In a Bald Truth exclusive, we’re posting disciplinary records from the Texas Medical Board showing a paper trail of bad medicine and tough love (license revoked in ‘02, cancelled in ‘06) administered over the years to Anna Nicole Smith’s controversial cosmetic surgeon, Dr. Gerald Wayne Johnson, 67.
Now suffering from dementia, Johnson just closed his Houston office after surrendering his medical license last year, his lawyer tells me, and now aims to sell videos of his trophy nip-tuck, Anna Nicole Smith, if he can find a buyer.
In 1994, Johhnson videotaped Smith’s breast implant surgery when he installed assets that helped catapult a Texas beauty from stripper to Playboy centerfold. Attorney Gus Pappas insists his client owns the videos, HIPPA or bust, and that he’s free to sell them, especially now that the patient is dead. Others disagree.
“I’d hate to think someone who did this would be practicing medicine at this time in Texas,” Jane McFarland, chief of staff for the Texas Medical Board told me today. “It’s a good thing he’s not.”
Indeed, if Doctor 77027 still had his license, he’d be under investigation, she says, but the TMB has no jurisdiction to investigate complaints against the defrocked, even if one surfaces in a lawsuit like the one filed by Howard K. Stern, executor of Smith’s estate last week.
Johnson “made thousands of videos, of all his patients,” his lawyer, Gus Pappas told me in an exclusive interview today. “It was routine, for educational purposes and for his own use. But he always offered a free video to his patients, and I’m sure he did to Anna Nicole.”
Howard K. Stern, who requested an ex-parte injunction in California to stop any sales, last Friday won a restraining order against the Hollywood agent Johnson enlisted to market the video, Thomas Riccio of Universal Rarities. A judge has set July 20 for a show cause hearing.
Stern’s lawsuit says not only are Smith’s medical records protected by federal privacy laws, but the late reality television star would have never given her consent to be taped, or allow sales of her surgery video.
When Riccio showed him the tape, Larry Birkhead was “totally disgusted” by what he saw, according to the lawsuit: five minutes of Anna naked under the knife, to the soundtrack from Jaws, with nat pops of her Trimpsa lines laid in: “How Do You Like My Body?”
Riccio said it was understandable that he’d be “emotional,” but it was “just business” for him, the lawsuit said.
Pappas says the California judge erred in ordering copies turned over to the estate, and that the proper venue is Texas, where he’s ready to duke it out in court. “I understand their position, but it’s wrong,” he says.
Meanwhile, in another Bald Truth exclusive, we can report that Johnson Tuesday obtained a Texas restraining order barring his bidness partner, Riccio, from giving the tapes to anyone. Pappas tells me he’s just trying to round up his client’s property.
“If he’s given any tapes out, he’s breached our agreement that requires him to keep it confidential,” says Pappas, who drew up the contract between his client and the memorabilia collector.
Messages left for Riccio at Universal Rarities have not been returned. “I’m not sure who’s seen it, or has copies, but we want them all back. We have full approval rights anyway.”

Nice going Art! I’m so glad Howard is doing everything he can to stop this additional madness on top of everything else. Just when it seems like everyone is rounded up in this saga, another one comes out of hell.
I sure hope the day will come when he can run them all to ground, and be able to start enjoying life. He certainly deserves some peace and happiness. Howard, I’d take you on my side any day.

Un frickin believable! I’m stunned and disgusted. I think that is this was some sort of common practice to video tape patients TO SELL, most people would NEVER have any type of plastic surgery. This is beyond disgraceful. Yet another person trying to make money off of this tragic chain of events. GOD, this makes me sick. Stop the maddness!

Anna can’t even get the peace that she deserves after life. Congress shud get involved. Imagine what can of worms this doctor has opened up. My question is, was there a signed release from the patient? If not, case closed(all patients’ videos shud be sent to them or their estate asap). I will repeat, this sleazy behaviour of this doctor goes beyond just ANS(yeah right, dementia my b*tt).

