
I believe in Howard’s innocence and I have seen nothing to cause that to change. Hang in there Howard and pray. You are not alone in this and you have every right to delay, push for, overthrow, overturn, step on, expose anything and everyone that tries to pull you down. I pray that God will give you faith like Daniel, strength like Samson, wisdom like Solomon, brokeness like David to call on him for help. I think the judge should grant HKS the injunction. The idea of RC trying to get people on the record after she has published and released the book to the public is absolutely appalling. No one should have the right to publish lies and expect to be shielded from those lies. Did RC really believe no one was going to sue her for the statements she made in her book? I believe, not only should RC be sued but everyone who gave her fasle information should also be sured.

I believe that Howard K. Stern, with the help of Lin Wood, is going in the right direction. Apparently, Rita Cosby did not research her book as she should have. In my opinion the book should be removed from store shelves. I also wish everyone would get off Howards back because it will probably come to light in the end that he was the most honest person here.

Tonight, October 17th, Access Hollywood will feature Maurice Brighthaupt better known as “Big Moe” who was Anna Nicole Smith’s friend and former bodyguard. Hopefully we will hear his side of that story tonight. Also, on the Biography Channel, there is a one hour series called “Final 24″. An idea popped into my head. My understanding is is that you are finally ready to start opening up and start talking but you refuse to do it on certain shows- like Fox News’ Greta Van Susteren. (Damn straight!) You have already done Larry King and frankly I don’t know anymore reputably shows you could do. Then I thought of 60 Minutes or Dateline NBC- something like that. What do you think? Not only am I sure they would be more than happy to have you but it would give both you and them a chance to sit down and really get to know not just you but Anna Nicole too. As much as I loved you on Larry King the other night I thought the pace was too quick and their was so much I wanted you and King to talk about but didn’t. For instance, rightfully so there was a lot of talk about the effect Daniel’s death had on Anna, but what was the effect Daniel’s death had on you?
People can say what the will about you but when Anna herself is seen as saying, “If I didn’t have Howard or my daughter, I probably wouldn’t be here” or when Anna is seen saying “I think he [J. Howard Marshal] sent him to me.” Its hard to argue agaisnt. I think it would really give people the chance to see something other than the quick video clip of the well suited lawyer walking into court. I think this would give you an chance to sit down and let people see your heart, to let people see why Anna loved you so much and to let people see why we support you so much. To let people really get to know both you and Anna Nicole.

I am pleased to note that LB is not prosecuting Rita Cosby at this point in time. He can wait to see how the HKS lawsuit progresses before launching his claim. Every lawsuit is a crap shoot so only time will tell if Howard wins this one. In any event,I wish him the best of luck. Rita is a joke and Howard should be able to steamroll her in court and at the very least see that no more copies of the book are distributed and that she does not profit at all from its publication. They are suppose to be very good friends so why isn’t RC using Debra Opri as her attorney?
Probably because:
(1) DO has her own legal problems connected to this story
(2) Based on the phone calls that Art recently had with DO
it appears that she is
distancing herself from her good friend RC
(3) I don’t really think this is the reason but is DO
licensed to practice law in NY?

Maybe Howard’s appearance on Larry King was a good thing but I wonder whether it would have been best to not appear at all, since anything he says gets twisted by the hateful, scums waiting to snatch him in their crocodile jaws.
Something has to be done about what is being done to Howard, but I don’t know what.

I agree…..I think you need to show a “softer” side to you like when Anna was alive and you two were interviewed with the baby. I am sure time is of the essence for you and you have a lot of irons in the fire, but I AGREE….you need to soften your public persona and get into those deep intimate questions. For example, what did you and Anna do for fun? What dinners did you like? What movies did you watch together….things like that. Please hang in there. I know you have been through a lot. I’m thinking no news is good news for Howard since if it was bad for him reporters would be crawling back out of the woodwork again. In the show cause order that’s part of the filing lin-wood-10-16-07-order-to-hear-motion-tro.pdf we’ve exclusively obtained, U.S. District Judge Denny Chin has ordered lawyers for Cosby and Stern to appear for a conference in his courtroom Oct. 18 at 11 a.m.

