Bahamas Inquest Judge Fired for TV Interviews; Daniel Smith Death Probe Delayed Indefinitely

We’ve learned the coroner’s inquest judge into the death of Anna Nicole Smiths’ son, Daniel, Monday was booted off the case for yakking to the press about what might happen.
You remember Chief Magistrate Roger (Don’t Go There) Gomez. Well, his boss, Supreme Court Justice John Lyons, ruled Monday he’s toast after popping up on television in an interview that “departed from accepted judicial convention,” according to the Nassau Guardian, the island’s leading newspaper.
Lyons said he just happened to catch the controversial interview while channel surfing, sources tell me, and heard the lower court judge waxing on “about what about what was going to happen or might happen” in the case. NASSAU, Bahamas: A magistrate presiding over an inquest into the death of Anna Nicole Smith’s 20-year-old son in the Bahamas was dismissed Monday by a judge who scolded him for discussing the case in a television interview.
Supreme Court Justice John Lyons said Magistrate Roger Gomez should have told the media to “buzz off” when they asked about the investigation into the mysterious circumstances surrounding the death of Daniel Smith.
“Things have got to be done properly,” Lyons said.
Howard K. Stern, the attorney-turned-partner of the late reality TV star, arrived alone for the hearing and there were none of the camera crews that previously attended the high-profile court battles over where to bury Smith and the custody of her infant daughter.
The inquest, was convened to determine whether her son’s death was accidental, suicide or perhaps even a homicide.
Daniel Smith died Sept. 10 as he visited his mother three days after she gave birth in a Nassau hospital to her daughter, Dannielynn. Authorities say he died from a combination of drugs including methadone and antidepressants.
Anna Nicole Smith died in Florida on Feb. 8 at age 39 from an accidental overdose of prescription drugs, including a powerful sleep aid that a lawyer for Stern said she took to cope with grief over her son’s death.
The inquest has been delayed by a challenge from Stern’s legal team, which wants jurors to take a questionnaire to test for possible bias. Lyons said that the magistrate who will replace Gomez in the case will rule on whether to allow the questionnaire. The magistrate has not yet been named.
The Bahamian Coroner’s Court had picked a seven-member jury, but they will be discharged and no date has been scheduled for the inquest to resume.
Gomez is the second official involved with Smith’s case to be reassigned for remarks to the media. Chief coroner Linda Virgill was removed by judicial officials for telling reporters that Daniel Smith’s death was “suspicious.”
Stern, who came to the Bahamas with Smith last year, has been living in the waterfront home they shared. He gave up custody of her infant daughter last spring after DNA tests proved Smith’s ex-boyfriend Larry Birkhead is the father.

