EXCLUSIVE: New Horizons Break-In Lawsuit! Contempt Action Looms for G. Ben Thompson; Court OKs Howard K. Stern To Sue Anna’s Ex; Will GBT Get Jail For Break-In, Eviction Move? Sources Say August Hearing Set

In a world wide web exclusive, The Bald Truth has uncovered a Bahamas court order that allows Howard K. Stern to ask that the developer who has been trying to evict him and Anna Nicole Smith from the disputed Horizons property be jailed for tresspassing and contempt.
The Bahamas Supreme Court order, posted here publically for the first time, gives Stern the greenlight to sue –and demand jail time for two figures who have vilified him in the media as a “squatter:” South Carolina developer G. Ben Thompson, and his lawyer, Godfrey Pro Pinder.
The howardcourtorder.pdf order cites “their joint and individual breaches” for allegedly going on Horizons property when court injunctions were in place protecting Smith against such intrusions.
Stern declined to comment; calls to Shelley, Pinder and Thompson’s lawyer, were not returned by press time, but we welcome their input.
At the time, Thompson was suing Anna Nicole, and later her estate, for title to the home he claims he sold her for $950,000, and she believed was a gift. Two judges issued injunctions banning anyone from entering the property to disturb the former reality TV star until the lawsuit over ownership was settled.
According to the order, signed June 19, Stern can apply for “an Order of Committal,” or contempt, against Thompson and Pinder for violating court orders issued Nov. 20, 2006, and Feb. 9, 2007, barring them or anyone from disturbing the residents.
One injunction was issued last fall when Thompson had the electricity cut off at Horizons; at the time, Anna Nicole’s baby, Dannielynn, was inside. Stern won a second injunction Feb. 9, the day after Smith died in Florida, after he learned Thompson son-in-law Ford Shelley went into the house to remove computers, dvds and other property. He told me he did it to make sure they didn’t fall into the wrong hands, “for safekeeping,” and later turned some of the items in to police.

To hear talk show crusaders chanting “evict Howard the squatter” mantra, you’d think Anna Nicole’s beleaguered executor would be long gone, aimlessly skulking Nassau streets with the good old boy’s boot print on his behind, begging scraps to feed Sugar Pie and dodging the next sucker punch.
“We have a court action to have Stern evicted,” declared Godfrey Pro Pinder, the Bahamian attorney for GBT, on April 13. “So it (won’t be) long now.“
Only “now” has come and gone; and as we’ve reported here exclusively, the developer could default on his Horizons claim for failing to post a $100,000 cash bond the Bahamian Supreme Court ordered him to put up by May 28 if he wants to press it.
Now, in a new Bald Truth exclusive, we’ve learned a judge has opened the door for Stern to sue Thompson and Pinder for contempt—and demand jail if found guilty.
In an order issued June 19, the court cites dates of injunctions that were in place to protect the Horizons’ residents when GBT made or authorized forays on the property to evict Stern and Smith., including the infamous Horizons break-in, Feb. 9, the day after Smith died in Florida.
When Stern learned Ford Shelley had removed Smith’s computers, dvds and other items for so called “safekeeping,” he obtained another injunction that day, Feb. 9, similar to the injunction issued Nov. 20. Stern obtained that one after Thompson allegedly had power turned off to Horizons with baby Dannielynn inside, and witnesses tell me, drove by with Ford Shelley to ‘observe their handiwork.”
Both dates were cited as “joint and individual breaches” by Thompson and Pinder. At the time, two Supreme Court injunctions barred anyone from going on the property to disturb Smith or Stern until a court ruled who owned Horizons.
Any foray onto property in the Bahamas with a court injunction in place barring entry may constitute not only tresspass, but contempt, legal experts say, with jail one possible penalty.
According to the recent order, signed June 19 and posted here exclusively, Howard K. Stern can apply for “an Order of Committal,” or contempt, against Thompson and Pinder “on the grounds of their joint and individual breaches of the orders of this court made” Nov. 20, 2006, and Feb. 9, 2007.
Sources tell us Thompson was served last week in South Carolina, and Pinder got popped with the papers in the Bahamas earlier this week.
An August hearing date has been set, and if a judge rules court injunctions were violated, Thompson and Pender could go to jail. Sources tell me Stern wants the book thrown at his attackers.
On November 20, a Bahamian judge ordered an injunction to bar those disputing Smith’s ownership from going on the property after Thompson and Pinder had the power turned off, then lead reporters to the house. Power was restored quickly, but a second injunction was ordered Feb. 9 after the Horizons break-in.
Another possible violation could involve March 22, when Thompson lawyer Pro Pinder tried to serve a summons to have Stern evicted, claiming he was tresspassing on the property his client says he bought for Anna Nicole Smith.

