Howard K. Stern Fights Back, Sues for $$; Lawsuit for Defamation Against “Texas;” Will Virgie Lawyer Pay for “M” Word?
Making good on his threat to sue those who called him a “murderer” on national television, Howard K. Stern filed his first lawsuit for defamation Friday against Texas lawyer John O’Quinn, the mega-millionaire attorney for Virgie Arthur who often trashed Stern as a killer, before and after he was exonerated of any crime in the death of Anna Nicole by a major police probe and a medical examiner.
The lawsuit, filed in West Palm Beach, Florida federal court, asks for unspecified punitive and compensatory damages for slander and invasion of privacy, citing O’Quinn’s “recent appearances on … national television…in which he has made public accusations of murder and other misconduct against Mr. Stern.”
Stern cites one appearance on Greta Van Sustern’s Fox News s how, Feb. 21, 2007, when the swaggering O’Quinn publically accused him of being a murderer. In a statement issued Friday we have below, attorney Lin Wood said the accusations were not only false, but Stern would “hold him accountable thorugh the civil justice system.”
O’Quinn could not be reached for comment, but if he stays in character, can be expected to scoff at the charges, and we hear, has plans to file his own wrongful death e lawsuit against Stern soon. O’Quinn, also acused him on the Nancy Grace show either the first week of April or the end of March. I couldnt believe what I was hearing, It made me sick to think that pompous ass could get up there and say that, or that Nancy Grace could allow it. He stands up there and talks about how great grandmothers are, as if to say just because you are a grandmother you are a good person. There are a lot of mean old ladys out there that hurt their children and then their grandchildren. Look what happened to Ann Nicole, it will break my heart if anything hurts little Dannielyn. I dont think Larry will protect her enough, and I really wish Howard had her. He is so strong, you can tell he did his job to protect Anna Nicole and that is why so many people hate him, they wanted to use Anna Nicole and they couldnt get past Howard, I have full respect for Moe also and I hope he does write a book, I will buy it as he really loved her and would write the truth. I admire the people from Trim Spa also. She had a few good people around her.

O Quinn couldnt be reached for comments because he doesnt care. He has his eyes set on the Marshall estate. Couple a million to him, no biggie, so he has to give a collectable car? money and suits arent going to change the way people feel about Howard anyway. Had Howard not delayed everything in site, people might have just blown O Quinn off. Howard gave them a reason to talk and made his self look guilty. I dont feel sorry for him, and I predict he will be in a court room for at least the next 10 years of his life.

I heard him on court tv several times call Howard a murderer. I was appalled, o’quinn. I am very happy about this I have always liked Howard Stern. I have hated to see him vilified for rating it is great to see him get retribution. Hope he gets lots and lots of money. Debri Opri was on court tv stating she hired a media firm for Larry Birkhead to boost his ratings in the public opinion poll, doing so they tried to destroy a good person. The hostile take over from Opri and O’quinn has always be obvious to me and I am sure to greta and nancy, they should know better and have taken our county to a whole new low. Putting any one on their shows that will say anything. They use to be reliable information but somewhere they turned into the national enquirer even using them for a news source. Unbelievable

I never thought I would say anything positive about Howard K. Stern but in this case, I think Stern has legitimate grounds for suing O’Quinn. His statements went far beyond his opinion.
O’Quinn has appeared to be drunk on various TV shows and I am among many who believe that. Greta tried to stop him from calling Stern a murderer and she kept pointing out that O’Quinn could not state any evidence.
And after VIRGIE’S latest drama today, wanting shared custody with Larry, I won’t object if he sues her, too. I think she is far too controlling and no matter what Larry does, I can see that it will never suit her. She seems like one of those people who will always be dramatic in order to get attention.. [Like mother, like daughter?] I supported her before because I believed that she was only interested in being the grandma.

I have seen John O’Quinn on Court TV on numerous occasions, calling Howard K. Stern a murderer. Virgie Arthur has insinuated the same, namely during the Florida court proceedings. O’Quinn and Arthur are clearly going to sue Mr. Stern for wrongful death in both the Anna Nicole Smith case but also in the Daniel Smith case. They are greedy, manipulative and hateful people. Virgie Arthur had no relationship with Anna, Daniel, or Dannielynn, but now she is suddenly concerned (about fame and money).
I am a Larry Birkhead supporter. Howard K. Stern has stepped up to the plate regarding the best interests of Dannielynn in working with Larry. The same cannot be said for O’Quinn and Arthur. They could not care less about the welfare of this child, they only care about money.
I hope that Larry gets justice by getting sole custody/guardianship of his daughter. I hope that Howard gets justice and his good name back by crushing Mommy Dearest and her renegade attorney.
I guess since Virgie couldn’t mooch off of Anna while she was alive, she will mooch off of her in death. Disgraceful.

