Bald Truth Exclusive: New Horizon’s Court Docs! G. Ben Thompson Drops Claim To Anna’s House, But Files For Damages Against Lawyers, Estate

In a Bald Truth exclusive, we’ve obtained the August 16 court document that says developer G. Ben Thompson is dropping any claim to the Horizon’s home he’s maintained he owned and bought for Anna Nicole Smith.
The late Playboy centerfold said it was a gift, and held a deed to the property that is now part of her estate.
In the ‘NOTICE OF WITHDRAWAL,” lawyer Godfrey Pro Pinder says Thompson, who claims to have briefly dated Smith, “wholly withdraws their legal action” claiming he owns the $950,000 home he helped arrange for Smith.
But we’ve also learned Thompson has filed a separate lawsuit for “damages” against the law firm that represented him in the Horizon’s deal, Callander’s and Company, and named Smith’s estate executor Howard k. Stern, in what sources say, is a roundabout attempt to recover what he says he spent to secure Horizons for Anna Nicole.
However, under Bahamian law, it’s highly unlikely a judge would allow GBT to sue anyone else until he pays court costs to Smith’s estate; Stern has always maintained his longtime companion owned the home.
Last year, after discussions between Smith and Shelley broke down over the house, witnesses say she kicked him off the property and out of her life, and her lawyers won court injunctions designed to allow Smith to live there with Stern and her baby, Dannielynn, undisturbed, while they battled over Horizons in court.
Then, last year, Pinder tried to serve an eviction notice for Thompson, news crews in tow, and briefly had Horizons power turned off, with the baby inside. In March, just over a month after Anna died, he tried to oust Stern, who had hired top Bahamian lawyers Cedric L. Parker, and Wayne Munroe, to fight for Horizons and the estate. In May, a judge ordered Thompson to post a $100,000 cash bond to cover court costs in case he lost the title fight.
After missing one deadline, Thompson son- in- law Ford Shelley told me he aimed to put up the cash, then missed another. Their lawyer, Pinder, later told me in an exclusive interview he’d urge his clients to fight “even though they might feel they are throwing good money after bad.”
Then came the August 16th Surprise, apparently signaling they’d reversed field, and Pinder quietly put the court on notice his clients were tossing in the towel. Or so it seems.
Now after bailing, Thompson still has to defend himself in a countersuit Smith filed for title to the house–AND he’s filed a new lawsuit for damages against his attorneys in the Horizons transaction, Anna’s estate and Stern as executor.
But the South Carolina developer also faces a daunting August 28 court date –and possible jail time—for contempt charges stemming from the Horizon’s break-in the day after the reality star died of an accidental overdose in Florida, and for violating court injunctions in trying to evict Stern.
Thompson skipped the original court date, earlier this month, claiming he’d been “threatened” and feared coming to court. Stern and his lawyers have called that ridiculous.
Some court watchers say they need a scorecard to keep track of it all, including a separate criminal case Stern has filed against Ford Shelley. Days after he was charged with burglary in connection with othe Horizon’s break-in, Shelley turned in some items he admits taking to a South Carolina sheriff, but has told me and others he’s yet to surrender all property belonging to Smith’s estate and her daughter, Dannielynn. Her father, Larry Birkhead, recently told me Shelley confided he had more items stashed with relatives in South Carolina.
Shelley claims he obtained permission from a lower court judge to enter the house, before taking Smith’s videotapes, laptop computers, paintings from the nursery, sunglasses and other items, purportedly at Anna’s request, to protect them. But the so called Clown tape quickly surfaced on a cable news show, edited down to snippets from what I’m told was an hour of Anna goofing deliberately on tape, later spun to portray the scene as Anna gorked on drugs. Photos from her laptop of immigration minister Shane Gibson also popped up in newspapers.
A computer forensic examination of Smith’s harddrives, detailed in an exclusive report we’ve obtained, shows the laptops were copied within hours after Shelley says he took them.
With the Horizons’ reprieve, what this means for Stern, and Smith’s four dogs who live with him, is one less lawsuit, and it also buys Stern time to decide how to handle the house for the estate and the future of baby Dannielynn.
Only no one expects Thompson and Shelley to fade away. Especially Shelley.
“I know Howard’s going through a rough time right now,” Shelley told FOX News host Greta Van Susteren on Feb. 13, “and I pray that he’ll get over this and he will survive. But, I’ll tell you this. Justice will prevail, and I thank the Lord every day that I live here in the United States, because I can I tell you, having to fight something in the Bahamas whether you’re right or wrong, it’s who has got deep pockets. I’m done. (But) I will not lay down.”