The only person destroying HKS is HKS for all of his lies and manipulations and greed. Virgie nor anyone else can do that, only himself. I am quite sure Mr. Harris will not print this, because I saw what he did to another gentleman who called Howard a liar on here. Secondly when did I admit Rita was lying, a manipulation of my words by you? I must have been sleeping at the time. Thirdly, how about someone saying HKS is now worth About $25 million from corporations he has set up on Anna, and Baby Dannielynne gets none because the corporations are all in his name. Is this what Larry Birkhead was talking about laundering money and now doesn’t want to admit it? Last but not least, I am not from Texas, but am from a small town in the South Central States. There was a Dr. who had 3 patients die from overdose of pain medication. They did the same thing to him that they did to Dr. E. and Dr. Kapoor. Search warrants at home, office and storage among other places and lots of T.V. coverage and newspaper coverage. Just to let you know that our Dr.s have laws to follow just like people who have two people die in their presence of unexplained circumstances.

You got that right!! There are no depths to which O’Q will not stoop to capitalize on this beautiful little girl. Pure evil exudes from the Texas camp and their cohorts. O’Q of all people should know that in the final analysis the law has a way of protecting the innocent. If Dannielyn does not inherit anything from the Marshall Estate then all this avaricious slander will have been for naught. Also, Dannielyn will probably be better off leading a normal life with Larry and his family away from the glaring publicity that has surrounded her since birth. My advice to Larry is - cool it with the publicity. It’s enough already!! Learn a lesson from what happened to poor Daniel who tragically left this world in the prime of his life.

I hope that this is a fair judge! and rule in Howard’s favor, because a blind person can see that Rita was trying to pay money for the nannie’s to lie this is unacceptable and Ms. Rita should not get away it. Sorry to hear that Cosby’s book is still on the shelves..we all saw and heard her attempts at “blackmail”..I suspect she may be charged, but failing this her lengthy “DO YOU KNOW WHAT I MEAN” repeated in every sentence of the tape and then some certainly shows her lack of expertise. I hope Howard wins his case… but …These were the people who were mean’t to be looking out for her..THEY FAILED DISMALLY! The legal system are “dragging their feet” but I certainly hope that Dr. Perper kept ANS long hair samples {which he told Greta he had taken} under pristine conditions…it will be very interesting to see the amount of drug use PRESCRIBED by Sandeep and Khristine charted against the ACTUAL AMOUNT OF DRUGS TAKEN {or given as ANS as she certainly was in no fit state to administer them to herself!!} I AM CONVINCED THAT HER DEATH COULD HAVE BEEN AVOIDED IF….many around her cared about her instead of $$$$$$$$$$$$$$$$$

Art Harris, you are to be commended for exhibiting the courage of your convictions. The popular theory is usually mindlessly embraced by the masses, and it is sadly evident in this media lynching of Howard K.
Mrs. Seder and Colleen, I so agree with your suggestions to Howard. If I can add one more suggestion for Howard it is this:
Yes, Howard is going to be compelled, perhaps, to demonstrate a softer side, even if he knows in his heart that Anna and he knew the truth. Evidently, those who seek to sully his (and Anna’s) name want to believe the lies.
I hope there is a way to publicly display the positive pictures and videos of Anna and Howard taken throughout the decade or more that they were together.
Howard shouldn’t have to exonerate himself, but the public’s appetite for sensationalism has, unfortunately, decided otherwise.

No Mrs. Seder, I am not one of the Florida appellate lawyers although I do have a legal background from another country. The entangled ramifications of all these pending lawsuits is beyond anything that I have ever witnessed or could have imagined. Just following the expanding events which occur almost daily is of itself an exercise in American law. I thank Art for publishing all the Court documents and will remain a faithful reader until all these many legal actions have been resolved. It looks as if we are all in for the long haul!!