Now I understand why O’Quinn showed up in the BAhamas today! He is “mad” at Howard and will use Virgie and the threat of his bill to get her to cooperate - or maybe she just will anyway if she smells money!
I hope and pray that Howard gets his just rewards for trying to protect Dannilynn (As Anna tried to do) from her mother. “Mommie Dearest” was the perfect way to describe her!

You haven’t done much research there, have you? Maybe you should even dig through some older articles on this very site and see what you can find… The prescriptions that were in Howard’s name were prescribed and INTENDED FOR USE BY ANNA NICOLE SMITH. The DOCTOR even said this, (hence her investigation..). Howard, not being a doctor.. how would he know what they were or even know what the risks were? My husband doesn’t check my prescriptions since he is NOT my CAREGIVER! I am a grown woman, just like Anna Nicole Smith was. Responsible for my own actions. As she was.
Howard did protect her as best as he could. He couldn’t protect her from herself….

Greta manipulated everyone on her show to say negative thing about HKS..but she was very careful to stop at the edge of the cliff when she wanted to agree. Its about damn time! Maybe it will not only shut up some of these commentators on the cable shows but the ones they allow to spew their garbage. I fervently hope that Lin Wood goes after ALL the hate mongers on message boards who have constantly called him a murderer. It is so obvious that these type of mindless people soak up tabloid tripe and think it is really factual news. They are the proof of what severe damage the media can do against someone.
Now how damn scary is that? Lin Wood always reminds us that the next witch hunt will always come. When, where or WHO is unknown but the next time it could be one of our innocent loved ones in their cross hairs.
America needs to wake up and start thinking for themselves and have the damn sense to question the ones who give us their biased views. I hope Lin Wood blows the top of this entire cesspool.

doctors of famous people perscribe drugs in other peoples names all the time, it is not Howard’s fault if any one the doctor. but I am not so sure about that either because the patient tells the doctor what they prescribed does not work and the doctor tries another antidepressant. What ever you can not blame Howard he was following Dr. orders. doctor knew the meds. were for Anna. Anna just lost her son and was in a very bad way. The doctor was probably trying different meds to see what worked for her. I know other patients doctor do that for. The patient has to be responsible in reporting to the doctor what they are taking to a point. These were not schedule 2 narcadics they were anti depressants. This is where the media has done so much damage in the sensational way they are reporting

Loss of consortium? For a relationship that did not exist? Add to that a live tape of Anna Nicole telling the world what she thought of her “birth mother”. Don’t forget that Daniel was also an adult and shunned granny as well. Does Virgie really want to publicize the skeletons in her closet? Probably not but looks like O’Quinn will offer her up for sacrifice to get a shot at the Marshall fortune. What a waste of the legal system.

You’re doing the right thing, and you have more support than you will ever know. Noone should be allowed to carry on in the media as O’Quinn has. I’m not only appalled by his accusations, but by the fact that the media keep parading him out for, what appears to be, nothing more than entertainment value. It’s disgusting. Most of the time he sounds delusional and drunk. If he didn’t appear so diabolical, I’d pity him.
Howard, you’re a stranger to us, but our hearts go out to you for the unimaginable losses you have suffered, and for the continuing accusations leveled at you. I am probably Howard K Stern’s biggest fan. I hope everything works out for him. It is a shame that most people want to see the bad. I always looked at Howard and Anna as having such a beautiful friendship. When things got bad for Anna everyone left but Howard. He was always by her side because he loved her. Plain and simple. It is such a shame that people don’t understand true friendship and love. I respect and admire Howard. Even now he will not allow bad words to spoken about Anna. He is still protecting Dannielynn, for Anna. I hope Larry can learn a lesson here from Howard.

Since the lawsuit, I have noticed Greta, and Nancy Grace have been watching what they say about HKS. The good news for him is all the accusations, and slanderous remarks are on tape. Honestly, if you have a friend that has a history of prescription drug use, I would never have prescriptions put in my name “for her use”. I just wouldn’t do it.
I am just confused.
What pain was she under that she needed methodone prescriped to her?
Even if it was intended for her, why not put it in her legal name or another alias? Why put it Howard’s name?
Why was the doctor prescriped half a medicine and the other half to Howard?
Why were there a series of wire transfers in the name of Howard and the doctor, orgininating from the doctor’s husband?
Don’t I have a responsibilty for the medicines in my name and to make sure they are dosed correctly?
What about that fax list of medicines? Didn’t a pharm tell them specifically this was dangerous and had another pharm professor call them to tell them that the person needed to be hospilized and to not give this combination because it was dangerous.
Bottom line, Anna didn’t drive. Who picked up these medicines for her?
It just really doesn’t make sense. I feel that there are alot of questions that needed to be resolved. Who cares about diaries, DNA, etc.
Two people have died.
I would like to understand how that happened.