Chief Magistrate Roger Gomez was ordered dismissed yesterday as presiding judge in the Coroner’s Court inquest into the death of Anna Nicole Smith’s son, Daniel, after Supreme Court Justice John Lyons ruled that a television interview Gomez gave about the case departed from accepted judicial convention.
Gomez, the second judge to be dismissed from presiding over the inquest, had, according to Lyons, who inadvertently viewed the questionable interview, talked “about what was going to happen or might happen” in the case.
“The present coroner has got be removed from this (and) there’s got to be another coroner,” Lyons ordered, adding that the only thing he knew judges who were asked by journalists to comment on cases that they were presiding over to say in response was: “Buzz off.”
Noting that he had “no experience” while practicing as an attorney or during his judicial career of any presiding judge giving press interviews about a case they were considering, Justice Lyons said: “It’s not a practice I am going to approve of.”
He also ordered that the new jurors that will be chosen as a result of his ruling should be selected from “as wide a poll as possible to draw jurors from.”
The selection of a new magistrate and jury will result in further delays in the start of the inquest — the matter has already been stalled for more than nine months—- as dates that fit into the schedule of the new presiding judge will have to be set.
The matter came before the Supreme Court after an attorney for Howard K. Stern, Anna Nicole’s attorney, partner and executor of her estate, who has been named as a witness in the inquest, challenged the selection of the seven-member panel that had been chosen. The Supreme Court has oversight of the Coroner’s Court.
Although Lyons stopped short of granting a request by Stern’s attorney, Wayne Munroe, for potential jurors in the Smith inquest to be compelled to answer a 30-item questionnaire, the judge said the new coroner appointed to hear the matter should use his/her discretion in ensuring the panel’s impartiality, particularly in light of the media attention the case had garnered.
Lyons invited Munroe to submit the questionnaire to the new presiding judge to be appointed, saying it was up to that judge’s discretion whether any part of the questionnaire would be adopted.
He did concede that Stern had been the subject of unfair media coverage early on, but added that journalists had since become more balanced in their reporting.
Neil Braithwaite, the lawyer who appeared for the attorney general and is named as a respondent in the matter, argued that there was no need for the questionnaire as it was routine for judges to warn jurors about considering information they may have heard or read in the media.
Attorney Debra Rose appeared for Bill Smith, Daniel’s father, who has asked that his 20-year-old son’s body be exhumed from its present burial spot here, along his mother’s body and returned to the United States.
The inquest into Daniel Smith’s death was originally set for hearing in October but met its first speed bump when Magistrate Linda Virgil, who had been responsible for hearing all Coroner’s inquest, was dismissed from her responsibility and the de facto system altered to allow other magistrates to hear Coroner’s inquests. Virgil’s dismissal came shortly after she told reporters she knew the cause of Daniel Smith’s death.
The case was eventually reassigned to Gomez and rescheduled for March. But Stern’s lawyer’s motion to block the seven-woman jury, who had been selected by Gomez, resulted in the chief magistrate putting the case on hold indefinitely while the Supreme Court deliberated.
Daniel died Sept. 10, one day after arriving in The Bahamas to visit his mother who had given birth to his half sister Dannielyn days earlier. He was found dead the morning after spending the night in the same hospital room as his mother.
It has been concluded that Daniel Smith’s death was caused by him ingesting a cocktail of prescription drugs, including methadone. A coroner’s inquest would determine whether Daniel Smith’s death was accidental or the result of foul play.
Daniel Smith was the son of Anna Nicole and Bill Smith, who married in 1985 and divorced two years later.
Anna Nicole died in a South Florida hotel room Feb. 8 and autopsy reports have concluded that she too met her demise as a result of consuming prescription drugs. Foul play has been ruled out in her death.

I think this was a very good day in court for Howard to receive a fair trial. Obviously they have already had to change some things due to the media bias as mentioned above. The jurors and Gomez being dismissed seems like a new start in this!
and thank you for keeping us informed of this tangled legal web that will one day end and Howard can rest in peace! I do wonder what he will do when this is all over. If the Marshall’s thing is settled and I were him. I would chalk up his legal career to be a winner and go on vacation forever

Im happy to hear this latest news. I would like the inquest to go on. Only to clear Howard from any wrong doing, it just seems an impossible task.
As far as Billy Smith this idiot who had NOTHING to do with his son for a number of years now wants his body exumed and brought back to Texas. Where were you Billy all those years that Howard and Anna were the only Parental figure that Daniel had?

For a father to ask his son to be moved from his mothers side in death is a real ass. He had nothing to do with Daniel for 18 years and now thinks he can come in and move him. They are resting together and should never be seperated. What is wrong with these people? Virgie I’m sure is doing her best to upset the cart. Anna had a reason to keep away from her and now I’m really seeing why. She still wants control. Even in death.

The big question that i have is the ppl that will or wont show at the inquest. Because Daniel was in the Bahamas such a short time prior to his death, no one can demonstratively show that these drugs that caused his death were not given to him in CA or taken by him at or before his hospital visit. Daniel was hospitalized in CA not that long before his Bahamas visit. He was extremely nervous about flying. My understanding is that no US citizen can be forced to show up in the Bahamas. One of the main testifying witness is no longer w/ us..FS/GBT might not show their mug there(even tho GBT was at the hospital). How can this inquest really be thorough(as it shud be)? I am sure the Bahamian ppl are courteous and fair, but i wud hate to be an American being ‘judged’ by any foreign citizen who walk into court w/ their Bible in hand(as that first panel of women did) at this time in history. I hope the media brainwash wears off and Daniel/HKS/ ANS can get some level of a fair hearing. We know it is not a trial, but lets get real(it might as well be called that). I hope that the witness list is drastically adjusted to only reflect the relevant ppl and not the tabloid list that was originally submitted. I hope that the panel of citizens see thru all the bs and do exactly what they did in FLA(accidental-not provable foul play). I wish they had the same procedure as the US where the coroner,ME,pd, prosecutor do the leg work ahead of time before sending it to any panel of citizens to decide. Again, if all relevant citizens that knew Daniel in the US cannot be forced to show up, this inquest shud be brief and deemed no ‘misadventure’. Last thing, i was relieved to see that the presiding jurist that appeared on and gave a tour to GVS was replaced. I am sorry to hear the judge for Daniel’s inquest has been removed, only because it should be heard and done with.
On the other side HKS can concentrate on matter’s at hand.
I can’t imagine Mr. Smith being allowed to exhume Daniels body, he was not in Daniels life, so he can’t say he is a grieving father. If he was serious he should have been around before Daniel was buried.

