The Bald Truth has obtained billionaire Texas lawyer John O’Quinn’s blast back in the defamation suit filed against him by Anna Nicole Smith executor Howard K. Stern, an 11 page great ball of fire that argues Florida has zip jurisdiction over the mighty Texan and should kick Stern and his whiney complaint to the curb.
It’s all about the J word, he argues as a defendant filing a reply Thursday in federal court in Florida, where Stern has sued him for defamation for trashing him on talk shows as a “murderer.” Stern’s pitbull, lawyer Lin Wood, says JOq should pay big time for stepping waaaaaaay over the line.

All JOQ argues he was doing when he called Stern a “murderer” was leveling the playing field of public opinion for his client, Virgie Arthur, and he insists that’s as kosher as Texas toast.
“An attorney’s duties do not begin and end at the courtroom door,” his lawyer writes so eloquently. “Attorneys have a responsibility to preserve their clients zeaslously…and may be duty-bound to make statements to the media to protect a client such as Virgie Arthur, who had been subjected to considerable adverse publicity in the weeks heading up to O’Quinn’s retention.
“At a minimum,” he argues. “”O’Quinn had the right to effectively ‘balance the tables,’ in advocating his clients’ entitlement to assert her paramount interest in determing where her daughter was to be buried.”
That’s right, the not so subliminal message: put that dead blond beauty in Texas soil, in JOQ’s backyard, where Virgie wanted and the next headline might be how jurisdiction helped Mama win a seat at the Marshall inheritance table.

In defending his right to call Stern a murderer, before and after the Florida investigation ruled out foul play in the accidental overdose of the actress, O’Quinn even quotes a law journal interview with his adversary , Lin Wood:
“As an advocate for your client,” says the lawyer who defended the late Richard Jewell, Patsy and John Ramsey and others vilified in the media, “you’ve got to go out and litigate in the court of public opinion. You’ve got to take advantage of the willingness of the media to let you come on their air…to discuss your client’s position in a high profile case,”
But Virgie as victim? Howie as killer, Larry as an unfit Gay Dad, c’mon, Texas, where the decency in any of this. Will Virgie say and do anything to find a path to the trough her daughter blocked in life? I thought O’Quinn should have been disbarred. His remarks on the air have been totally defamatory and he should pay the price. He is a very sleazy lawyer with a sleazy past. It’s no wonder he is Virgie Arthur’s lawyer. Sleaze attracts sleaze. They are all in a conspiracy to discredit Howard and now Larry, so that Virgie will become executors of both estates and gain custody of Dannylynn. I certainly hope judges and jurys see through them.

Hi Art: When O’Quinn made his statements on national television, I immediately thought that what he was saying was defamatory and contacted the Texas State Bar through their web site. At the time I did this, it was unknown to me that he had had other problems with the State Bar.
IMO, his comments were unprofessional and a violation of the Code of Ethics. O’Quinn should not be allowed to get away with this deplorable behavior and it is my hope that HKS prevails!
In addition, is there any way that when you mark documents with the “Art Harris” logo, you could do it in a way that the document can still be read. I find it frustrating that I am unable to read anything with this logo on top of it. Thank Art!

hi art. thanks for the information. i hope they nailed oquinn to the wall. he should have pay for what he did to stern. if i remember correctly, howard didn’t address the media while he was in court fighting for the remains of anna nicole smith. the things printed about vergie had to do with her statements on the stand and comments and questions by the attorneys involved with the case. am i wrong? it was vergie and her attorneys that started the smear campaign. if i remember correctly howard was just defending himself. he has only give maybe three interviews since anna death. once when he was reunited with dannielynn in the bahamas. and about the breakin. outside the court house in the bahamas where he standed he wouldnt fight for custody and would help larry get full custody. then in june when anna will was probated and the interview at dannielynn birthday party referring to rita crosby book. he is letting his lawyers do the talking for him. i just wish larry would do the same. vergie is just waiting for larry to mess up. but larry loves his daughter and has the right to raise her. vergie needs to drop the lawsuit, which she stated on the greta show it was just a formailiy. which is it vergie? you can’t have it both ways.
art, what happened in the contempt case on sept 26th. did g.ben thompson show up this time? does this mean he won’t be there for the inquest? i don’t understand why people find it hard to believe that daniel’s death was accidental. anna nor howard would never ever hurt daniel. the inquest has people up there as witnesses that have already been caught in lie after lie. and how can rita crosby take credit for getting the inquest put on the books? the bahamas was looking for a new judge to oversee the procedure.

All O’Quinn calling Howard a murderer did for Virgie was lead the public to believe that she’s got a hack for an attorney. That’s how I felt when I heard him call Howard a murderer. I wondered how an attorney could be so stupid as to step over the line so publicly. Even Opri had the “sense” to whisper the “murderer accusation” under her breath and away from the cameras so it would only be their word against hers.