G. Ben Thompson, the man who engaged the late former Playboy playmate Anna Nicole Smith in a legal dispute over the Horizons mansion before her death, has withdrawn his original lawsuit over the house.
Almost simultaneously, Thompson filed damages against five different parties including Howard K. Stern — as executor of Smith’s estate — and the Callender’s & Co. law firm, which handled the sale of the house.
Thompson has alleged that both Stern and Callender’s & Co., along with Horizons’ first owner, Ronald H. Kelly, the Americas International Bank Corporation Limited (AIBC) and the AIBC liquidator, George Clifford Culmer, were involved in the controversial sale of the Eastern Road mansion.
“We believe that all these people were involved in the case [and] we need all five defendants to be brought together so we can sort it out,” explained Godfrey “Pro” Pinder, Thompson’s legal counsel in the suit, in an interview with The Guardian Wednesday.
“Instead of just Ben Thompson against Anna Nicole Smith, who has now passed, all these parties will now be a part of it.”
According to a copy of the notice, Thompson is alleging professional negligence and breach of duty by Callender’s & Co. and negligent and or dishonest misrepresentation to Smith by the parties by word or conduct, or both.
He also alleges that the five defendants caused his involvement in a “notorious law suit” with Smith’s estate, as well as false advisement that his instructions were carried “out to the letter” which “deceitfully” caused him to send moneys to pay AIBC, Culmer and Kelly on behalf of Smith’s estate.
As a result, Thompson alleges that he suffered damages, slander in his title, loss, expense and costs.
The housing dispute between Smith and Thompson goes back to October 2006, after the death of Smith’s son in Doctors Hospital, when Thompson alleged that Smith was not the actual owner of the house because it was his money that had paid for the mansion.
However, Smith counter claimed that the house was a gift from Thompson following a previous relationship between the two. After the initial claims, both parties filed claims against the other.
Smith was involved in that lawsuit, as well as one with Callender’s & Co., up until her death in February.
Callender’s & Co., which originally represented Anna Nicole Smith in her purchase of the house, became involved in the very public controversy when allegations of false information surfaced.
Former Immigration Minister Shane Gibson then became a part of the controversy when allegations surfaced that he had expedited Smith’s residency application, despite her not having the necessary documents and not being the lawful owner of the house.
Speaking in the House of Assembly, Gibson alleged outright that Callender’s & Co. was to blame for the mix-up. Now, Thompson is alleging the same thing.
“We believe that the law firm made an error in not getting proper documents from her — like a surrey note and mortgage,” Pinder said.
In the suit, Thompson is asking for an unknown amount of damages, a return of all sums paid by Thompson to the defendants, interest, loss, expenses, costs and “further and other relief”.
The writ was filed on August 16 and the defendants have 14 days after receiving notice to make an appearance in an action at the suit.
Responding to the suit, Michael Scott of Callender’s & Co, told The Guardian yesterday: “It’s completely absurd. These individuals are essentially the authors of their own difficulties. And at all times, Callender’s & Co. acted in accordance with their instructions, which included giving Anna Nicole Smith possession without insisting on proper security documents to support loan commitments. They are now seeking to make other people scapegoats for their own behavior, including besmirching the names of reputable persons in this community. As far as I’m concerned, this is simply a display of breathtaking inanity.”

Thanks Art for keeping us updated on this sordid behavior of Thompson & Shelley. I sincerely hope that Shelley is not let off the hook for his behavior AFTER breaking and entering Anna’s home. Airing stolen property on national media is a low beyond low.
Also, if Shelley has stashed stolen property with relatives in South Carolina…..they should be prosecuted for receiving stolen property. Is there anyone in that family with ethics?

Confusion is the best defense. Switch one lawsuit for another, waste court time; keep people in a perpetual state of law shock. However Mr. Stern is a bright man and he will counter sue for everything coming his and Anna’s way he is a natural pit bull. Shelley, I too, hope that justice will prevail and we all get to see your sorry hide thrown in jail for all the criminal acts you have committed and all the anguish you have caused Anna and Howard.
And that goes for everyone else who has slandered Howard. He’ll have to live with that stigma for the rest of his life. Never mind the fact he is innocent. All the small minds will cling to the lies that were bandied about so maliciously. Small minds feed on hate.
I’ll tell you, I never knew how utterly hateful and vicious people were, until I came online in search of a site who supported Howard and found to my dismay, some sites that were just horrible. The people were absolutley rabid! I really feared for his life. I did find some sites though, that were in support of him, but unfortunately not before seeing a glimpse into the small, hateful, rabid minds of so many people. It was truly a frightening experience.
Just think everyone, if these people were on the jury at YOUR trial and they already tried and convicted you the way they did Howard. Scary thought, huh?