The common wealth statutes are in H. Sterns favor and the fact these slimeballs broke the law willingly on numerous occasions… I will do a tap dance when they are found guilty and not only have to submit financial monies in apology but also serve some time in the wonderfully accomidating Bahama jail.
Pro Pinder knew full well he was a disgrace to the Common Wealth while he played up to the US media spotlights, it was a disgrace seeing him lapping up the attention, while defending a crook. The under handed tactics he utilized to keep the charade going is indeed pitiful … He and his client reflect each others poor morals and values and depict a poor light of how the law can be used in a negative manner.
I bid H. Stern the BEST of luck and hope he gains more then what he asks for, the Majestrate is well aware, as are the citizens of the Bahama’s, the injustice done not only to H. Stern but also to Anna.

I remember that shameless attempt by Pro ‘Windbag’ Pinder when he showed up at Horizons’ gate w/ the tv cameras. They shud throw the book at that media hog & his thieving clan of clients. Not a day went by during the custody hearing in Bahamas that i didn’t see his grinning mug on CTV. I suspected back then, Windbag knew his case was weak, so he was trying to pull a fast one on the US public.
FS needs to be locked up right next to that vile doctor trying to sell implant video.

“Howard wants the book thrown at those he feels tried to take advantage of Anna when she was reeling from the death of her son”. This statement speaks volumns about the kind of decent human being that Howard Stern really is. He is not driven by greed or self interest but his love and devotion to Anna. I hope that he has something special in mind for Ford Shelly. I would like to see Howard’s “boot print on the behinds” of several more people but this is a nice start! In a perfect world Howard would have everyone either behind bars, losing their job, paying a fine, etc. for the sins they committed against him, Anna, Daniel and Dannielynn – everything which was illegal or immoral. Let us not forget that Larry was coming at them hard and fast with the help of Debra opri before, during and after Daniel died and I think that his actions hastened Anna’s death. In the perfect world I mentioned – Howard would have all his legal fights behind him and have custody of Dannielynn, just as Anna wanted.

Ford Shelley should have been arrested when it was first discovered that he and his pack stole into Anna’s home to collect what they might best capitalize on: tapes they could splice, art they could sell, personal letters. . .and possibly some evidence that might have been used against them? Better late than never, and I’m glad the court authorized this suit.
Question, Art. It was originally reported in the Bahamian papers that an ex-attorney of Anna’s was in on the heist. Any idea if this is true, and who she was, or what her motives were?

Hello Art, I am so glad that Howard gets a chance to pay these people back for all the harsh things they have said about him. I only hope that the main stream media gets a dose of the same medicine. No one has come forward to apologize to Howard for all the cruel things they have said about him. No media personalities have issued any retractions regarding interviews they had with FS and GBT. This story has appeared on ET Online (quoting Art Harris and his original story, of course), but why, oh why, don’t those outlets (NEWS OUTLETS!) that trashed Howard so consistantly, bother to mention these small victories? I never before realized just how biased and one sided the media was. NEVER. This whole saga has been a real education. Not a welcome education, but absolutely necessary. Thank you, Art, for being that lone voice crying out in the wilderness, demanding the truth, searching for the truth, REPORTING the truth.
I still believe that the majority of people out there want the whole truth and not some made up story that casts people as heroes or villains, all in the name of ratings. Ruining a man’s life for RATINGS? What happened to the pursuit of JUSTICE in America? What happened to innocent until PROVEN guilty? What happened to checking FACTS before reporting on a story? I am so glad that when Dannielynn wants to visit the graves of her mother and brother in the Bahamas she will be able to stay in the house her Mom last lived in.
A lot of the media will be eating crow after this. Starting with Nancy Grace, Greta and Geraldo, I believe the word squatter was used. I think every time the word was said in reference to Anna or Howard living in the Horizons a sum should paid to Anna’s estate and Howard.
In an earlier article you wrote this paragraph in a comment:
“Which gets back to the mortgage. Had they not tried to pull a fast on Anna in her darkest hour, it would have been settled, Howard K. Stern tells me. He wanted to pay them just to take pressure off Anna, who still considered it a gift from a friend and ex-lover, but after ordered Ford out, then later died, well, the rest is revised television history.”
And to think Howard was going to pay them off and the whole thing would have been settled, except for their greed. This was all about greed for money. But their big plan back fired. The love of money IS the root to all evil, as GBT and FS are finding out.
Now all of Anna’s and Dannielynn’s stolen items need to be retrieved an returned.