I think at the time O’Quinn was riding the wave of the media frenzy. That and his own arrogance made him think he was untouchable. Then Lin Wood appears and the media scurried back into their little holes leaving O’Quinn to paddle to shore in a very leaking boat.
Down and dirty is the game. Texas lawyering seems pretty rough and tumble. I ran across this. It’s Joe Jamail taking a deposition. Jamail represented the clients that O’Quinn bilked in the breast implant settlement. I think Wood’s style is a wee bit different.

More than likely O’Quinn is playing the odds, hoping to delay these proceedings until after the inquest is a done deal in the Bahamas. If things don’t go well there for Mr. Stern (for some biased miscarriage of justice) then possibly O’Quinn’s position will improve in the defamatory case.

Virgie herself said on that interview w/ Greta that she wasn’t trying to take Dannielynn and raise her, though if she had to she would…she said something to the effect that she was worried when Dannielynn was 14 she might want a porshe (some kind of expensive car) can’t remember the make. I’ll have to try & locate the transcripts on that interview - it really showed that her only concern was having a say in how Dannielynn’s money would be spent!
Again, I’ll state my opinion that HKS will make sure that Dannielynn has an estate when she becomes of age, and Larry will make sure that little girl grows up with a good education along with his family, little cousins, aunts & uncles, and so forth showing her ‘unbiased’ true love for just being Larry’s child. She wouldn’t get this from the Texas crowd - Anna knew that, and Anna told the world through the ET interview with Mark.

I am from Texas also. When I heard him say those things, along with other things on the shows, I was sick to my stomach. No matter how you look at it, it was not right. period. And as far as him now referring to Virgie being as good as texas toast. Well, texas toast is BAD for you, white bread, the butter will harden your arteries, and it is fattening! LOL It is usually served with chicken fried steak and mashed potatoes. So, that does not say a lot about Virgie, now does it?

You’re up s***screek Mr. O’Quinn. I have been following this whole saga since before Anna died and not once did I ever hear HOWARD say anything bad about Virgie Arthur. It was always Anna Nicole that was out talking smack about her. And that wasnt until it Virgie Arthur was out talking smack about Anna and Howard. Even when Howard was under oath and had the the chance to tell the world the horrors he knew about VA, he was STILL respectful.
And good luck trying to explain away the fact that Vergie “Im scared for my granddaughter’s life in Howards’ care” Arthur tried a last minute appeal that would have kept DL in the Bahamas with Howard so Larry couldn’t take her out of the country.

I was watching him on some show once and as soon as he said that, I switched channels and never watched any of those programs again. O’Quinn and his client are the biggest jokes in Texas. Dannielynn is going to grow up and sooner than we all think. When this child is an adult does Virgie honestly think that her beautiful Grandchild will not see all she is doing now and how much pain and anquish she is causing Larry, Howard who raised her the first few months of her life see with her own beautiful eyes and KNOW the stories that Anna Nicole told everyone about Mommy Dearest are true? What goes around comes about and one day Virgie will get back all the heartache she is causing everyone now and that poor child in the future. Dannielynn lost her Mother, her Brother for God’s sake be there for her as a Grandmother should be and stop this nonsense. IF Virgie loved Anna at all she would get her principles straight and think of her Grandchild and ONLY her Grandchild. This to me shows her interest is money only. When my Sister passed away my Mother clung to her Granddaughter even though she was grown because she was a part of her own Daughter which she had just lost. Everyone knows that HK$ was negligent with his care for ANS. It’s like Aruba…the Bahamas botched the death of Daniel and Dr. Perper botched the death of ANS. Give Larry a chance to raise his daughter, please convict HK$ of at least Negligence…?

I remember that interview with Virgie when she said larry was still young. Implying at his age he cant handle money(how old is he and how many ADULTS his age still have mommy handling their finances?

Time will tell all. Rita Cosby will be broke after being cleaned out by lawsuits. Debra Opri, too, she will be scrounging for clients. VA will just be more of an embittered old battle-ax, LB will probably marry the woman he’s been seeing for sometime, and give Dannielynn a sibling, and hopefully, HKS will be able to pick up the pieces of his life, meet someone nice,and father a child that will be his this time. LB already has his child, and it looks like Dannielynn will have a good life with him.

I read an interesting article about O’Quinn dating back to 1998. Most of you have probably read it, but it gives an insight into how he operates , and why he tries so hard to have the defamation suit transferred to Texas.

I believe a large part of Vergie’s behaviour is the result of having little/no contact with ANS for so many years and then toward the end, being heavily influenced by the likes of Mark Hatten and his sister who no doubt told her “lies and embellished stories” because they have a grudge against HKS, big ditto Larry at the time, another big ditto Ford Shelly and GBT, and OQ who is probably heavily connected to the Marshall’s who do not want to part with their $$$ - no way.
The rest of her behaviour is the the result of her own life/family experiences which certainly don’t sound like the norm. At this point I believe Anna would rather have us pray for her than spew forth further hate.

That is why she lost her child,At least for now.At least she had the sense to know whe was not the best person to take care of them at this time and gave them to Kevin early.Brittany needs a support system which she does not have at this time