Thanks again. Your reporting on anything ANS related is more up to date than some other sites.
Before these latest actions or in this case non-actions in this case by GBT and/or Ford Shelley I had believed that their story might have been true. Now I’m wondering if maybe ANS and HKS were telling the truth. I mean why would GBT just give up on a house ($950,000 house) that he claims he owns? That’s a lot of money to just throw away.

Howard should not let up on these people until he has recovered all of Anna’s property. They should be made to pay for the harrassment they put Anna through during her hour of grief.

Whatever the legal merits of either side’s ownership claim may have been in court, the karmic merits at least seem clear. The unnecessary damages caused by Thompson and Shelley to Anna and Howard’s lives and reputations can never fully be compensated for, but $950,000 would seem to be a just desert.
Happy first birthday to Dannielynn. If Howard keeps his stride, she may just eventually become the “billion dollar baby” Nancy Grace wanted her to be.

I see this Thompson/Shelley partnership similar to when bullies get the weaker people involved in situations way over their head. To me, Thompson is a pathetic man being pushed around by a tougher bully. Regardless of Thompson’s past dealings, Shelley is many times worse and that may be the reason he latched on to his wife. Shelley “fell in love” with a young lady whose daddy would allow him to step over him in order to forge ahead and advance in the world. I believe that from the time Shelley laid his eyes on the prospective daddy-in-law, he saw a doormat where he could climb up the ladder. He reached high, higher and higher…. I hear the ladder creaking, it is swaing in the wind….Watch out! Oops, there he goes!

Pro Pinder sure showed his face on all the TV stations, Wonder if he is hiding now………I think that the drugs in that Refrigerator was planted. I know she was on Prescription Drugs, but doctors hand drugs out like candy anymore………….I really felt sorry for Howard, but he was silent and I truly thought he was innocent of everything they accused him off. I always said the most these people had was a note from ANS for the purchase price — anyone who has bought a house knows you don’t give a deed without getting the mortgage first — and they are in the real estate business !!
I am sure that they have also filed a claim against the estate for the purchase price.
Their behavior was terrible — Shelley has no excuse not to turn over to the daughter those things he “stole” from the house.

Kira #50… I also hope that Howard eventually finds love and happiness with someone who deserves him and it’s a shame that Krista Barth is already married! I watched her closely during and after the Florida trial. She was very impressive and the thing that I liked most about her was her interaction with Howard. She seemed very protective of him and seemed to truly care. She is a smart savvy attorney and beautiful to boot. As handsome, intelligent and downright decent as Howard is – he can have his choice when the time is right.

All the talking heads that were maligning Howard, don’t have the decency or the guts to come out and publicly apologize to him, they are also too stupid to realize how much better the public would think of them if they did apologize. Any decent person would not have done what they had been doing to begin with. Do they realize at all, what so many people think of them?

I just read the item in the Nassau Guardian, according to the story a big fight is in the near future. It doesn’t seem that GBT is hiding. He has filed one big lawsuit.
Still, I don’t know how this would decide ownership of the Horizon estate.
Also, I smell a rat—I don’t think for one minute that GBT would just give up rights to the expensive house. I do, however, believe they have come across some information that supports ANS in her claim the house was a gift. HKS and ANS have found a loophole that they laid their claim on.
Now comes the news that GBT is dropping the suit. I don’t believe it. Consider this, the house will go to DanniLynn. Her father is her guardian. This would give him all the opportunity he needs to work a deal with GBT.
Time will tell.

This board should be renamed the Howard Fan Club. I shake my head when I read from some of you that Howard should have the baby. It sounds like a couple splitting up their possessions, and the baby should be treated like the silverware.
The people who feel this way can’t possibly have children of their own. She’s a human being, not one of the dogs. Her mother is gone; she belongs with her father. He obviously loves her and is trying to give her the best life he can.
As far as Larry giving Howard the house, it’s not Larry’s to give….it’s Dannilynne’s. Give all of Anna’s money to Howard? Why? Again, its Dannilynne’s. Who would be low enough to take that baby’s wealth? Well, except for some of the posters on this board.

As soon as I saw that comment from Trishmurphy, I thought of you right away lol. I don’t know why people keep thinking just because he is Dannielyn’s father and guardian, he owns everything that is her’s. I do realize Trishmurphy seems to be on Howard’s side, but Horizons doesn’t belong to Larry.
I don’t trust Thompson one single bit in this Horizons house deal. I can’t get over the nerve of Thompson and Shelley. They are the lowest of low. I just hope so much that they will soon get what’s coming to them and that they both end up in prison where people of their ilk belong. Anyone else would. I don’t understand how they keep evading the law. One day it will catch up with them.