what I find interesting is that no one in a month has picked up on this. It seems that Howard is not a media show hog and that may have been one of his problems. He wasn’t comfortable with selling himself to the media so the media listened to the one’s that where attacking him.
Also, it took a month to get the “scoop” but Art is the only one who got it (NOT tmz or national enq).

Irene Ducharme in MA, #40… I was touched by your comments. I think more and more people are becoming aware of the kind of person Howard is, why Anna loved him and why only death could seperate them.
Ivy39, #37… Wonderful support for Howard and I feel the same contempt for those who have hurt him but it’s hard for me to accept when people use “Howard and Larry” in the same sentence. This is Howard’s fight alone. Larry could not figure his way out of a paper bag by himself. Howard and Larry are about the same age but there is a vast difference in the quality and maturity of those two men. Howard’s drive comes from his devotion and love for Anna. Larry’s drive comes from his love for Larry.

Those purported “court orders” were apparently from a lower magistrate’s court and may have been issued erroneously by a judge who was whamboozled and unaware a higher court’s injunction was in place barring others from going on the property when they were issued.
Whatever, sources tell me they were dismissed long ago, after it was explained that, no, a three does not beat a Jack, even in the Bahamas. Say the three man says, I win, and starts raking cash off the table, eh’s the winner ’til someone stops him.
I welcome other takes on this, but recall Ford Shelley did tell me his lawyer got verbal permission from some judge who was stricken with cancer, who said, sure, guys, it’s ok to go on the property to keep others from breaking in and stealing stuff. Love to see that court order, or maybe the judge just told lawyer Tracy Ferguson, who was there that day, to tell Ford it’s fine…
Reminds me of OJ looking for the real killer … maybe he still is, and that’s the mystery guy who’s BAAAAAAAAACK, and decided to insinuate himself into the sad Anna saga, steal her videotapes and give them to FOX.

I hope HKS knows there are many supporters behind him cheering him on. Well…it’s about time!
Howard is a GREAT LAWYER _ I’ve always believed that.
If I had to go through what he has been through with loss after loss and THEN deal with these criminals, I’d be tempted to just walk away. He never has..he just stays, keeps his head down – working in his grief. He is alleged to have said that Anna would want Dannielynn to have the best – and it’s clear she and Larry Birkhead have the same “best” thing Anna did – Howard. I hope he continues his legal manuvering and strategic “hits” until they drop every piece of information they took from Horizons back on his doorstep.
The odd thing? Howard is very honorable…He reminds me of the guy who will give you the shirt off his back willingly until you try to tear it off him..then you better run.
Go Howard. Your own personal “force” is with you.

Everyone that is not sure of this, here it is: HOWARD K STERN IS THE EXECUTOR! Larry is the guardian of Dannielynn’s estate. I am tired of seeing ” If Larry allows, lets, permits him”. What is so hard to understand about the roles? Anna named Howard. She didn’t name Larry except for when she used a few choice words that weren’t too accomodating.
Don’t get me wrong folks, I don’t have too much against Larry. LOL. He seems to be keeping his mug away from the camera now, so that’s some relief. As long as he keeps Anna’s precious joy out of the spotlight and takes good care of her, I’m ok with him.

I agree with you. I too am tired of people saying that Larry “lets” Howard do things. I don’t know where they are getting that idea.
Larry is darned lucky to have Howard looking out for Dannielynn’s best interests and Anna’s estate. I hope he is mature enough to realize that.
I also get tired of people saying that one can’t like Howard and not like Larry, since they are working together. Well maybe I’m the exception then lol.
And as for people calling us Howard lovers, well I for one don’t mind wearing that label at all and I wear it proudly. I do believe he is a very remarkable man and keeps proving it all the time.