If he really cared about him where was he at before his death. Its funny, here we had Larry that fought tooth and nail to get Dannielynn and then we have Billy Smith who we have never really seen or heard from until now.
Art, Once again thank you for the update. I also agree with Mish, I would like to see the inquest get started so that Howard is cleared of everything and he can try to put some of this behind him. I know that he needs his time to grieve and he will only be able to completely do that when everything has been cleared up in the courts.

I’m happy that Gomez was tossed. He thought he was being smart and got foxed. Howard will be ok. The truth will come out and all the blamers will be put to shame whether they admit it or not. People should realize that if Anna had thought for a second that Howard had done something to Daniel, he would have been tossed from her life. Nobody else would have thought anything about him being involved, had it not been for the cruel media mongers. I think it’s disgraceful what they did to him. I hope he gets the last laugh.

I agree with the # 1 comment. Virgie’s Bahamian attorney; ‘Rose’ was directed by O’Quinn, I believe to try any strategy to get Daniel and Anna back to Texas.

I remember the Florida trial when the Judge got Daniel’s biological dad on the phone. It was great! Bill Smith messed up and said he wanted Daniel to be buried w/ his mom. Virgie’s other attorney said something to the effect;
Bill, don’t you remember what we talked about?…or maybe what the lawyers told him to say! Bill Smith is not going to ‘fork over’ one penney to get Daniel’s body exumed and flown to Texas – then the burial expense to have him laid to rest in TX… The ONLY reason Bill Smith is asking this is because Virgie’s lawyers were trying everything they could to get Anna’s body brought to Texas. I believe they figured if Daniel was there, then so should Anna be…
Then O’Quinn could have leverage with his connections in Texas and have Stern shut out of Anna’s business. I truly don’t know what they were expecting; Virgie and her family to have control of Anna’s assets or future assets??

I have respect for alot of people. Especially the dead. Anna and Daniel are together where she wanted to be and where she wanted Daniel to be. If she didnt want Daniel buried in the Bahamas she wouldnt have had him buried there.
For Billy Smith to come forward after all these years and say he wants his son brought to Texas is a joke. He said Via telephone to the Judge in FL that he wanted Daniel with Anna his mother.
Virgie knows that if Daniel is moved the right thing would be to have Anna moved.That is the way she is hoping to win her fight.
If anyone is to learn a lesson in all of this it is to be sure you have your wishes CLEARLY spelled out. Anna should have had her will updated after Daniels death(5 months) and it should have been spelled out clearly that she did not want Virgie to have any part of her childrens lives or any part of her Estate. That is one thing I think Howard dropped the ball on and I KNOW he would agree.

Debra Rose is now represent’g Billy Smith(are there no other lawyers in the Bahamas?). These Bahamian lawyers seem to just shift from one client to another in this case. BS had his chance before Daniel was buried and at the FLA hearing when Judge ‘Sideshow’ called him and he stated that ANS shud be beside her son in the Bahamas. The decision was made by his mother months ago. No real reason for him to be moved now. Debra Rose’S petition shud be ‘DENIED’. STOP THE MADNESS.

Virgie and her clan need to stop the madness. That includes Billy Smith. If he can’t show cancelled checks where he made his child support payments, his case should not go forward. Smith really wants to pursue this, but he is being hustled by Virgie and her stupid legal eagles. Even if Daniel was moved which he’s not going to be, they can’t move Anna. Now that won’t happen. Also, part of the original delay was the citizens of that country were upset that the one for Daniel was being fasttracked ahead of others. Also, if i were HKS, i wud have requested everything he is now. For months we saw a media lynching from here to across the waters of HKS. Who in their right mind wud ever want to be involved in any inquest in such a climate? IMO, that panel of citizens and witnesses shud be tested and retested/questioned and requestioned/investigated and reinvestigated up to their gills before anything goes forward(if at all). Daniel died almost a year ago, ANS died a few months ago. Calm the hell down(all u haters will not get your pound of flesh). Justice must be blind and fair(key word FAIR).