Howard is doing a fantastic job of stomping any persons willing to make a buck off Anna. Well, done Howard, and I am so sorry you have to go through this and continue to do so. Confiscate and destroy!!!!! So that one day Dannielynn does have to see or endure all of this. This is what a father figure does for the love of the child and the love of his life, Anna.
I agree with an earlier poster….Where is that wonderful mother that said she loved her so much. NOT. She lives around Houston and she is quit as a mouse (rat). We don’t hear her ranting about exploiting her daughters name and what her precious granddaughter would someday see. I guess there’s no money in it for her?
I also agree with another poster…I am also ashamed of these foul persons living in Houston. I am ashamed to live in the same town, we Texans are not like this.

If this doctor supposedly suffers from dementia, can he REALLY BE OF RIGHT MIND to offer this video up for sale. A court injunction shud absolutely step in and stop this. Dementia shud be one reason to stop this. Hey Art, who did that bad implant surgery for ANS earlier in her career? Was it this doctor? Also, this wud be a time for VA to step in and show her daughter(after death) how much she cares by trying to stop this release. This story is truly disgusting. Barf bag pls!

Medical records belong to the patient, NEVER to the doctor. He has them, he keeps them for medical treatment purposes but at anytime when a patient as for those records, the doctor MUST comply. The doctors who charge a patient for making copies of their medical records are breaking the law. They BELONG TO THE PATIENT!! IT IS THE PATIENTS SOLE DISCRETION ON HOW THEY ARE USED!! In this case, they belong to Anna’s estate now and it is their sole discrection how to use them or if to use them or DESTROY them. Total DESTRUCTION of this property is the only fesible answer and should be done immedietly upon return to the estate. I have faith that Howard will come out the winner in this and if not, lets hope there are still etical people left in the media business and they won’t get any buyers for this disgusting, disturbing tape.
I think whoever owns the rights to the Jaws theme song should also sue this doctor. After all, it’s copyrighten, and I’m positive permission to use it in this way was never given or even asked for.

What is it with all these people from Texas trying to make money off of Anna ( Virgie, Lawyers, Doctors, Aunts, sisters ect.) maybe they should call Texas the Anna Nicole state.
This Doctor sounds like a dirty old man video taping breast surgeries.

I remember the story about one of Anna’s implants ruptured and it leaked into her body and she was very, very sick and had to be rushed to the hospital. Is this the same doctor who did that? What a low life after he caused Anna so much pain in life now he is going to cause the ones who loved her pain in her death. This is so sick.

Who recommended this doctor to Anna? Do you know how she became involved with him? Didn’t Anna have a lot of pain and health problems from these implants? Aren’t these implants a lot of the reason she needed pain medicine most her life?

They have missed the point. If an individual, like Howard, can be persecuted in the court of public opinion with innuendo, lies, speculation,unfounded rumors and suspicion, then none of us is safe. Indeed, the man used manic depression and many other excuses such as his own family to evade financial responsibility. On the M.A. document that ART supplied, it shows 5 dismissed malpractice cases however there are many more serious cases of malprctice accrediited to the doctor.
I think the media needs to be informed of this latest case for no other reason than to expose this man in Houston. I’ll bet many more women would come forth!!!

This man’s actions are despicable. Every time I think we have seen the worst from the dregs of society, something else, even more horrible, comes to light.
No amount of money or fame in the world could make me want to be in the limelight.
No one should have to go through this kind of invasion of their privacy. Everyday, I see more and more, the reasons why Anna Nicole wanted, no needed, to look for peace of mind on distant shores.

As unethical as this doctor may be, I hope that the California court throws the case out on jurisdictional grounds. This case belongs in a Texas court and once there, the book can be thrown at these doctors. Until then, it simply comes down to preventing forum shopping; Howard K is a prime example of a lawyer thinking he can go to court wherever he prefers in order to get the desired result (e.g., Marshall v. Marshall).

ummm yeah…but in the USA,CALIFORNIA courts have Jurisdiction over Anna’s estate, and this is an estate matter…
This is estate property and unlawful desimation of her image that is under the authority of her ESTATE. Get with the program and have a beer…that tape belongs to Anna’s estate.

I am a patient of Dr. Johnson’s. I know for a fact that he is ill. I can’t believe that he is trying to publish this video. He always makes videos of his patients and tells you AHEAD of the surgery that he will be making them. As a matter of fact, you are required to sign something so that he can make them. I am defending that he is a great doctor and that he is truly ill. I don’t defend that he should be publishing this video.