I feel terrible that he isn’t the baby’s father however I do hope for Danni Lynn’s sake Larry keeps Howard in her life and please please please Larry don’t allow that old bag Vergie visitation let alone shared costody. Remember in the US there is no grandparents rights in court. So I would let her spend all her money on court costs in Bahama’s and then come back to the states and take her to court again and disallow her any say or anything to do with the baby, at least that is how I would do it. Like some others here, I hope Howard Stern also files defamation lawsuits against all the television “talk” and entertainment shows who allowed O’Quinn to make his blatantly slanderous statements. Particularly those hosted by lawyers who absolutely understood the legal ramifications of what O’Quinn was doing.
I would even include in that grouping those who allowed the California P.I. to tell a story about Daniel hiring him too. Not one of them bothered to inform their audiences that the P.I. was a personal friend of a jilted former lover of Anna Nichol with whom Daniel was living at the time they met. So there are many possible explanations for the meeting — if it occurred — other than the one the P.I. gave to police and tv. Too many to go into here. The point is media people never once questioned his motives for telling the story and the credibility of the story itself.
Whatever happened to the days when “news” people sought the truth instead of quick, easy ratings?

My sister and I loved ANS and we fully suport HKS in all of this chaotic mess. She just told me that Virgie wants legal guardianship of Dannielynn, 50% control of Anna’s possible inheritence and in the event something should happen to Larry, then she wants full custody and a controlling interest of the estate. What the hell is wrong with that money hungry fat slob? Why does she deserve any kind of connection with Dannielynn? Finally the world see’s that her motives are selfish and it isn’t about Dannielynn or the fact that Anna is dead and gone. My first concern would be that my daughter and grandson were just recently buried, and that I have a 71/2 month old grandbaby whom I have never even held. Howard was smart when he refused to let that witch pick her up. Virgie, Dannielynn will eventually have a say so about who is in her life. Larry should be ashamed of himself right about now. He sold pictures to a trash magazine for his benefit and his only. If he had a decent bone in his body, he would stay out of the limelight and raise that beautiful baby outside of the media. Howard has done a magnificent job of secluding Dannielynn and the only reason why he has been on tv was to answer questions that we all want to have answers too. Howard loved Anna and he would not betray her in anyway. Larry also had the opportunity to reside at The Horizons house, with Howards blessing. But he is back in Cally and running his mouth to anyone who will listen. What’s wrong Larry? Do the Bahamians not know how to highlight your hair? Cap your teeth to your satisfaction and receive botox injections? Larry doesn’t want Dannielynn, but the paycheck that could potentially accompany her. The same thing goes for Whalebate Virgie. Most people figured she was after the money but she laid it all out by making those demands regarding Dannielynn. Howard should be executor of the will, guardian of Dannielynn and have a huge position in her life. He cares about her, unlike those other players in this situation. Virgie apparently doesn’t have any decency to her or she would pack it up and go home. She is waiting on a big check that I hope and pray doesn’t make it in to any of this. Howard I am heartbroken for you and Dannielynn. You are the real father no matter what any test says. You must understand that in the end it will all work out for you. Every action has a consequence good or bad. LARRY’S motive is not about DANNIELYNN, it’s about that fortune that she stands to inherit. Surely the Bahamian Courts can see that and award custody to the best person for the job. Larry will never be the kind of father that Howard is. NEVER!!!! Howard you never know how all of this will play out. The judge may decide in your favor. Larry sold pictures very recently to Ok magazine for the almighty dollar. Dannielynns’ name should have been left as Stern. One day Birkhead you will have alot of explaining to do to “Anna’s and Howards daughter”. I’m sure that you haven’t even thought that Dannielynn will grow up, understand what happened to her mother and Daniel. Who is going to answer those questions so that it doesn’t screw her up. Once she is around Howard when she is older, she will see why Anna chose Howard and not Larry. Virgie go back to your trailer and leave Howard alone. You will never get custody of Dannielynn. If only Anna were here to explain why she dispised Virgie so much. Dannielynn and Howard will be together in the end. I do hope that the move Larry just made, selling pictures and stories to OK Magazine will come back and bite him in his butt. Howard I’ve said this several times but it is worth repeating. You and your family are a class act. You deserve to raise Dannielynn with lovely family members around who will do the very best for her. Virgie will have that childs’ mind so warped it will be tragic. The first person to ever accuse HKS of murder was Jackie Hatten. She was on Nancy “Disgrace”, Larry King and she called Howard a murderer. She also claimed that she saw HKS on numerous ocassions feed ANS drugs. She also claimed that she was Daniels Godmother and ANS bestfriend. Bullcrap. The CEO of Trimspa’s wife said she had been around for 4 years and she had never heard ANS mention Jackie Hatten. She confronted her on National TV. Larry King I believe figured out the she was a pathological liar and she didn’t return on his show. She should be sued for defamation as well as Virgie. She got a few thousand for giving up a fabricated story to a few tabloids and got caught in lies and now she’s right where she belongs. Back in TX in a trailer park. ANS had class and she wouldn’t associate herself with the likes of someone like Jackie. People will do anything for money and notarity. ANS’s mother baffels me and I’m not sure what to make of it. I knew it was about money, I’m not so sure of the courts and giving Dannielynn to the most responsible and best person. HKS is all she has known and my vote is with him. I just wish that he would fight for her. We love you Howard and keep on going.