I’m concerned about Howard being named in the suit with the 4 others …it’s a bait and switch – they will give up a claim to what is soon to become Dannielynn’s house in order to collect errors and ommissions insurance payments or other damages from the law firms and their liability insurance co. This way, they win, Larry wins, Dannielynn wins but not Howard. He is being named individually in this suit, not as the representative of ANS estate even though the article refers to him as the executor. GBT and Shelley always wanted Howard to be the one to “pay”, not Anna, because they thought he was 100% responsible for the situation and said it more than once to the media.
The best part about coming here today? Reading the support for Howard.

I congratulate Art on continuing on with the Anna Nicole story. It is true that Howard Stern had a lot of criticism and most of the other players in the situation weren’t too attractive. However, I think that Entertainment Tonight and Art as evidently being part of that organization, has treated Howard with kid gloves. You don’t seem to challenge what he has to say or question some of the very bad judgment he showed. That is the only thing I don’t like about Art–he is too biased for Howard.

#65 I agree with your thoughts regarding the Horizon’s property. I’m wondering about the two other properties..the house that Anna was building in the Bahama’s, and the house in Studio City that Anna owned and where Larry and Dannilynn are residing.
Possible scenario: Larry gets Horizon’s for Dannilynne, Howard gets the other house in the Bahamas, and Thompson gets the house in Studio City, since he can’t own land in the Bahamas.

People who are in love usually use bad judgement at one time or another. It is pretty clear hear how much he loved her and he would have jumped off a cliff had she asked him too.
Just from watching her reality show she was in control of her own life and lived it the way she wanted too. I am sure he has a lot of regrets and misses her dearly. Leave him alone now.

If you want to concentrate on daily horrors, there are plenty of 24/7 news channels to keep you in knots and crawling the walls.
Had you not written positively about the president, I would have dismissed you as an unimportant. Our President is doing the best he can under the most unpleasant times and circumstances; he does not deserve to be torn down, especially by those who would be lost if they were in his shoes. How is this Howard’s house? Doesn’t it go to Dannielynn, the rightful heir to her mother’s estate? All this gossip indicates Howard has somehow come away with a house he deservedly earned. Mostly, I’m skeptical of Howard’s role in fighting for a house in Anna’s name, especially because of his unique attachment to the place.

This is justice!!! At long last. Why haven’t we heard anything from Catherine Crier or Nancy Grace (who I USED to like) or the idiot Greta? Of course they are busy eating their meal of crow! At least Howard can take some small comfort in winning this round. There are a lot of us out here in video land who have our own thoughts and don’t need to be spoon fed false beliefs especially when we can see through all their LIES, innuendos and malicious gossip. I am so happy to hear that G. Ben did the right thing. He knows that he gave that home to Anna. He knew he would lose. Him and his sneaky son-in-law Ford Shelley, deserve to lose alot more. They stole all those things from Anna’s home that were priceless. That is amazing that they aren’t held accountable for what they did. Howard is doing so well defending Anna and her memory. I feel so sorry for all the grief that he has entailed up to this point. He really is a remarkable man. So many called him names and said such bad things about him and I know that those things hurt him deeply. Especially when they talked about his Anna. He has defended her for years and he is still trying to clean up the mess that was left behind and he is doing a great job of it. Anna left under terrible circumstances and Howard was left to sort through everything and to try to make heads or tails of it. He has done a good job of it. I think he is a terrific person and I know that he is excited about going to Dannielynns birthday and he deserves to be there.

This move by Thompson does not surprise me. He most likely had no choice and was forced to take another path. I believe he was hoping to avoid having to sue his attorneys. Months ago I read a opinion piece, written by a Bahamian attorney, indicating Anna’s death changed everything in regard to the transaction, under Bahamian law. He all but said that Anna’s passing made the claim moot. IT DOES NOT MEAN THAT THOMPSON IS CONCEDING HIS POSITION THE HOME WAS NOT A GIFT! It just means that he couldn’t win under BAHAMIAN law and had to seek remedy elsewhere.
If find it incredibly difficult to understand why Anna would be given such an expensive “gift”. It is much more credible that Thompson offered to help Anna get residency by making it appear she owned the house. Besides, what person, in their right mind, would accept such a “gift”, move to another country, and not have written proof of such a gifting of such a hugh investment? I can’t imagining an attorney advising her to do this without a receipt of a gift of the property in hand.
My husband and I were gifted an airplane from his father when his mom passed. We had the receipt of the gift before the transfer was even begun. We also reported the gift to the IRS and Franchise Tax Board in CA where we live.
Once again, I’m advising you to step back from this story. You have become far too one-sided on the issue. I believe the truth to this story has yet to come out.