JERRY BROWN cannot change the medical examiner,s report,you can look at this five ways to sunday,and still come out with accidental death.anna drug level was within normal range,just the mixture,of CH AND HER OTHER PILLS took her life,anna took so many pills before,this was not forseen.Howard did the one thing he should have done to try and help her,( HELP KEEP HER FROM THE LEACHING FAMILY OF HERS,After watching virgie and oq go after larry,and young new father,and making his live a hell,and time amd time again hearing virgie,s treatment of Anna in her young years and watching those pictures of Anna in 1991,BEFORE HOWARD,HOW DOES ANYONE HAVE THE NERVE TO PUT THE BLAME ON HOWARD,To me Danniel had a host of problems,i would not rule out FS for giving danniel methodone,to say Howard would do anything to hurt either one is way off, the one JERRY BROWN SHOULD BE LOOKING AT HE IS NOT ,BECAUSE OF OQ AND VIRGIE TRY CHECKING FS.,JERRY

I would like to know why our media is allowed to do the things they have been doing to an innocent man and getting away with it.
They have been allowed to have all kinds of criminals on their shows telling lies and showing stolen tapes that were private. Why is this being allowed? How do these people all get away with this? This is a modern day witch hunt and they have been trying to burn Howard at the stake, but we won’t let them.
Something needs to be done about these “news” channels and their hosts. They need to be held accountable for the terrible things they have been doing to one man. None of these people have any ethics or morals.
I wish I knew what we could do to stop these witch hunts, conducted by scum like Greta, Nancy and Geraldo and others. We have all emailed them, but it hasn’t done one bit of good. They need to be stopped. All of them, along with the criminals and other trash they bring on their shows. I can’t even describe the contempt I feel for all of them.
There should be a law so that this sort of thing isn’t tolerated. That would be a start. One of these times, someone is going to get upset enough to stop them for good. They should think about that a little, and start watching their backs. One of these times they are going to tangle with the wrong person. They should go after OJ, lol.

Just getting off from work~ anyway over the weekend on the Geraldo show , which I don’t watch” But he had a host of people from his choosing talking about Howard, they were saying that the reason Howard was taking pictures of Anna” is because he was going to sell the pictures for money. As we all know that taking pictures with your family is what people do’ for fun family time. My point is that one of Geraldo guest was shelley, and I’m thinking is this the guy SHELLEY that broke in Anna and Howard’s house and stole their computers, the baby ” pictures that Anna painted, and tapes, and much more… And SOLD them over the internet for money as in $CASH… that he put in his pocket. The way I see it.. ET tonight is the only “honest” news show that I have watched so far. ET tonight do not trash people they treat people fair. And I thank you! et.

I don’t know if you meant that Howard is weak, but I think he’s really STRONG. He has this air of intelligence and sophistication that most all the other people in this mess (Shelley, Thompson, O’Quinn, VIRGIE, Opri) seem to sorely lack. Because he doesn’t rant or rave people seem to think he lacks emotion or is cold and heartless. I think it’s a sign of…good breeding that Howard doesn’t act all that emotional (on the witness stand or in public) but I suppose a lot of the general public are used to the antics of brash, unsophisticated people out there who yell and scream and cry and rant in public on a daily basis (people on tv who have power and a big audience like Judge Judy or Oprah or Dr. Phil, for example), that they think that’s the norm, and anything less is a sign of heartlessness.

Beverly, I agree that there is nothing on earth that can justify the injustice and pain HOward is being put through. I do hope that every single person involved in Howard bashing will somehow find themselves in situations a million times worse.
By the way you feel, you obviously did not mean to say Howard is weak. He conducts himself with dignity and restraint due to his proper upbringing. I cannot imagine that many people would have the restraint Howard has to not speak derogatorily about the deadly venomous snakes slithering around him.