I realize everyone is entitled to their own opinion, but man some of these people are incredible. What did HKS have to gain by ANS and Daniels death? Nothing. He is miserable and without Anna, Daniel and Dannielynn (soon). That man needs time to grieve and mourn that beautiful woman and mother of his child. Maybe not biological but just the same he is her dad. Larry was the sperm donor and that is so unfortunate for little Dannielynn. She is the most beautiful baby I have ever seen in my life. But then again look at her mother!!!!!! REST IN PEACE ANNA!!!!!

I believe that Anna knew she was deeply loved by Howard and that she wasn’t alone. Even though she had lost her beloved son, she still was surrounded by so much love from him. Howard has nothing to feel guilty about. He gave himself to her. What a man!

Yes Cindy from Knowxville, You said it best, it was like you were reading my mind. First of all Toney Potts said that Larry should take pictures of him and Dannielyn and he could make money, I think he said to put it aside for Dannielyn but Larry does have some huge legal fee’s to pay, that by the way he wanted ANS to pay for him before. I cant believe he has custody, I really think she would be better off with HKS also.
That Jackie that was on Larry King, I hope she gets taken to court also for calling Howard the M-word, the last time I saw her on Larry King it came out that her brother was put in jail, he got 7 years can you believe it to get 7 years you must have done something pretty bad, but she blamed HKS for that, He was protecting ANS from him. That is why Jackie told all those lies. All those people were so jealous,
What about ANS sister who wrote that book, Train Wreck, I cant believe these people they are all such trash, she was on Dr. Phil and couldnt answer one question she just dodged it all. She just wants to make money, I hope no one buys that book, She is discusting. Right after Daniel passed away and these people came out from under their rocks, first the mother I was shocked and I had really felt bad for ANS, then after she passed away and this sister materialized I had to shake my head. No wonder Howard had to protect her from these people. It is so sad because now there is a little baby and if Howard doesnt have her who will protect her. Larry just doesnt seem to be mature enough. He got his picture in the paper and made some money maybe now he will leave her with the person who truly loves her. My heart goes out to you Howard and I love to see your sister Bonnie out there, She has so much class as does your brother. The trim Spa people too are out there sticking up for Anna. Bless you Howard and you know you will come out of this shining as you should. There are a few of us who are not swayed by a bunch of lies.

Art, I am thrilled with Howard’s choice in L Lin Wood. Notice how the media has shied away from anything to do with Howard and the ANS saga since Mr. Wood came onto the playing field?
I also wanted to say that Jamie Floyd had an excellent point when she talked about the “Dark Knight”. Did you see that?