jojo I don’t see where HKS blocked the inquest his attorney just asked if they couldask a few questions of the already picked jury and the courts stopped the inquest until they could hear this and decide. This last time had nothing to do with HKS it was about one of the judges going public with information about the inquest, which is forbiden there

Maybe it would “appear” differently to you if you were in Howard’s shoes, what with the media and so many others calling him the “m” word and everything else their mean little minds could conjure up. Not to mention the “paid to lie” maids hired by Shelley and Thompson.
Also this Gomez that payed court to Greta Van Sustern; I remember watching that on TV. He was showing her all through the courtroom and I was sitting there not believing my eyes, that someone would actually do something like that. I thought, O my God, I don’t beleive this is happening. I’m so glad they dismissed this guy as they should. I hope Greta gets what is coming to her also, as well as everyone else that did harm to Howard.
Everyone has been doing their damnest to set Howard up. Cowards that they all are, they took a man at his lowest point in life, while he was grieving, and made him out to be the bad guy, which he isn’t.
Now JoJo, if you were in his shoes and had gone through all the crap he has been through, wouldn’t you want to do all you can to make sure the people on that jury will be fair? I have to wonder if they can actually get a fair jury at this point. Also would you want witnesses who were paid to lie about you?

Actually, Howard was named Daniels guardian and TRUSTEE of his money, however,Daniel predeceased Anna,and was over 18, so I don’t know if that holds any weight except for the wishes of the decendant.
Now Anna’s estate has FULL CONTROL over the burial plots in the Bahamas, and would have to give permission for anyone to be exhumed from there. That PERMISSION WOULD NEVER BE GRANTED, so even IF,puppet-boy Billy was able to get AN ORDER from a Bahamian court(good luck with that) and the ministry of health to exhume,and the US customs dept to transport a body into the US, it doesn’t matter. I have read that digging people up in the Bahamas is UNHEARD of…
not to mention, an extremely expensive endeaver…
Virgie has no shame and is a disgusting excuse for a human being using a mentally handicapped person like Billy ..wonder how much $$$ she bribed him with?

#29, Mish.It won’t happen. First of all, Billy Smith is not going to get Daniel moved. Secondly, Howard is not going to cave in to any of Virgie’s nonsense. Anna wanted to be where she is. The courts put her there because of her wishes and that’s where she’s going to stay. Virgie has found out that being estranged from your child can be damaging in more ways than one. This is just payback for her. Anna had custody of Daniel, not Billy Smith. He didn’t try to be a father to Daniel before Anna died, now it’s too late. He most certainly can’t be a father to him now, so he needs to leave things alone. Even if Billy was successful, which he won’t be, Virgie still has no standing. So, O’Quinn can call her “just a sperm donor”. lol

How stupid are some of you? Howard is not Daniel’s legal guardian because he was already DEAD when Anna Nicole died and her will was read. When you pre-decease someone and you are in their will, it doesn’t matter what it says about you, it’s a dead issue (no pun intended). You can’t inherit money and you can’t be put under somebody’s thumb (i.e., guardianship, which by the way is for children) because you’re DEAD. Danial was an adult, he wasn’t disabled or mentally challenged, so AGAIN, it’s a dead issue. Or how would you like someone try to take hold of your affairs just because your mom never updated her will?
Love your site, Art, but I have to wonder about the IQ’s of some of your posters.

I think you’re right about the guardian part, but the will can speak to the fact that you didn’t want the natural father to be the guardian in the child’s life. That speaks volumes. Why wouldn’t you want the natural father to be the guardian? It also speaks to who you did want as guardian and why. I don’t think this will even have to come into play, because Anna was Daniel’s guardian and sole supporter for years and that’s where she chose to bury him.

I just happened to be searching the web into the inquest of Daniel Smith and found this repulsive site. I used to respect Art Harris, but based on this site and the people who are partaking in their views, this is twisted, and my respect has been depleted. This is such a tragic story , with 2 people dead and a precious little girl who will know her Mom and brother through the eyes of someone else. I cannot believe no one but “1″ other person, on this comment site that has a clue. Howard KS , is , I believe the person responsible, for the untimely deaths of both of these people. Daniel did NOT like this man and his influence over his Mother, and using drugs to keep this influence going, up until she died. If you watched her reality shows u would know she was repulsed by howard ks. She treated him like he was a piece of gum stuck to the bottom of her shoe. Has everyone here forgotten all the lies he told on Larry King. I hope the truth comes out and justice prevails.