To Diana, thanks for the vote of confidence. I loved ANS and HKS. It breaks my heart to see what they have endured for so long. I realize this situation has to play itself out in the courts but that doesn’t ease my mind. Virgie is a demon with a polyester suit on. I wonder if the courts think like I do? I am on the outside looking in and the picture isn’t pretty. To all the players that are in the middle of this, I wonder how it looks to them? Does Virgie think she isn’t transparent? Where were all of them before Anna died? Exactly. They knew Anna would never give them another opportunity to hurt her like they did before. Howard has been the only real true love in Anna’s life. He tried to protect her from herself and others, to no avail. Anna’s estranged family should be ashamed of themselves. But they have no class and they don’t care so i’m sure that they don’t have a decent bone in their bodies. Anna, Howard and the rest of The Sterns are a 1st class act. I have always liked Anna and Howard and I always will. I don’t care what anyone says. Larry is also a shark after the money. Why did he pose with Dannielynn with his shirt off? That was a strange picture. Larry you weren’t in GQ or Playgirl. I felt such a strange vibe when I saw those pictures of him and Dannielynn. That’s his daughter. She’s not some model he’s posing with to win model of the year with. I thought it was a bit odd. Maybe Birkhead needs to be investigated also before he is awarded custody of that precious baby. The courts should leave her with her real Dad, HOWARD!!!! He has true love for her and he hasn’t posed for any pictures shirtless with Dannielynn. Something isn’ right here. Sorry but Howard K. Stern is a murderer. Why the change of heart now? He knew he was looking guilty as hell. His attorney advised him to work with Birkhead while he would go after everyone else. The Inquest into Daniels Murder is not over yet. Don’t count your chickens before that hatch. HOWARD K. STERN WILL BE CHARGED FOR MURDER. We all know that is the truth.

I am amazed at the long drawn out post you wrote. How long did it take you anyway? Howard is NOT and was determined to NOT BE Dannielynn’s father. He is nothing to her except for a LIAR! If anyone has to do explaining down the road it will be Howard. Any man that would lie knowing fully well he is not a child’s father keeping the child from her real father is worthless to me. Per Anna’s own words she thought it disgusting to sleep with Howard so the whole world knows there was no way on this God’s green earth that Howard was the father. Please note that the above headline is ambiguous to say the least. The $100,000 Bond will not go to ANS Estate if GBT loses the lawsuit. ANS Estate will have to submit and file a Bill of Costs, detailing the legal fees and court costs incurred by the Estate in preparation and during the trial. The Plaintiff will then have the opportunity to dispute these costs with the Court appointed Taxing Master. In any event, the Court Costs and Legal Fees guarenteed by the Bond for Costs will be paid to ANS Estate’s Bahamian Lawyers for services rendered. I’m not afraid to state my opinion here, which is, after reviewing all the know facts, and weighing them against all the known lies told my ANS’s entourage, up to and including Howard K Stern and Dr. Eroshevich, I believe Daniel and Anna were murdered, both by the same party whose initials are HKS. I believe he is a user, abuser, enabler, gigilo, pimp, who lived off a woman for 12 years. You bet he has shut up. You can bet is attorney has told him that he is burying himself with all the double stories and lies. I believe he is busy at the moment trying to cover his butt in the Bahamas, by either buy people off or making promises he has no intention of keeping.

Stay tuned; you may be hearing some information that may threaten your deep-seeded beliefs soon. Interesting that Anna hit the skids career wise before Stern began managing her affairs. The deliberate train wreck that was the ANS Show scored ratings records and put her back on the map financially. Do you think she’d have kept him around if he wasn’t pumping up the volume? As for shutting up, no one believes him when he speaks, so what’s the point.
He’s the designated scapegoat, and media bad guy, which fascinates me and makes me think, there’s got to be two sides to the story, or even three, so who stands to gain if he and/or Larry B. go down? Mmmmm? Right.
With the death investigations, both from apparent accidental overdoses, per Perper and Wecht, sure it looks fishy, but no wrong-doing by Stern in giving her meds has been charged, nor hard evidence presented, except smears from Ford Shelley, who sources tell me was in charge of giving Anna her meds when she stayed with him and his wife in Myrtle Beach before flying to the Bahamas…Later, I’m told he was the source linking Stern to Daniel’s demise as reported on TMZ and TV interviews that were widely considered gospel. This was the same time he was pressing Anna for a mortgage to Horizons, and providing ANS tapes allegedly purloined from Anna’s used by some in the media as anti-Stern lynchpin to pump up the designated anti-Christ.
I’m still curious why FS refused to meet with Bahamian detectives when they came to Myrtle Beach to question him. Some excuse about dental work was given, and investigators returned empty-handed.
So you have reached your conclusion based on an appearance of foul play that has been shot down by at least Florida investigators…Oops, Anna not murdered, say police. That shouldn’t matter to you, though. And you will no doubt dismiss that Daniel had been depressed and had drug issues, too. Which will come out soon and, of course, fall on many tone deaf ears.
Wonder what other old headlines may bite the dust or have to be rewritten?
